Tangelo Drive, Oro Valley, AZ 85737 April 3, 2017 Narrative for Variance Request PR 4 2017 t ttrrrrrrNi►'rrrrrrr Variance request for Chapter 23; Section 23.5.B.l.b (Building Height [Sloped Area]) Of This letter is a formal request for variance to allow the finished building height to be measured from the proposed finished pad height at the property located at 461 E. Tangelo Dr., Oro Valley 85737. This property is a 3.31-acre lot composed of unmodified, natural terrain within Tangerine Meadows. The impact of measuring the building height from natural grade would leave a roof area of 1582 square feet, of a total 5701 square feet under roof, above the 18-foot building height limit. If the variance were granted then none of the square footage under roof would be in violation of the city ordinance. In order to construct a home that would incorporate adequate water drainage and prevent flooding while only balancing the site would require a building pad height of approximately 5.5 feet in height at the most extreme foundation footing. This pad height would allow for proper drainage, prevent flooding and would not require any fill dirt to be imported or exported from the site. Since the natural grade under the proposed home site is greater than 6% the current ordinance dictates that the height be measured from natural grade to the highest point of the structure, excluding chimneys. The spirit of the ordinance is for the preservation of views and therefore we performed a View Shade analysis, supported with pictures, to demonstrate that the views of our neighbors' to the West and Northwest would not be affected with the proposed house height. To date we have made modifications to our home plans in order to ensure preservation of neighbors' views and also to try and meet this city ordinance without having to submit for an official variance: 1. Early on we realized that placement of our home on the property could impinge on our neighbors views to the North. Therefore, we approached them, shared our concerns and all agreed on the placing of our home in order to maximize their views. 2. We modified our roof heights by adjusting slopes as a first attempt to meet the ordinance. If this variance were not to be granted it would create multiple hardships to the project. If we keep the proposed height we would have to lower the building pad height, therefore creating possible drainage and flooding issues in the future. Export of dirt would create a financial hardship on the project. Sincerely, Jose A. Barrera, Ph.D. Dv i7DD851 Variance Request for The Barrera's - 461 E. Tangelo Drive, Oro Valley, AZ 85737 Section 2.0 - Submittal Content of the Process Guide Question #3 with Answers Variance requests must provide information for the following 5 findings. That there are special circumstances or conditions applying to the property referred to in the application including its size, shape, topography, location or surroundings, which do not apply to other properties in the district. Answer: The topography of the land is natural, unimproved, uneven, and most of it already lies below the level of the street and below our neighbors to the north and west. ii. That special circumstances were not created by the owner or applicant. Answer: The topography is natural, raw and unimproved by us (the owners), so we did not create the circumstances in which we are applying for the variance. iii. That the authorizing of the variance is necessary for the preservation and enjoyment of substantial property rights. Answer: We are applying for the variance to: prevent flooding, avoid the added cost of dirt removal and to preserve our views. iv. That any variance granted imposes such conditions as will assure that the authorizing of the adjustment shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is located? Answer: If the variance is granted, it will not produce limitations to other properties. The only limitation that our variance could have produced would have been limiting the view of Mount Lemmon to the east. Therefore, a View Shade analysis was performed to demonstrate that the views of our neighbors to the West and Northwest would not be affected if the building height were measured from the proposed finished pad height. V. That the authorizing of the variance be materially detrimental to persons residing in the vicinity, to adjacent property, to the neighborhood or the public welfare in general. Answer: No, the authorization of the requested variance would not be materially detrimental to anyone. To date, we have made modifications to our home plans in order to ensure preservation of our neighbors' views and also to try and meet the City of Oro Valley zoning codes. Early on in our design process we realized that the placement of our home on the property could impinge on Jeff and Rachel's views (neighbors to the north). Therefore, we approached them, shared our concerns and all agreed that placing our home back another 25 feet from the road would preserve their views. We also, modified our tallest roof height by adjusting its slopes as an attempt meet our cities zoning code for building height. We put up the pole to signify the most extreme height on our lot/house that we discussed on Thursday. I'm looking at the recently emailed plans and began to wonder if a variance is really needed. The code measures building height as shown: Building Height (Sloped Area) The maximum vertical distance measured from natural grade to the highest point of the building directly above. excluding any chimney. This definition applies only to a building footprint where the natural cross -slope is six (6) percent or more. When looking at cross sections B and E it appears that the deepest amount of fill happens underneath a portion of the home that isn't too tall (a flat roof section). Maybe the only area is on cross section E, below the pitched roof. Changing that pitched roof to a lower or shorter roof might eliminate the variance need. Please take a closer look to ensure that there aren't other options in the house design or that there really are building portions that are higher than 18' when measuring the building and the fill dirt directly underneath the building. I want to make sure that the variance is really needed or that there aren't other options. I know that you don't want to lower the house pad, due to drainage, but lowering a section of the roof (if really needed) might be another option. Thank you both. Part of my review is to ensure you have a clear understandable application to move forward. I offer the following comments in order to provide more clarity for your project. 1. The narrative does not seem to clearly state the request. You basically should be asking for a building height variance and not an interpretation of how code section 23.5.B.1.b. reads. The topography of the lot and the amount of cut and fill required to build your house coupled with the 18' maximum building height of the zoning district is the limiting factor. Asking for a building height increase from 18' to XX should be the request. The 1582 and 5701 of roof area is a difficult section to understand. That may be better shown graphically. 2. Even though you'll be asking for a building height increase, the actually structure of the house should be no more than 18' tall. It appears that the house might be 19' tall or more for just the structure. Also, building height is measured from the building pad and not finished floor. Be sure to include the foundation in the overall height of the structure. 3. Also, you or your engineer will want to be sure that the V or terraced 8' cut and fill limits of the code are still met. 4. Someplace in the 5 questions, you might want to add why a stepped house isn't part of your plans. S. The site plan, page GP1 needs to have features labeled. There are crosshatched and dotted areas and possible ramadas and garages that are not identified on the plans. Ensure all features of the site plan are clear. However, there are some features that make the site plan too busy. For example the rounded area (if that's only a concreate feature), the slope percents and the wall openings callouts add unneeded information. 6. On the site plan you should also identify which part of the building doesn't meet the building height and is the area of concern. Include outbuildings if they also don't meet the height limit. 7. The cross sections are very nice but you should circle or highlight the areas of concern. Is it the whole building or only portions that don't meet the 18' building height? Those are a few comments that may make the application present better to the Board members. I'd be more than happy to review my comments with you at any time. Please call or email if you wish. My goal is to get your case on the May Board of Adjustment meeting. In order to keep that schedule I'll need your revised documents no later than Wednesday April 26. You may email revisions to me if you like. Tangelo Drive, Oro Valley, AZ 85737 Narrative for Variance Request Variance requested for: Total Height (Building & Pad) to he increased from 18' to 24' 6". (e _ 5 — Applicable Code: Chapter 23.5.B.1.b (Building Height [Sloped Area]) The house structure will not exceed the maximum building height of 18', however due to the fill needed for the building pad (6' 6" at maximum point) the total building height will increase to 24' 6" (at the maximum point). In order to construct a home that would incorporate adequate water drainage and prevent flooding while only balancing the site would require a building pad height of approximately 6.5 feet in height at the most extreme foundation footing. If we keep the proposed height we would have to lower the building pad height, therefore creating possible drainage and flooding issues in the future and the export of dirt would create a financial hardship on the project.
