PUBLIC EQUESTRIAN TRAIL EASEMENT
THIS EASEMENT,made thi day of ,2002,by and between
University of Arizona Foundation,an Arizona non-profit corporation,h er known as the Grantor and
the Town of Oro Valley Municipal Property Corporation,a non-profit corporation,and hereinafter known
as GRANTEE.
Grantor,for valuable consideration,hereby grants unto GRANTEE,its successors and assigns,an
undefined blanket easement for equestrian trail purposes over the property described in the attached Exhibit
A(the"Property").
1. GRANTEE shall have the right to construct and maintain a recreational trail for equestrian
purposes.
2. GRANTOR agrees for itself,its successors and assigns not to erect,place or maintain,nor to
permit the erection,placement of any improvements upon the above herein described easement,
which would impair the usage of said easement.
3. GRANTEE shall have the right to make such topographical changes as are consistent with and
reasonably necessary to promote the trail purposes of this easement.
4. Motorized vehicles shall not be permitted on the Property,except to construct and maintain trail
and Flood Control Improvements.
5. GRANTEE may erect such signs as are compatible with the conservation and trail purposes of this
easement.
6. GRANTEE may remove alter or vegetation. All new vegetation shall be harmonious with the ..

general surrounding vegetation. Grantee and its contractors,agents and employees,shall have the Ti
right to cut such roots and remove such obstacles that could endanger or interfere with said

easement and shall have free access to said easement and every part thereof,at all times,for the
purpose of exercising the rights herein granted.
7. GRANTEE has the right to enforce its regulations within the Property. -:
8. GRANTEE shall not be obligated to perform any act or take any affirmative action to accomplish
the purposes stated herein.

9. GRANTEE acknowledges that the Pima County Flood Control District has primary responsibility
for Flood Control in the Canada Del Oro Wash,which may periodically affect trail access.
10. In consideration of the mutual terms,covenants and conditions herein contained shall be binding
upon and inure to benefit of an heirs,executors,administrators,permittees,licensees,agents,or
assigns of Grantor and the successors and assigns of the Grantee.
