WATER UTILITY EASEMENT
VISTOSO PARTNERS, LLC , ("Grantor"),
does hereby grant to THE TOWN OF ORO VALLEY ("Grantee"), a perpetual right-
of-way for ingress,egress and a perpetual water utility easement and right-of-way for the
construction, maintenance and operation of a water pipeline and appurtenances in, over,
under, and across the following described premises, situated in Pima County, Arizona,
shown on the attached Exhibit"A"and made a part hereof by reference.
Grantee may enter upon the Property and may dig ditches and install water utility
lines and may enter the Property at all reasonable times for the purpose of construction,
maintenance, repair, service, replacement and removing any water utility lines and
appurtenances. Following any use of the Property for the above purposes, Grantee will
restore the Property to a good and clean condition,and if the property is paved,to restore
the pavement to a similar condition as found before the pavement is cut.
This easement is subject to the following conditions:
(1) It is understood and agreed that the Grantor may use the said right-of-way and
easement for any purposes not inconsistent with actual use of said right-of-
way and easement for the purposes herein granted, so long as Grantee's use
and access to this right-of-way and easement is not obstructed;
(2) That all grants,covenants and provisions herein shall be binding on and inure
to the benefits of the heirs,successors,and assigns of the parties hereto;
(3) That Grantee shall hold Grantor free and harmless of any and all claims,
liabilities or damages associated with Grantors' use and enjoyment of the
easement and right-of-way, including but not limited to the costs of repairing
or maintaining any water main located within said easement and right-of-way;

Legal Description
A 10.00 foot wide strip of land over that portion of The Estates at High Mesa Rancho Vistoso
Neighborhood 5 Parcel E, Lots 1 thru 80 and Common Areas A, B, and C, according to the plat
recorded in Book 49 Maps and Plats, at Page 91, records of Pima County, Arizona, lying 5.00
feet on each side of the following described centerline:
COMMENCING at the northeasterly corner of Section 30, Township 11 South, Range 14 East,
Gila and Salt River Meridian, Pima County, Arizona;
THENCE N 89°16'32" W along the northerly line of said Section 30 (according to said plat of
The Estates at High Mesa Rancho Vistoso Neighborhood 5), a distance of 746.35 feet to a point
on the easterly line of said The Estates at High Mesa Rancho Vistoso Neighborhood 5 Parcel E,
Lots 1 thru 80 and Common Areas A, B, and C;
THENCE S 35°00'33" E along said easterly line, a distance of 45.42 feet to a point on a line lying
5.00 feet southerly of and parallel with the southerly line of a 20.00 foot wide easement described
in Dkt. 8011 at Page 1198, records of Pima County, Arizona, the POINT OF BEGINNING.
THENCE along said parallel line the following courses and distances:
S 63°16'38" W a distance of 46.12 feet;
S 67°04'42" W a distance of 100.97 feet;
N 68°29'00" W a distance of 162.11 feet;
N 65°57'16" W a distance of 274.65 feet;
N 69°27'42" W a distance of 70.63 feet to a point on the easterly line of a parcel of land
described in Dkt. 8351 at Page 1999, records of Pima County, Arizona, and the POINT OF
TERMINATION.
The sidelines of herein described easement are to be lengthened or shortened so as to meet at the
angle points formed.
