E CE`ACE N 1951 ROOA 97053432 4 SOROV ' elliIzo�� 04/09/97 TOWN OF ORO VALLEY EASMNT 16:07:00 11000 N LA CANADA MAIL_ ORO VALLEY AZ 85737 AMOUNT PAID $ 8.00 TOWN OF ORO VALLEY TEMPORARY CONSTRUCTION EASEMENT Canada Hills Community Association, the Grantor, for the consideration of ONE DOLLAR AND OTHER VALUABLE CONSIDERATION, grants unto the TOWN OF ORO VALLEY, an Arizona Municipal Corporation, the Grantee, over and upon the real property described on the attached Exhibit "A" (the "Property") an exclusive temporary easement for use by the Grantee, its agents and contractors under the Town's direction, to enter in and upon the property of the Grantor for the purpose of reconstruction and widening of La Canada Drive from a point south of Lambert Lane to Naranja Drive(Project No.STP-ORV-0(4)P). This temporary easement is subject to the following terms and conditions: 1. Nothing herein contained shall be construed as granting title to the land belonging to the Grantor or as vesting in the Grantee any right of entry to the property after termination of this Easement. 2. Upon the Grantee's termination of this easement, the Grantee will restore the land of the Grantor to its existing condition to the extent reasonable and practical. 3. This easement shall commence at the start of construction of La Canada Drive (Project No. STP-ORV-0(4)P). It is further understood and agreed that this easement is to expire and terminate thirty(30)days after completion of the above mentioned Project.
