BOARD OF ADJUSTMENT APPLICATION
FOR: X Zoning Variance Note: Submittals are due by noon
Zoning Interpretation
Appeal of Administrative Decision CASE NO.: V C ` C - 0 f
NATURE OF REQUEST: This request is for a side set back variance of 10' for the residence at 10764 N
Poinsettia Drive in Oro Valley, AZ 85737. Robert Dobbin, the homeowner since 1989, has been diagnosed
with a degenerative nerve disorder that has rendered him disabled. His fianc6e, Liz Hamilton also is disabled,
suffering from the effects of encephalitis. They both reside at the residence, and require immediate
improvements to the home to continue being able to have access to all areas of their home. The plans
contained in this packet show the design for a ADA accessible garage for the two and Robert's son, Joel, who
is their primary helper/caregiver. The existing garage is to be closed in and be made into a accessible
living/workout area for the two. You will find that the existing topography and site layout lends no other
reasonable solution than the one proposed here. The owner urges the board to approve the variance and fast
track this process as soon as possible. ADA guidelines compel the board to approve this variance The Fair
Housing Amendments Act (FHAA) defines discrimination as including "a refusal to make reasonable
accommodations in rules, policies, practices, or services, when such accommodations may be necessary
to afford [a disabled] person equal opportunity to use and enjoy a dwelling" (42 U.S.C. §3604(f)(3) (13)).

SUPPLEMENTAL QUESTIONS FOR APPLICATION FOR A VARIANCE
Please provide the following information addressing 1— 5 in the Findings from Section 21.6 I of the Oro
Valley Zoning Code Revised (OVZCR). In order to authorize a variance request, the Board will be
searching for sufficient evidence in accordance with the findings.
1. Are there special circumstances or conditions applying to the property referred to in the application
including its size, shape, topography, location or surroundings which do not apply to other
properties in the district?
Yes. The property sits on top of a hill, one of the highest in the district. The rectilinear layout of the
property lines limits any expansion of the home toward the north and south of the parcel. The topography
of the site compounds the problem with the shape because of the steep drop to both the east and west
boundaries. Also to the east is a Flood Prone Area at the rear of the property, limiting any construction
there.
2. Are there special circumstances that exist that are not self imposed or created by the
owner/applicant?
Yes. As discussed earlier, the owner of the house and his fiancee are disabled. These renovations are
designed to improve their quality of life and the continued enjoyment of their property.
3. Is the authorizing of the variance necessary for the preservation and enjoyment of substantial
property rights?
Yes. The home in its current condition is unmanageable for persons with the handicaps the two face. We
compel the board to consider this when making their decision.
4. If granted, will the variance impose such conditions as will assure that the authorizing of the
adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon
other properties in the vicinity and zone in which such property is located?
The Fair Housing Act (FHA) requires housing_ providers, local zoning authorities and others to make
reasonable changes or "accommodations" in rules, policies, practices or services (42 U.S.C. §
3604(f)(3)(B): 24 C.F.R. § 100.204.). This variance does not constitute special privileges, but the
aforementioned "accommodations" required be made by law.
5. If granted, will the variance be the minimum necessary to afford relief and will not materially affect
the health, safety, and welfare of the neighborhood or surrounding properties.
Yes. The design is the minimum necessary, and will not impose on adjoining property of community.

Narrative to Accompany Board of Adjustment Application:
Monte Del Oro #62
Date: 02-12-08
The following is intended to expand upon answers to the five questions on the Board of
Adjustments application, and to support the argument for a side set back variance of 10'
for the residence at 10764 N Poinsettia Drive in Oro Valley, AZ 86737. The primary
reasons for requesting a variance in this particular case stem from the owners need to
remodel, as well as the physical nature/requirements of the site itself. While much must
be done to the interior of the existing house it is important to understand that the purpose
of this request is to allow the construction of a new garage. All future improvements
planned for the residence rely on the placement of this addition within the current 20'
building setback.
In order to improve quality of life, the owners must make changes to the home. Robert
Dobbin and his fiancee are both disabled. Their conditions limit mobility and cause a
great deal of pain. In the house, the two use walkers and canes for mobility, and out of
the house they are use wheelchairs. There have been improvements to the exterior of the
house such as an ADA compliant ramp built to the front door of the residence; however,
not much has been done to improve the interior condition. Long distances between
rooms and difficult floor level changes within the home must be addressed. One in
particular is the entrance to the house from the existing garage. As shown in figure 1, a
handrail has been added to assist the owners with the difficult steps at the door to the
home. In this situation a ramp would be the appropriate response, but would make
parking more than one vehicle impossible. The newly proposed garage would enter the
home at the same finished floor level through the remodeled existing garage. It would
also provide adequate parking for three vehicles with the addition of a 5' wide access isle
that serves two parking spaces and provides a path to both doors serving the garage
space.
Beyond the implications for remodeling the home, the site itself has many factors that
would justify a 10' side yard setback variance. The shape, topography, and layout of the
home on the site create a difficult set of design boundaries. It is immediately apparent
that the rectilinear layout of the property lines limits any expansion of the home toward
the north and south of the parcel. The topography of the site compounds the problem
with the shape because of the steep drop to both the east and west boundaries. Also
shown is the Flood Prone Area to the rear of the property, which suggests no further
construction be planned for that area. Therefore, the best available location for the new
garage addition is the space already within the walled yard to the north of the existing
garage. Figures 2 and 3 show that the area is large enough, it works with the current
layout of the home and the driveway, and there are no grading or topography issues.
The Fair Housing Act (FHA) requires local zoning authorities and others to make
reasonable changes or "accommodations" in rules, policies, practices or services with
regards to persons with disabilities. Accordingly, a person with a disability should have
Robert Dobbin Page 1 of 3

Oro Valley, AZ 85737
an equal opportunity to use and enjoy his/her dwelling. We hope the board sees the
nexus between the proposed variance and the disabilities suffered by the owners. We
have made great effort to propose a plan that is the minimum necessary improvements to
the property, and the most beneficial for the owners.
We ask that the board consider that rejection or further delay of construction is time that
the owners will be spending without reasonable enjoyment of their home. A fast -tracked
process is needed to aid in quality of life and prevent possible injury. Thank you for
compassion and consideration. We look forward to your response.

1601 W. Beech Way, Oro Valley, AZ, 85737.
Chair Schannep swore in the applicant, Mary Glenn Winscott.
It was clarified that this item was continued from the last meeting in order to
correct the size reduction of the lot.
Planning and Zoning Inspector Patty Hayes presented the Staff report. She
stated that neither opposition nor support had come forward since the last
meeting.
03/25/2008 MINUTES, BOARD OF ADJUSTMENT 2
Chair Schannep opened the public hearing at 3:00 p.m. There being no
speakers, he closed the public hearing.
MOTION: A motion was made by Member Hickey and seconded by Member
Kessler to approve OV10-08-01 A a variance to revise the previously approved
6.34 acre lot size reduction to 6.27 acres, a change of .07 acres.
MOTION carried, 5-0.
CASE NO: OV10-08-02, Robert Dobbin requests a variance from the
required 20' side yard setback to 10'. Subject: (parcel #224-27-1740)
located at 10764 N. Poinsettia Drive, Oro Valley, AZ, 85737.
Tucson resident Joel Alley stated that his father, Robert Dobbin was unable to
appear before the board due to illness. Mr. Alley stated that he would testify on
his behalf.
Chair Schannep swore in Mr. Alley.
Mr. Alley stated that his parents were both disabled and the remodel of the home
was to promote their quality of life. He noted that he would attest to the special
needs of his parents while design consultant, Scott Stouffer, would answer
design questions.
Chair Schannep swore in Scott Stouffer.
Discussion noted the following:
• The addition could not be made on the west side due to the positions of the
septic tank, leach lines and a tree.
• The existing garage would become part of the home.
• A three car garage would be added to the home along with wheelchair access
to the home.
Member Martin clarified that the septic tank was on the east side of the home.
Mr. Stouffer stated that the front yard was short and would place the addition too
close to the street. He stated that the homeowners needed a flat handicap
friendly area to erect the addition. He noted that the area within the fence of the
side yard was most conducive to this project.
Discussion clarified that:
• The existing garage had two bays.
• A three car garage was necessary for handicap access as both of the
homeowners were disabled and each of them owned a car.
• The side yard wall was 5-6 feet from the property line.
• The garage would extend almost to the side wall of the fence.
03/25/2008 MINUTES, BOARD OF ADJUSTMENT 3
• Measures would betaken to ensure that the garage wall would be 10 feet
from the property line.
• The existing garage had two steep steps to enter the house.
o The required space for a ramp would allow for only one car in the
garage.
Planning and Zoning Inspector Patty Hayes presented the Staff report:
• The house was zoned as R-143 and the required side yard setback was 20
feet.
• All property owners within 300 feet of the property were notified of this
hearing by mail.
• The property was noticed online, published in the Daily Territorial and the
property had a sign posted.
• Staff had received no comments in support or opposition of this case.
• Since preparation of the report, a neighbor to the east inquired about the
case; no opinion was given.
• Existing home was built in 1981 under Pima County's CR-1 zoning standards.
o Those standards had a 10 foot side yard setback.
o When the property was annexed to Oro Valley the setback changed to
20 feet.
• Existing house placement and topography limits the placement of the
addition.
• Neighboring house to the north was approximately 8 feet lower than the
subject house.
Chief Civil Deputy Attorney Joe Andrews stated that the Fair Housing
Amendment Act was applicable to this case; however this board was not
responsible for ensuring its enforcement. He noted that it would be an issue for
the Town Council. He clarified that the duty of the board would not change due to
the disabilities of the applicants. He noted that it could be a consideration;
however the main focus would be to meet the established criteria to qualify for a
variance.
Chair Schannep opened the public hearing at 3:17 p.m. There being no
speakers, he closed the public hearing.
MOTION: A motion was made by Member Martin and seconded by Member
Hickey to approve OV10-08-02, request to reduce the side yard setback from 20
feet to 10 feet.
Member Martin stated that the five findings had been met satisfactorily. He stated
that, from a topographical standpoint, there was not another viable area to place
the addition. He noted that the applicant had lived there prior to annexation.
Member Hickey stated that the findings had been met and that Mr. Andrews had
defined the perspective of the board very well. He noted that due to the
03/25/2008 MINUTES, BOARD OF ADJUSTMENT 4
topography, the disability of the applicant was not an issue.
Member Parisi concurred that the findings were met without allowing for a special
circumstance. He noted that a number of other homes in that area were built
prior to annexation and had 10 foot setbacks.
Member Kessler agreed stating that if the house had been built on a flat lot the
applicant would have more room to utilize. She noted that the positioning of the
septic tank was an additional obstacle.
MOTION carried, 5-0.
ADJOURNMENT
MOTION: A motion was made by Member Hickey and seconded by Member
Martin to adjourn at 3:24 p.m.

Patty Hayes, Zoning Inspector
REQUEST: Robert Dobbin requests a variance from the required 20' side yard setback to
10'. Subject: (parcel #224-27-1740) located at 10764 N. Poinsettia Drive, Oro
Valley, AZ, 85737.
REQUEST SPECIFICS:
Robert Dobbin requests approval to build a garage addition with a 10' encroachment into the side
yard setback. The required side yard setback in the R1-43 zone is 20'. Mr. Dobbin explains his
needs for the garage remodel and addition in the attached application.
SITE LOCATION:
This property is lot 62 of the Monte Del Oro subdivision located north of Pistachio Ave. and
Lambert Lane. Pistachio Ave. is located off of Lambert Lane '/2 mile east of La Canada Drive.
NOTIFICATION:
All property owners within 300 feet of this property were notified of this hearing by mail. The
property is posted with a notice of hearing, posted online at www.orovalleyaz.g_o_v and was
advertised in the Daily Territorial. At the time of this report preparation, staff had received no
comment in support or opposition to this case.
EXISTING LAND USE AND ZONING:
Site: Subject property — Existing house zoned R1-43
North — Existing house zoned R1-43
West - Existing house zoned R1-43
East - Existing house zoned R1-43
South - Existing house zoned R1-43
SITE INFORMATION:
Lot 62 is located in the Monte Del Oro subdivision. Monte Del Oro is a 187 lot subdivision
recorded in 1976 in Pima County. The subdivision was annexed into Oro Valley in 1987 and zoning
was translated from county's CR1 to Oro Valley's R1-43. Subject property is a 1.2 acre rectangular
lot. The lot slopes upward approximately 18' from the street to the house pad and then
approximately 40' from the house pad downward toward the rear property line. The eastern rear
portion of the property is a 100 year flood prone area.
SUMMARY:
Finding of Facts:
The existing house was built in 1981 under Pima County's CR1 zoning standards.
Existing house placement and topography limits the buildable area for the garage
addition.
• The neighboring house to the north is approximately 8' lower than the subject house.
The Board of Adjustment should consider the following findings in making its decision:
A. That there are special circumstances or conditions applying to the property referred to
in the application including its size, shape, topography, location or surroundings
which do not apply to other properties in the district; and
B. That special circumstances were not created by the owner or applicant; and
C. That the authorizing of the variance is necessary for the preservation and enjoyment
of substantial property rights; and
D. That any variance granted imposes such conditions as will assure that the authorizing
of the adjustment shall not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zone in which such property
is located; and
E. That the authorizing of the variance will not be materially detrimental to persons
residing in the vicinity, to adjacent property, to the neighborhood or the public
welfare in general.
SUGGESTED MOTION:
The Board may wish to consider the following motions:
I move to [approve, approve with conditions, or deny] OV 10-08-02, a request to reduce the side yard
setback from 20' to 10' .
