RESOLUTION OF THE TOWN OF ORO VALLEY, ARIZONA,
AUTHORIZING THE EXECUTION OF DRAINAGE AND
MAINTENANCE EASEMENT WITHIN LOT 177 IN THE MONTE DEL
ORO SUBDIVISION.
WHEREAS, the Town of Oro Valley, through the Department of Public Works, is
responsible for the maintenance of public drainageways and public road Right-of-Ways;and
WHEREAS, a drainage channel was constructed over private property for the purposes of
controlling drainage and sedimentation over a public road;and
WHEREAS, there is a need for the Town of Oro Valley to have access to private property
outside the public road Right-of-Way for maintenance purposes;and
WHEREAS, Barbara M. Park is willing to grant the necessary easement to the Town of
Oro Valley,
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF ORO VALLEY,ARIZONA:
1. That the drainage and maintenance easement granted in the attached document are
accepted.
2. That the Mayor is authorized to execute the easement on behalf of the Town of Oro
Valley.

EASEMENT
THIS EASEMENT made between Barbara Park, Grantor(s), and the Town of Oro Valley,
a municipal corporation, Grantee, hereinafter called the Town.
WITNESSETH:
THAT the undersigned, for and in consideration of One ($1.00) Dollar, and other
valuable consideration to the undersigned in hand paid by the Town, the receipt whereof
is hereby acknowledged, do(es) hereby convey unto the Town of Oro Valley, a municipal
corporation, its successors and assigns, a perpetual right-of-way, privilege and
easement for the following purpose(s): drainage and maintenance services; said
easement being in, on, through, over, across and under the following described parcel of
land, situate in the County of Pima, State of Arizona, to-wit:
See EXHIBIT "A" attached and made a part hereof.
TO HAVE AND TO HOLD the same unto the Town, and to its successors and assigns
forever

Drainage & Maintenance Easement
Lot 177
A 60 foot wide strip of land within lot 177 of Monte del Oro, recorded in Book 27, Maps
and Plats at Page 99, Pima County Recorder's Office, Pima County, Arizona. Said plat
of Monte del Oro being within the East V2 of Section 11, Township 12 south, Range 13
East, Gila and Salt River Meridian, Pima County, Arizona. Said strip of land described as
follows:
The Easterly 60 feet of said lot 177, as measured parallel to the Easterly property line of
said lot 177 common with lot 178 of said plat of Monte del Oro.
The sidelines of said strip to be lengthened or shortened to intersect the right-of-way line
of Lambert Lane and the North property line of said lot 177.
