La Canada Dr. Oro Valley, AZ 85737 Dear Sir or Madam: 1777 Cessna Way Oro Valley Arizona 85755 Igin of Oro This letter is to confirm that the La Cholla Airpark Board of Directors has voted and agreed to accept the transfer of approximately 2 acres from the lot at the SW comer of Beech and Corsair into the Airpark commonly owned property. This lot is legally described as 219-23-0670 in the Pima County records. The 2 acres is the approximate extent of Beech Way, which is also the Airpark's emergency runway. When the Airpark was created in the 1970's, Beech Way was an undulating dirt road. In the mid-19080's fill was brought in from construction on another Airpark lot, and the roadway was leveled and widened. Since it was approximately at 90 degrees to the main runway, it was decided at this time to pave it and create an emergency runway. The lot is in escrow, and the buyer does not want the liability of owning a portion of the runway. Since the La Cholla Airpark main runway is commonly owned property by La Cholla Airpark Inc., the Board of Directors agreed to take ownership of the portion that contains the emergency runway. Having the emergency runway being a part of the Airpark common area will benefit all of the Airpark residents. This lot is a unique situation within the airpark, and after the approximate 2 acre transfer, 6.345 acres will remain. The Board of Directors agrees to waive the 7 acre minimum rule for this specific lot, and would like to join in the request for an Oro Valley Zoning variance to allow this lot to be built on even though it is below the Oro Valley 300,000 sq. ft. (6.887 acres) standard. Please note that no extra building lots will be created by this variance, and the transferred area is the existing Beech Way road/emergency runway, so no changes would be detected visually. Please call me at if you would like any further information. Sincerely, I Gil Alexander Board Member, Secretary, La Cholla Airpark, Inc. Are there special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district? Yes. A portion of this lot is the Emergency Runwayfor La Cholla Airpark The runways are owned by La Cholla Airpark; Inc., the common area of the development. The shape of this lot is not representative of most of the other lots in the airpark, in that it has a 50 foot wide extension towards the airpark Eastern boundary, away from the main runway - most lots with similar extensions have them for access to the main runway. 2. Are there special circumstances that exist that are not self imposed or created by the owner/applicant? Yes. The lot shape was created in the early 70's upon initial development of the airpark The lot extension was not a runway at that time. Beech Way was not leveled until the mid-80's, at which time it was paved and became the Emergency Runway. 3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial property rights? Yes. The proposed land swap would relieve the new lot owner of liability generated by a runway on the property. This case is not the usual case in the Airpark, where the runway areas are owned by the common entity, La Cholla Airpark, Inc. 4. If granted, will the variance impose such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? The proposed swap would remove a unique case in the airpark No limitations on nearby properties, and all of the Airpark would benefit by the full ownership of the Emergency Runway. No changes in the building area of the lot would be created. No extra homesites would be created, and no special privileges would be created 5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect the health, safety, and welfare of the neighborhood or surrounding properties. Yes. The proposed land swap is only of the area that is the present Emergency Runway. By transferring this portion to the common area, the welfare of the neighborhood will actually be improved by guaranteeing the future use of Beech Way as an Emergency Runway. 2 12/U5/2UU7 11 AU FAX 18UU75975 Lazy right Ranch LgiUU1 File No. 06151331 EXHIBIT "A" All that part of Section 27, Township 11 South, Range 13 East, of the Gila and Salt River Base and Meridian, Pima County, Arizona, more particularly described as follows: COMMENCING at the Southeast corner of said Section 27; THENCE North 00 degrees 01 minutes 00 seconds West along the East line of Section 27, a distance of 2080.31 feet to the TRUE POINT OF BEGINNING. No conditions were placed on your request. Prior to recording the lot division a review by our Planning department is required for a minor land division. This review is separate from the Board of Adjustment and could not take place until the variance was approved. I have included the application and submittal requirements for the minor land division. LA CANADA DRIVE CALL TO ORDER - at 3:00 pm ROLL CALL PRESENT: Andy Martin, Chair Bart Schannep, Vice Chair John Hickey, Member Colleen Kessler, Member EXCUSED: Paul Parisi, Member 1. CASE NO: OV10-08-01, Mary Glenn Winscott, requests a variance to reduce the required 6.88 acres of the R1-300 zoning to 6.34 acres. Subject property (parcel #219-23-0670) located at 1601 W. Beech Way, Oro Valley, AZ, 85737. Chair Martin swore in Vice President and Secretary of La Cholla Airpark Gil Alexander and Oro Valley property owner Mary Winscott. Mr. Alexander stated that when the airpark was laid out, it included a narrow strip that branches off to the east. He stated that the strip is currently used as an emergency runway. He noted that the lot was currently for sale and that the owner felt the airpark should own the strip. He stated that on behalf of the airpark he would accept the land transfer at the closing of the sale. Mrs. Winscott stated that the party interested in purchasing her property found that the runway was an obstacle to obtaining insurance. Mrs. Winscott noted that it was important to the airpark to have the runway when pilots are unable to land at the main runway. Mr. Alexander noted that all of the other roads in the airpark were easements and were not owned by the airpark; only the runway and the common area were owned by the airpark. Discussion clarified that: • The strip to the west of this lot on Beech Way was privately owned. o The zoning for that lot would not change as there was enough acreage to maintain the required 6.88 acres. • This was the only emergency runway. Zoning Inspector Patty Hayes presented the Staff report: • Subject property is an 8.4 acre parcel in La Cholla Airpark • Zoned R1-300 which required a minimum of 6.88 acres per parcel • Mrs. Winscott proposed to transfer a 2.08 acre portion of the lot to the La Cholla Airpark Association. o The transfer would make the property .53 acres short of the required 6.88 acres. • All property owners within 300 feet of the property were notified by mail. • The hearing was posted online and in the Daily Territorial Newspaper. • Staff received one email in support of the proposal and no opposition. • La Cholla Airpark has agreed to accept the shared driveway and emergency airstrip as common area for the airpark. • Removing the 2.08 acres would not create another buildable lot. It was clarified that: • Selling the property was not an issue, but rather that the proposed lot size would not conform to the code. • Re -zoning the parcel to a lesser density would not allow for an airstrip. • The proposal would make the parcel insurable and buildable. Chair Martin opened the public hearing at 3:09 p.m. There being no speakers, he closed the public hearing. Mr. Alexander noted that the transfer would benefit all airpark members. MOTION: A motion was made by Vice Chair Schannep and seconded by Member Hickey to approve OV10-08-01, a variance to reduce the required 6.88 acres of the R1-300 zoning to 6.34 acres. Subject property (parcel #219-23- 0670) located at 1601 W. Beech Way, Oro Valley, AZ, 85737. Vice Chair Schannep stated that all five findings were evident. He noted that the variance was in the best interest of the neighborhood and would be required in order to preserve the full property rights due to the potential liability. Member Hickey agreed and noted that it was an issue of increasing safety. He stated his full support. Member Kessler and Chair Martin concurred that all five findings had been met. MOTION carried, 4-0. ADJOURNMENT MOTION: A motion was made by Member Hickey and seconded by Member Kessler to adjourn at 3:13 p.m. Prepared by: Christina Pickering Office Specialist ORO VALLEY PLANNING AND ZONING DIVISION BOARD OF ADJUSTMENT REPORT CASE NO: OV 10-08-01 Hearing Date: Agenda Item No.: Prepared By: February 26, 2008 1 Patty Hayes, Zoning Inspector REQUEST: Mary Glenn Winscott requests a variance to reduce the required 6.88 acres of the R1-300 zoning to 6.34 acres. Subject: (parcel #219-23-0670) located at 1601 W. Beech Way, Oro Valley, AZ, 85737. REQUEST SPECIFICS: The subject property is an 8.4 acre parcel in the La Cholla Airpark zoned R1-300. The R1-300 zone requires minimum of 6.88 acres for each parcel. Mary Glenn Winscott proposes to transfer a 2.08 acre portion of the subject lot to the airpark association. The 2.08 acre portion of the lot is currently being used as a common driveway and as an emergency airstrip for the airpark. Eliminating the common driveway and emergency airstrip from the subject parcel will reduce the size of the subject property to 6.34 acres, .53 acres short of the required minimum 6.88 acres. SITE LOCATION: This property is located in the La Cholla Airpark. The property can be accessed from Kingair Drive and Moore Road. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing, posted on line at www.orovalleyaz.gov and was advertised in the Daily Territorial. At the time of this report preparation, staff had received one email in support and no comment in opposition to this case. A letter from the home owner's association in support of the case was included with the application. EXISTING LAND USE AND ZONING: Site: Existing property — Vacant land zoned R1-300 North — Existing home zoned R1-300 West- Existing airplane hanger zoned R1-300 East- Existing home zoned R1-300 South - Existing home zoned R1-300 SITE INFORMATION: This lot is located in the La Cholla Airpark. The La Cholla Airpark was established in the 1970's and annexed into the Town of Oro Valley in 2005. Subject property is an undeveloped flag lot shaped parcel. The entire lot as it is shown today is the original configuration. The pole portion of the flag lot was developed as an emergency runway over time; however, the owner cannot assume liability of the runway and would like to donate that portion as common area to the air park. SUMMARY: Finding of Facts: • The La Cholla Airpark has agreed to accept the shared driveway and emergency airstrip as common area for the airpark. • Removing the 2.08 acres from the 8.4 acre parcel would not create another buildable lot. • The La Cholla Airpark is the only R1-300 zoned area within the Town limits that allows an aviation airstrip. • Rezoning this parcel to a lesser density would not allow an airstrip The Board of Adjustment should consider the following findings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. SUGGESTED MOTION: The Board may wish to consider the following motions: I move to [approve, approve with conditions, or deny] OV 10-08-01, a variance to reduce the required 6.88 acres of the R1-300 zoning to 6.34 acres.
