WHEREAS, GRANTEE requires a perpetual drainage easement on a parcel of land belonging to the GRANTOR; NOW THEREFORE, in consideration of One Dollar ($1. 00) and other valuable considerations the GRANTOR does hereby grant to the use of GRANTEE forever an easement for the construction and maintenance of a drainageway over that certain tract of land situated in Pima County, Arizona, and more particularly described as follows: SEE ATTACHED EXHIBIT "A" CONDITIONS: 1. GRANTEE agrees that the natural or existing contours of the above described land shall not be excavated, filled, or altered without prior approval of the Pima County Engineer. 2 . That if at any time hereafter the above described easement is abandoned by the GRANTEE, said parcel of land shall revert to the GRANTOR or to the successors in interest of the GRANTOR, and all rights, title, interest or claim existing by virtue and authority of this instrument shall be extinguished. 3 . The land where the easement is written is part of Dennis Weaver Park, a county park, at the time of easement preparation. The description of the easement boundary is as follows: BEGINNING at the West one quarter corner of said Section 24, Then S 89°59'35" E a distance of 2, 642 .89 feet to the center section marker, also being the centerline of Calle Concordia, Then S 89°59'35" E a distance of 42 . 11 feet, Then N 60°00'25" E a distance of 90. 00 feet to a point on the North Right-of-way line of Calle Concordia being 45 feet from the centerline of Calle Concordia, said point being the TRUE POINT OF BEGINNING, Then N 89°59'35" W along said north right-of-way line of Calle Concordia a distance of 80. 00 feet, Then N 60°00'25" E a distance of 25.47 feet, Then N 00°00'25" E a distance of 31.55 feet, Then S 89°59'35" E a distance of 20. 00 feet, Then S 00°00'25" W a distance of 20. 00 feet, Then N 60°00'25" E a distance of 179.70 feet, Then N 79°42'06" E a distance of 347. 64 feet, Then N 60°57'28" E a distance of 89.95 feet more or less to the easterly line of said Lot 51 of Linda Vista Citrus Tracts No. 2, Then S 00°08'38" E along said easterly line of Lot 51 a distance of 70. 00 feet to a point on the centerline of the 80 foot main easement, 9353 365 Drainage Easement Page 2 Then continuing S 00°08'38" E along said easterly line of Lot 51 a distance of 40. 64 feet, Then S 79°42'06" W a distance of 399.42 feet, Then S 60°00'25" W a distance of 75.82 feet to a point on the northerly right-of-way line of Calle Concordia being 45. 00 feet from the centerline of Calle Concordia, Then N 89°59'35" W along the northerly right-of-way line of Calle Concordia a distance of 80. 00 feet to the TRUE POINT OF BEGINNING.
