ORO VALLEY PLANNING AND ZONING DIVISION r BOARD OF ADJUSTMENT REPORT CASE NO: OV 10-08-05 Hearing Date: June 13, 2008 Agenda Item No.: 2 Prepared By: Patty Hayes, Zoning Inspector REQUEST: Paul Hofmann, represented by 31) Architectural Designs, requests a variance from the required 15' side yard setback to 10'. Subject parcel #224-34-1370, located at 935 W. Landoran Lane, Oro Valley, AZ, 85737. REQUEST SPECIFICS: Paul Hofinann requests approval to build a detached garage with a 5' encroachment into the side yard setback. The required side yard setback in an R1-36 zone is 15'. The proposed detached garage would reduce the setback to 10'. SITE LOCATION: This property is lot 136 of the Oro Valley Estates subdivision located at Greenock Drive and Oracle Road. NOTIFICATION: All property owners within 300 feet of this property were notified of this hearing by mail. The property is posted with a notice of hearing, posted online at www.orovalleyaz.gov and was advertised in the Daily Territorial. At the time of this report preparation, staff had received no comment in support or opposition to this case. One neighbor to the north across the street called to inquire but had no opinion. EXISTING LAND USE AND ZONING: Site: Subject property — Existing house zoned R1-36 North — Existing house zoned R1-36 West - Existing townhouses across golf course zoned R4 East- Existing house zoned R1-36 South - Existing house zoned R1-36 SITE INFORMATION: Oro Valley Estates is a 234 lot subdivision recorded in Pima County in 1958. Oro Valley Estates was incorporated as part of the original Town in 1974. Subject property is a flat, .8 acre, rectangular lot. SUMMARY: Finding of Facts: • The house was built in 1963 in Pima County's CR1 zoning district. Records are unclear for the date the existing detached garage was built. • Pima County's CR1 zoning requires a 10' side yard setback. • Oro Valley's Zoning code was adopted in 1981 with a 15' side yard setback required for R1-36 zoning. • The homeowner plans to demolish the existing detached garage and build a new detached garage. • The existing garage is approximately 16' from the side property line. • If the variance is approved the garage will require architectural review by the Development Review Board. The Board of Adjustment should consider the following findings in making its decision: A. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings which do not apply to other properties in the district; and B. That special circumstances were not created by the owner or applicant; and C. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights; and D. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located; and E. That the authorizing of the variance will not be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. SUGGESTED MOTION: The Board may wish to consider the following motions: I move to [approve, approve with conditions, or deny] OV 10-08-05, a request to reduce the side yard setback from 15' to 10'. La Canada Drive Oro Valley, AZ 85737 Re: Garage Plans for 935 W. Landoran Lane Dear Sir/Madam: I am the homeowner who, through my architect, Frank Rendon, recently submitted plans for a new garage on my property. 1 was informed that the Development Review Board mostly approved the plans, but rejected the request for a variance of 15' to 10' from the setback requirement. With your indulgence, t would like to explain why this project is so important as submitted, as well as to why it will be impossible to complete unless the variance is granted. Since we moved to my neighborhood in 2000, one of my goals was to replace the current garage structure — a dilapidated and converted flat -top carport — with a functional and beautiful garage. One of our overriding concerns was to make the new garage consistent and compatible with the house, both of which are apparent in the new design. Moreover, my wife and I have four children with a grave need for space and storage. Our storage space is so limited now that we can't fit our vehicles into the existing small structure. Until fairly recently, I understand that the set back requirement for structures in Oro Valley was 10'. In fact, our neighborhood has many garages 10', or less, away from the property lines, including my neighbor's on the side I wish to build. My plans for building our garage had always assumed this. In fact, three years ago we completed an addition to the back of the house with the idea that we would be re -building the garage. For example, the back of our home has large glass french doors that look into the back yard. Because our existing garage protrudes into the yard at an angle, it obscures our line of sight when looking out the back. (Please see attached picture.) The new garage will not be at an angle, but will face forward toward the driveway in the same direction as the front of the house. It will be a much better use of the available space, but because of it's increased size, the structure's planned location is the only one which will work. It is set between the house, on one side and a large, 45 year old eucalyptus tree on the other, neither of which can be moved. Attempting to relocate the Community Development Department April 28, 2008 Page 2 new structure another 5' into the back yard would only make it impossible to build. And, although not a brick has been laid, my wife and I have already spent over $10,000.00 in architectural fees, plans, and miscellaneous costs associated with this project. If the project were to be cancelled now, all of that will have been wasted. My goal, as with all of the improvements I've made since moving here, is simply to enhance the property by improving its function and adding to its overall beauty. The new garage will do both, as well as to enhance the beauty and character of the neighborhood. It will be virtually identical to the style of the existing house, and, as I mentioned earlier, will. be the same distance from the border of my property as is my neighbor's garage on that side. (Moreover, both of my neighbors on either side of the property have already agreed to the 10' set back for the new structure.) I am simply asking that you please reconsider your decision. In the meantime, please don't hesitate to contact me at 797-1041 or 544-7993 if you have any questions or require further information. Thank you for your consideration. Sincerely, Paul G.
