WATER UTILITY EASEMENT
Bank of America NT & SA , ("Grantor"),
does hereby grant to THE TOWN OF ORO VALLEY ("Grantee"), a perpetual right-
of-way for ingress,egress and a perpetual water utility easement and right-of-way for the
construction,maintenance and operation of a water pipeline and appurtenances in, over,
under, and across the following described premises, situated in Pima County, Arizona,
shown on the attached Exhibit"A"and made a part hereof by reference.
Grantee may enter upon the Property and may dig ditches and install water utility
lines and may enter the Property at all reasonable times for the purpose of construction,
maintenance, repair, service, replacement and removing any water utility lines and
appurtenances. Following any use of the Property for the above purposes, Grantee will
restore the Property to a good and clean condition,and if the property is paved,to restore
the pavement to a similar condition as found before the pavement is cut.
This easement is subject to the following conditions:
(1) It is understood and agreed that the Grantor may use the said right-of-way and
easement for any purposes not inconsistent with actual use of said right-of-
way and easement for the purposes herein granted, so long as Grantee's use
and access to this right-of-way and easement is not obstructed;
(2) That all grants,covenants and provisions herein shall be binding on and inure
to the benefits of the heirs,successors,and assigns of the parties hereto;
(3) That Grantee shall hold Grantor free and harmless of any and all claims,
liabilities or damages associated with Grantors' use and enjoyment of the
easement and right-of-way,including but not limited to the costs of repairing
or maintaining any water main located within said easement and right-of-way;

BANK OF AMERICA
That portion of Section 7, Township 12 South, Range 14 East, Gila and Salt River Meridian, Pima
County, Arizona, being a strip of land 15.00 feet wide lying 7.50 feet on each side of the folowing
described centerline:
COMMENCING at the North One-Quarter(N 1/4) corner of said Section 7;
THENCE S 00°20'38" E, along the North-South mid-section line of said Section 7, a distance
of 2,123.77 feet to a point on the arc of a non-tangent curve concave to the South, a radial line of
said curve through said point having a bearing of N 10°40'48" E;
THENCE Westerly along the arc of said curve, to the left, having a radius of 1,203.24 feet
and a central angle of 48°38'49" for an arc distance,of 1,021.61 feet to a point of tangency;
THENCE S 52°01'58" W, 442.05 feet to the Northeasterly right-of-way line of FIRST
AVENUE; •
THENCE S 37°58'02" E, along said right-of-way line, a distance of 727.49 feet to a point of
curvature of a tangent curve concave to the North;
THENCE Easterly, along the Northerly right-of-way line of said FIRST AVENUE, along the
arc of said curve, to the left, having a radius of 50.00 feet and a central angle of 70°44'04" for an arc
distance of 61.73 feet to a non-tangent line, said point being the POINT OF BEGINNING;
