Liberty Bank as beneficiary under that certain Deed of Trust recorded in Book 10523, Page 2243 on April
14, 1997 in the office of the County Recorder of the County of Pima, State of Arizona does hereby acknowledge
and consent to that certain waterl ine easement granted to The Town of Oro Valley Water Utility Co. recorded
concurrently herewith for the right of way described in Exhibit "A" attached hereto.
WHEREAS, Liberty Bank, Beneficiary of said Deed of Trust agrees to subordinate its interest in the premises
described therein to the above grant of easement.

LEGAL DESCRIPTION OF WATER LINE EASEMENT
1 An easement for Water line purposes over a portion of the Northeast Quarter of Section
10, Township 12 South, Range 13 East, Gila and Salt River Base and Meridian, described
as follows:
Commencing at the Northeast Corner of said Section 10, said point being the intersection
of the centerlines of Naranja Drive and La Canada Drive;
Thence South 89 degrees 57 minutes 20 seconds West, along the North line of said
Section 10, 75.00 feet to a point on the Westerly line of the Right-of Way of said La
Canada Drive;

Thence South 00 degrees 01 minutes 41 seconds East along said Westerly line, 647.10
feet to the Point of Beginning of the centerline of an Easement, 10 feet in width; •
Thence South 89 degrees 58 minutes 19 seconds West, 10.00
feet to the Westerly terminus of said centerline.
