(R)08 - 82 OV11- 08-04 REQUEST FOR APPROVAL OF A GENERAL PLAN AMENDMENT FOR PORTIONS OF RANCHO VISTOSO, NEIGHBORHOOD 5, GENERALLY BOUNDED ON THE NORTH BY http://orovalley.granicus.com/MinutesViewer.php?view_id=5&clip_id=800 02/08/2010 Town Council Page 9 of 22 RANCHO VISTOSO BOULEVARD, ON THE EAST BY BIG WASH, ON THE SOUTH BY TANGERINE ROAD, AND ON THE WEST BY THE RANCHO VISTOSO BOULEVARD (Continued from November 4, 2009) Click here for Item 6 Acting Planning and Zoning Director Paul Popelka reviewed the Council Communication and highlighted the following: - Goals of General Plan amendment: - Relocate school site - Maintain existing development rights - Maintain majority of golf course acreage - Widen Honeybee Wash Corridor He then reviewed the existing and proposed General Plan land use maps, land use proposal and the golf course designation. Paul Oland of The WLB Group, represented Vistoso Partners, and reviewed the proposed parcel changes for Rancho Vistoso, Neighborhood 5 General Plan amendment and summarized the following: - Consistent with Town's General Plan goals and policies - Consistent with Amphitheater School District's intentions (Title work has been completed) - No increase to number of housing units (proposed reduction to Neighborhood 5 unit cap from 3,555 to 2,500) - Preserves the intent of the proposed golf course - Parcel 5-D to be designated as Open Space adjacent to Honeybee Park - Significantly widens Honeybee Wash corridor Mr. Oland identified the Town staff condition regarding installation of a sewer line connection up to Parcel B. He commented that Vistoso Partners did not have a problem extending the sewer line up to Sun City; however, they have asked that the requirement for the extension to Parcel B be deleted as they were not involved in the development of that property. Mr. Oland also explained that the Improvement Plan states that the developer of that property would be responsible for connecting to that lift station. Mayor Loomis opened the public hearing. Doug McKee, Oro Valley resident, commented that as the Town grows, there would be a need for another golf course. He stated that the proposed amendment retained the intent of the golf course but reduced acreage to a point that may not allow for a golf course to be built in the future. He suggested designating the open area at the north end of the property as an either/or combination of open space and golf course so that there would be http://orovalley.granicus.com/MinutesViewer.php?view_id=5&clii)_id=800 02/08/2010 Town Council Page 10 of 22 the option to place the golf course in the open space. Mayor Loomis closed the public hearing. Provide a full hydrology report (said report shall be prepared to the standards of the Town of Oro Valley Drainage Criteria Manual, including engineering data & calculations providing support of statements contained within) sealed by an Arizona Registered Engineer that addresses all of the following information: a. Revise this submittal to provide a qualitative description of existing drainage conditions along the downstream property boundary. b. Exhibit F1 — Revise the exhibit to Describe and map the characteristics of the existing on -site hydrology. Include the following: i. Approximate 100 year floodplains with a discharge greater than or equal to 50 cfs. This map has been delineated down to a 100cfs flow threshold. ii. In addition, a sewer stub -out shall be provided to the boundary of Parcel 5-B in order to provide a http://orovalley.granicus.com/MinutesViewer.php?view_id=5&clip_id=800 02/08/2010 Town Council Page 17 of 22 connection opportunity to relieve the Parcel 5-13 lift station should that HOA elect to construct such a connection in the future. The sewer main connection to the existing Sun City lift station shall be constructed according to the timelines set forth in the existing agreement with the Amphitheater School District or at the time another development within this amendment area generates the need for the sewer, as determined by the Town Engineer, whichever is required first. The location of the sewer line will be along the west bank of Big Wash and will continue by gravity to the closest connection point on Tangerine Road, as dictated by Pima County Wastewater Management. 3. Revise the included Traffic Impact Analysis to correct minor technical deficiencies as directed by the Department of Public Works. 4. Provide a sealed letter by an Arizona Registered Engineer that states that there are no floodways that will affect the areas of this PAD amendment, or revise the report to stipulate that there are none currently mapped and that at the time of development, floodway analysis will be conducted. And any development within floodways shall be subject to the associated development requirements and restrictions. 5. This map has been delineated down to a 100cfs flow threshold. ii. Peak discharges both entering and leaving the site for 100 year events which exceed 50 cfs using approximate methods such as the regional area versus discharge graphs. This is particularly important for parcels 5-R and 5- http://orovalley.granicus.com/MinutesViewer.php?view_id=5&clip_id=800 02/08/2010 Town Council Page 18 of 22 V. c. Revise the submittal to Identify if any features of the development (i.e. structures, roads, lots), as shown by the Tentative Development Plan overlay, encroach on and/or modify existing site drainage patterns. Explain why this is necessary and other alternatives that have been considered. d. Revise the submittal to Describe and map potential drainage impacts to off -site land uses both upstream and downstream due to the proposed development. The third paragraph states that a future detailed encroachment analysis will be conducted. This must be provided as a part of the required hydrology report needed for this submittal. Rough encroachment as well as floodway analysis must be provided to determine the extent of the allowable development. The only alternative to the floodway information request is to provide a letter as stated in condition 5 above. e. Revise the report to specify that all public streets shall be all- weather passable as specified in the Town of Oro Valley Drainage Criteria Manual, section 6.1 Criteria. Developments consisting of private streets shall provide at least one all-weather vehicular path from each dwelling/building to the public ROW system. This includes the streets identified in the TDP that access each habitable building. 6. Revise the site analysis to address the existing and proposed rights - of -way widths. The report does not account for the ROW width difference between Arrowsmith and Moore roads. 7. Revise the Site Analysis to describe the right-of-way and pavement widths, geometrics, design speeds and traffic control improvements which will be needed. 8. Revise the Site Analysis to describe proposed on -site street right-of- way, indicate their proposed ownership and show typical roadway sections. 9. Revise the Site Analysis, for proposed developments greater than 0.5 miles from elementary schools and greater than 0.8 miles from middle and high schools, to indicate safe bus stops and safe bus turnarounds, if required. Bus stops should be designed to allow residents to monitor the safety of children while at the same time minimizing the impact of waiting children on the adjacent residents. This should be provided as a part of the TDP. http://orovalley.granicus.com/MinutesViewer.php?view_id=5&clip_id=800 02/08/2010 Town Council Page 19 of 22 MOTION carried, 6-0. 5. Popelka, RLA/AICP, Acting Planning & Zoning Director SUBJECT: Public Hearing: OV9-09-03, The WLB Group, representing the property owners, requests approval of an amendment to Ordinance (0) 08-02, a PAD amendment for portions of Rancho Vistoso Neighborhood 3. Specifically, the applicant requests an amendment to the deadline contained in Public Works Condition #3 in the Exhibit "A" conditions of approval requiring the extension of Vistoso Village Drive from June 2010 to a date prior to any additional land use on the property that would require the road extension, as determined by the Town Engineer. SUMMARY: This request to extend the deadline for design and construction of Vistoso Village Drive is based on current economic conditions and the extended timeframe for development projects, including development on Parcel B, which the Town owns. Approvals to Date: • Town Council approved the Rancho Vistoso Neighborhood 3 PAD Amendment on February 6, 2008 DISCUSSION: Current Condition Design and construct Vistoso Village Drive to the southern property line of Rancho Vistoso Neighborhood 3, Parcel B, at no cost to the Town by June of 2010. Recommended Condition Design and construct Vistoso Village Drive to the southern property line of Rancho Vistoso Neighborhood 3, Parcel B, at no cost to the Town prior to any additional land use on the property that would require the road extension, as determined by the Town Engineer. FISCAL IMPACT: There are no fiscal impacts from this request. CONCLUSION/RECOMMENDATION: Findings in Favor.- 1 . Current economic conditions have forestalled development of Parcel B and the roadway is not currently necessary. 2. The amended condition maintains the same obligation for the applicant to design and construct the roadway at a date concurrent with the actual need for the roadway. Finding Against: 1. The amended condition is not "date certain" as it is currently written.
