TEMPORARY CONSTRUCTION EASEMENT
Carmel Pointe Homeowner's Association, the Grantor, for the consideration of ONE DOLLAR AND OTHER VALUABLE
CONSIDERATION, grants unto the TOWN OF ORO VALLEY, an Arizona Municipal Corporation, the Grantee, over and upon
the real property described on the attached Exhibit "A" (the "Property") an exclusive temporary easement for use by the Grantee,
its agents and contractors under the Town's direction, to enter in and upon the property of the Grantor for the purpose of
reconstruction and widening of La Canada Drive from a point south of Lambert Lane to Naranja Drive(Project No. STP-ORV-0(4)P).
This temporary easement is subject to the following terms and conditions:
1. Nothing herein contained shall be construed as granting title to the land belonging to the Grantor or as vesting in the Grantee
any right of entry to the property after termination of this Easement.
2. Upon the Grantee's termination of this easement, the Grantee will restore the land of the Grantor to its existing condition
to the extent reasonable and practical.
3. This easement shall commence at the start of construction of La Canada Drive (Project No. STP-ORV-0(4)P). It is further
understood and agreed that this easement is to expire and terminate thirty(30)days after completion of the above mentioned
Project.

DESCRIPTION OF TEMPORARY CONSTRUCTION EASEMENT
SOUTH OF CATHEDRAL WAY
That portion of COMMON AREA B according to CARMEL POINTE as recorded in Book 45 of
Maps and Plats at Page 90, Pima County Recorder's Office, Pima County, Arizona, described as
follows:
COMMENCING at the Northeast corner of Lot 58 of said CARMEL POINTE;
THENCE on a plat bearing of N 89°58'19" E, along the South CATHEDRALright-of-wayline of
WAY according to said CARMEL POINTE, a distance of 5.00 feet to the POINT OF
BEGINNING;
THENCE continue N 89°58'19" E, along said South right-of-way line, a distance of 15.00
feet to a point of curvature of a tangent curve concave to the Southwest;
THENCE Easterly and Southeasterly along the Southeast right-of-way line of said
CATHEDRAL WAY, along the arc of said curve, to the right, having a radius of 25.00 feet and a
central angle of 66°25'19" for an arc distance of 28.98 feet to a non-tangent line;
THENCE S 89°58'19" W, 37.91 feet;
THENCE N 00°01'41" W, 15.00 feet to the POINT OF BEGINNING.
Containing 473 square feet, more or less.
