GRANT OF DRAINAGE EASEMENT
Rancho Vistoso
Neighborhood 2, Parcel E
This Grant of Drainage Easement (this "Grant") is made as of the 0.2.e day
of , 1988 by AMCOR Investments Corporation, a California
corporation, ("Grantor"), and the Town of Oro Valley, a municipal corporation
("Grantee").
1. Grant of Easement. In consideration of the payment of $1.00 and
other valuable consideration, the receipt and sufficiency of which is acknowledged
by Grantor,Grantor hereby grants and conveys to Grantee,its successors and assigns,
a non-exclusive easement (the "Easement") on, across, over and under the real
property legally described in the attached Exhibit A for the purposes of(a) collecting
and transporting surface, drainage, and storm waters, and (b) constructing and main-
taining banks,bank protection, channels,conduits, inlets, culverts, and other drainage
facilities and improvements; subject to Grantor's right to relocate the Easement in
accordance with the provisions of this Grant.
2. Exhibits. If a map or diagram is attached as Exhibit B, it is for
informational and illustrative purposes only. To the extent that Exhibit B or any
statement or information thereon may be inconsistent with the legal description set
forth on Exhibit A, the legal description shall prevail and control for all purposes.
Notwithstanding any acreage figures that may be set forth in any exhibit, this Grant
is made in gross.
3. Relocation of Easement. Grantor shall be entitled to relocate the Ease-
ment by recording a final plat or a new grant of easement (collectively, "Grant") in
the official records of the Recorder of Pima County, Arizona. The new Grant must
state that the Easement is being relocated, make specific reference to this Grant,
make a new grant or dedication of the Easement, and contain a legal description of
the new location of the Easement. Upon the recording of the new Grant, this Grant
will be automatically terminated without any further act or instrument of Grantor or
Grantee.
4. Binding Effect. All provisions of this instrument, including the benefits
and burdens,will run with the land and will be binding upon and inure to the benefit
of Grantor, Grantee, and their successors and assigns.
