(R)03- 50 RUG 11'83PM 1:13 TOV RESOLUTION OF THE TOWN OF ORO VALLEY, ARIZONA, AUTHORIZING THE EXECUtION OF DRAINAGE AND MAINTENANCE EASEMENT FOR EL CONQUISTADOR EXECUTIVE PLAZA. WHEREAS, the Town of Oro Valley, through the Department of Public Works, is responsible for the maintenance of public drainage ways; and WHEREAS, the Town of Oro Valley is constructing flood and erosion along protection along Mutterer Wash for the purposes of controlling flooding and erosion to private and public property;and WHEREAS, there is a need for the Town of Oro Valley to place a portion of the flood and erosion protection across private property outside the public drainage way; and WHEREAS, there is a need for the Town of Oro Valley to access this flood and erosion protection to be placed across private property for maintenance purposes; and WHEREAS, Manuel Gadea, President/Managing Owner of El Conquistador Executive Plaza,is willing to grant the necessary easement to the Town of Oro Valley, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY,ARIZONA: 1. That the drainage and maintenance easement granted in the attached document is accepted. 2. That the Mayor is authorized to execute the easement on behalf of the Town of Oro Valley.
