Edith,
Public notice has to go out today at noon. So if it's a yes, then the newspaper notice, property signs and neighbor
notices go out today.
Also, if you have revised plans and answers to the questions, those will be needed today also.

Edith,
The Fire Department has reviewed the variance request for the Eton property.
I've cut and pasted their comments and I apologize that the format copied over oddly.

Review Type: Variance Request Review Received on: 04/18/17
Review Status: Comments Only Review Due Date: 04/28/17
Section I: Fire Code Review Comments/Conditions:
2.1 The fire code does not support the location of this garage due to limiting access along the west side of the main
home. The distance to existing home and property line is not acceptable for firefighting access or separation of
exposures. Accessing the west side emergency escape window of the home would be challenging.
Please email or call me with any questions related to any of the above Fire Code comments.

Narrative:
The reason for this Variance is to request a side set back reduction from 15'-0" to 2'-0" on the
southwest corner up to an 8'-0" reduction on the northwest corner of the new detached RV/
Boat garage on the west side of the existing home. We also need a reduction of the required
distance between buildings from 10'-0" to 3'-6" on the southeast corner of the garage. The
northeast corner still meets the 10'-0" requirement. This request is important as placing the
RV/ Boat garage anywhere in the property, aside from this location, that meets the current
variance and Code will highly affect the views of both immediate east and west neighbors that
have been accustomed to their lifestyle in the neighborhood for over 30 years.

Five Findings
APR 14 2011
BY: .......................
i) That there are special circumstances or conditions applying to the property
referred to in the application including its size. shape, topoeraphylocationor
surroundings which do not apply to other properties in the district.
Answer: SIZE: The proposed detached RV/ Boat Garage is to be approximately 29'-
0" wide x 41'-0" long x 18'-0" high to accommodate a motor home 8'-6" wide x 36'-
3" long x 12'-10" high and boat with trailer 8'-6" wide x 30'-0" long x 8'-0" tall. It will
be frame and stucco construction, to be complimenting to the existing home.
SHAPE: Due to the length of both recreational vehicles, the garage will be
rectangular with a roof pitch draining to the back of the property where the slope
significantly drops from the front of the property at the southernmost point of the
lot towards the back of the property into the easement.
TOPOGRAPHY: IF the existing car garage was ground level to the current
driveway, the two west corner points would be as such: approximately 3'-8" above
the ground at southwest point and 4'-8" above ground at the northwest point. As
you can see, refer to Exhibit I, the ground continuously drops both to the west and
the north of the property.
LOCATION: The requested approval for variance is to place new structure close
to the southwest corner of the home, approx. 3'-6"away, running close to parallel
with the property line, from 15'-0" setback requirement to 2'-0" on the southwest
corner, 15'-0" setback requirement to 8'-0" on the northwest corner, and from 10'-
0" to 3'-6" on the southeast corner of the garage, requiring a reduction of distance
between buildings as well.
We also cannot attach the garage east wall physically to the exterior west wall of
the home as, by code, we must have a secondary form of egress to the outside
either by a window or door in all bedrooms. There is currently an egress window on
the west of the home, refer to Exhibit F-4.
ii) That special circumstances were not created by the owner or applicant.
Answer: When the Homeowners decided to consider their new retirement
destination, they fell in love with Tucson, specifically with Oro Valley. Upon
searching for many months, they chose this property due to multiple locations
within their property with different views; to the southwest the city lights from
Tucson, to the northwest the city lights from Oro Valley, and to northeast, the
stunning views of the Catalinas. They knew they would be relocating all their
recreational vehicles and wanted the property with land to keep them. Upon
further exploration of the neighborhood, they discovered a few properties with
larger RV garages as well as property owners with all their "Toys" just sitting in the
front of the property, making those properties look like used car lots. They did not
want to be "those kind of neighbors" or subject their new neighborhood to the same
"used car lot" view, refer to Exhibit C-1, D-1, D-2 & E-2. Their intentions are to
maintain a beautiful neighborhood and keep all their "toys" in their property
without taking views away from any of their neighbors that have been in their
neighborhood for over 3 decades in some cases.
III) That the authorizing of the variance is necessary for the preservation and
enjoyment of substantial property rights.
Answer: After considering all areas within the property where a 29'-0"W x 41'-0"L x
18'-0"H detached garage can be located, and speaking to the neighbors on the past
& current enjoyment of their properties, the best placement for the garage is
between the West neighbor, Mr. Oliver Transue & their house. We all realize that
said garage CAN be placed in an area where it will meet code and not require any
variances, BUT both the east and west neighbors will be greatly affected in a
negative way.
By placing garage in an area towards the northwest of the property, where a
variance is not an issue, the garage would sit above current ground a minimum of 4'-
6" to maintain an optimal driveway and then have the height of 18'-0" added to the
4'-6" retaining wall. This will 100% obstruct the view of the West neighbor, Mr.
Transue, who has lived in that home since 1978. The East neighbors, Mr. and Mrs.
Abdul & Maria Kassamali, will also be losing their accustomed view since 1986 of
City of Oro Valley as well as our desired sunsets from their pool area. Therefore, this
Variance is so important and is currently supported by both neighbors, refer to all of
Exhibit G & H.
If the garage is placed anywhere in the front property, the only way we can
meet the set regulations is by attaching to existing structure. This means that the
East neighbors will lose all their Tucson city views as well as current home owners
will lose the evening city views from their future proposed front door, refer to
Exhibit A-4, C, H-3.
IV) That any variance granted imposes such conditions as will assure that the
authorizing of the adjustment shall not constitute a grant of special privileges
inconsistent with the limitations upon other properties in the vicinity and zone in
which the property is located
Answer: The only special privilege that this variance will grant is the continuation of
enjoyment of both East and West neighbors, which both have been living in said
1- .
properties for 30+ years. Other properties have detached garages in the
neighborhood so this would also not be a singular scenario. On the other hand, not
granting the variance will put neighbors in the position of feeling that their current
enjoyment of views was not considered by current the homeowners. Mr. and Mrs.
Kaskawal want to be team players and they have the best of interest for both their
home, their lifestyle, but most importantly their newly neighborhood.
v) That the authorizing of the variance be materially detrimental to persons residing
in the vicinity, to adjacent property, to the neighborhood or the public welfare in
general
Answer: As mentioned in point iii), if the homeowners are not granted the variance,
and the ability to place their new garage in between the west side of their property
and the east side of Mr. Transue's property, they will be placing the garage, meeting
all codes and Town of Oro Valley Regulations, in the back yard. This will severely
affect both their current views from their back yard, the immediate East and West
neighbors views, and remove a privilege these neighbors have been enjoying since
the mid 70's & 80's.
We have consulted with both immediate neighbors, east & west, and they BOTH
agree to the proposed location, refer to Exhibit J. Mr. Transue, owner of 630 E Eton
Dr is especially excited for the variance approval as he will be most affected if the
garage is placed on the back yard needing no reductions on variance. He would
much rather have the garage sitting just outside of his property rather than lose his
views.
Please consider our request. We have taken into consideration not just the
homeowners need, but the neighbor's requests and the beautification and
improvement of the neighborhood.
Thank you for your Consideration
