RESOLUTION NO. 290
RESOLUTION FOR ABANDONMENT OF ROAD EASEMENT
LYING WITHIN SUBDIVISION KNOWN AS ORO VALLEY HEIGHTS
WHEREAS, it has been determined that the certain road
easement, more particularly described in Exhibit "A", attached
hereto, is no longer necessary to the town; and
WHEREAS, the owner of the surrounding property desires to
have said road easement abandoned; and
WHEREAS, such abandonment is permitted pursuant to A.R.S.
§28-1902:
NOW, THEREFORE, be it resolved by the mayor and counsel of
the Town of Oro Valley, Arizona, as follows:
1 . That certain road easement, more particularly
described in Exhibit "A" attached hereto and made apart
hereof, is hereby vacated and abandoned;
2. That title to the above-referenced abandonment
property shall vest as follows:
a. From the centerline of the easement east, to
Michael and Sandra KuroPatkin, husband and wife, and Malcolm
and Francine Levin, husband and wife, the owners of record of
Lot 2, Oro Valley Heights, recorded in the Pima Recorder's
Office at Book 29, page 26 of maps and plats, being the
property adjacent to and East of the subject easement;
b. From the centerline of the easement west, to
Merrill Holpert and Betty K. fiolpert, owners of record of Lot
3, Oro Valley Heights, recorded in the Pima Recorder's Office
at Book 29, page 26 of maps and plats, being the adjacent to
and west of the subject easement.
3. That the Town Clerk is hereby ordered to record this
resolution in the County Recorders Office, Pima County,
Arizona.

Oro Valley, this 14 th day of May , 1987

EXHIBIT A
Being a portion of the SW 1/4 of Section 13, T12S, R13E, G&SRB&M, Pima
County, Arizona;
Also being a portion of Lots 2 and 3 on a map entitled "Oro Valley
Heights" recorded in the Pima County Recorder's Office in Book 29, page
26 of maps and plats and being further described as follows:
Beginning at the southwest corner of Lot 2 which is also the southeast
corner of Lot 3, as shown on the above-mentioned map, and running
thence,
N 00°-03I-40" west, 289.50 ' to the southerly line of Atua Place and
there to end.
The above description is the center line of a 60' wide road easement;
i.e. 30' each on Lots 2 and 3.
Pedestal easements designated as P5 on each lot are to remain in place.

Dear Mr. Hook,
We the undersigned want to petition the Mayor and Town Council to vacate
a sixty foot easement that exists between Lots 2 & 3 Oro Valley Heights.
This sixty foot easement is divided as follows : ( see attachment)
Thirty feet on the west boundry of Lot 2 Oro Valley Heights
Thirty feet on the east boundry of Lot 3 Oro Valley Heights
This sixty foot easement was to be a dedicated street and named Calle
Amendra.However,it was our understanding that with the construction of
the condominums there would be no need for the easement that borders our
property on the south,thus no need for Calle Amendra.Therefore,we.the owners
of Lots 2 & 3 Oro Valley Heights concure that this sixty foot easement that
exists between our property be vacated because it is not needed.
