HomeMy WebLinkAboutOV1801514Town of Oro Valley Variance Request
Board of Adjustment Members,
I am requesting a Variance on the Owners behalf to reduce the front yard setback from 30 feet to 25
feet. This is for a proposed attached habitable space and single car garage on my clients' property. The
garage is the portion of the addition that we are requesting to modify the setback for. The addition has
not yet been built. This Variance is not in response to a code violation. This house belongs to the
Sunnyslope housing subdivision. This property is located in the RI-36 zone. We are requesting this front
setback modification to keep in line with the existing neighbor on the same street. 450 E. Glenhurst
Drive, which is 2 houses to the north, has a current setback of approximately 18'-0" from the front
street property line. We are requesting a modification of only 5' where this neighbor built at a 12'
modification. The garage wall height will be approximately 12'-0", which is below the 18'-0" maximum
required height. The proposed addition compliments the scale, height and material appearance of the
existing residence and surrounding houses. We request this front modification because the rear and side
yards of this property have a very steep terrain and the cost to build in these areas would be a great
burden on the home owners. We would not want to alter the current drainage and lush vegetation of
the existing landscape anyhow. The requested setback modification would not impede any of the
neighbors' views or rights as the nearest neighbor is approximately 100'-0" from the existing and
proposed structures. We are not requesting anything that will give special privilege to the homeowner
due to fact that the neighbor two properties down has a greater setback modification than what we are
requesting. Please consider this setback modification as it will increase the property value and aesthetics
of the neighborhood.
Thank you for your time and consideration.

Discussion about why the structure can't be slightly moved and size adjusted to meet standards.
The fact is that there are options to build this to meet code.
He will discuss with his clients.

RE: Variance for 410 E. Glenhurst Drive, case OV1801514
Vance,
Thank you for submitting the variance request for the front set back reduction at the above mentioned
address. Staff always wants to make sure an applicant has a very clear concise submittal to forward to
the Board of Adjustment, therefore we suggest the following corrections for the plans:
1. The written request should be divided into the six sections. First should be the narrative
describing the request and then write out each question from the Board of Adjustment
submittal list, followed by your response. Each question should be answered in complete detail.
2. The following comments are based on the narrative submitted with the plan:
a. The reference to the "habitable" space is unusual language, followed by mention of the
garage portion of the space. This might be better explained by adding a simple floor
plan to the submittal. Also a simple elevation of the addition could be helpful also.
b. Reference to the addition not being built and not a violation isn't particularly necessary.
c. The house doesn't belong to the Sunnyslope subdivision but is located in that
subdivision.
d. Variances are reviewed and approved or denied based on the individual property not
because of situations on other properties. Precedence is not set for the neighborhood
with a variance. While interesting and worth mentioning, you shouldn't place the basis
of the request because of a situation on someone else's property.
e. You mention the rear and side yard topography but this addition isn't planed in those
areas. Please explain.
3. The first question that comes to mind when reviewing the plan is, what prevents the proposed
addition from being reduced by 5' in the front to meet the setback? You'll want to make sure
your submittal provides a clear explanation. Also this explanation will need to be continued
when answering the variance questions that refer to special circumstances and how special
circumstances weren't created by the owner.

Town of Oro Valley Variance Request
Board of Adjustment Members,
I am requesting a Variance on the Owners behalf to reduce the front yard setback from 30 feet to 25
feet. This is for a proposed attached addition with a single car garage on my clients' property. The
garage is the portion of the addition that we are requesting to modify the setback for. Please see
attached floor plan. The addition has not yet been built. This house is located in the Sunnyslope housing
subdivision. This property is in the RI-36 zone. The request is to allow adequate living space in the
addition while retaining some of the eastern view from the existing kitchen. The existing east views out
the existing kitchen and the adequate living space would not be possible without the 5' reduction. See
attached site plan showing views from the existing windows. The following are the responses to the
Boards submittal list.
1. That there are special circumstances or conditions applying to the property referred to in the
application including its size, shape, topography, location or surroundings which do not apply to
other properties in the district.
Response: While other properties in this area also have steep terrain, this property has most of the
lot covered in steep terrain. See attached site plan showing extreme topography. This makes the
buildable area limited to where we are proposing the addition. The existing house with a small grass
area and driveway take up all the buildable space making this small patch of flat land the only
suitable location for an addition. To build in these areas would be a great financial burden to the
homeowners. The topography ensures proper sheet flow drainage throughout this neighborhood
and street. Adjusting these slopes could have a negative impact on the drainage and create
unnecessary erosion. If the addition is moved south 5' and out of the setback, the views would be
greatly diminished. See attached site plan showing views from the existing windows.
2. That special circumstances were not created by the owner or applicant.
Response: The current owners have just purchased this land and residence. These special
circumstances were not created by the owner. They did not originally build the existing house and
driveway. if they had, they would have built it more efficiently on the buildable area and not wasted
so much potential flat land and this variance request would not be necessary.
3. That the authorizing of the variance is necessary for the preservation and enjoyment of
substantial property rights.
Response: As previously stated in the opening brief narrative, there are very beautiful views out the
existing kitchen windows towards the north and the east. The proposed addition is pushed forward
on the property to retain most of these views that are afforded to this property and owners. The
addition would help improve property rates as it will itself increase in value with the added square
footage and garage space. The requested setback modification would not impede any of the neighbors'
views or rights as the nearest neighbor is approximately 100'-0" from the existing and proposed
structures.
4. That any variance granted imposes such conditions as will assure that the authorizing of the
adjustment shall not constitute a grant of special privileges inconsistent with the limitations
upon other properties in the vicinity and zone in which such property is located.
Response: We are requesting this front setback modification to keep in line with the existing neighbor
on the same street. 450 E. Glenhurst Drive, which is 2 houses to the north, has a current setback of
approximately 18'-0" from the front street property line. We are requesting a modification of only 5'
where this neighbor built at a 12' modification. The garage wall height will be approximately 10'-W,
which is below the 18'-0" maximum required height. We are not requesting anything that will give
special privilege to the homeowner due to fact that the neighbor two properties down has a greater
setback modification than what we are requesting.
S. That the authorizing of the variance will not be materially detrimental to persons residing in the
vicinity, to adjacent property, to the neighborhood or the public welfare In general.
Response: The proposed addition compliments the scale, height and material appearance of the existing
residence and surrounding houses. See attach proposed three-dimensional rendering of the addition.
Please consider this setback modification as it will keep the existing mountain views from the existing
residence and increase the property value and aesthetics of the neighborhood.
Thank you for your time and consideration.

RE: Variance for 410 E. Glenhurst Drive, case OV1801514
Vance,
Thank you for the additional information submitted via email on June 7. 1 have completed the review of
this second submittal and offer the following comments:
1. The narrative refers to the living space of the new addition, existing kitchen and impacts of
existing views from the kitchen. Perhaps a full floor plan (a simple one, not full building permit
detailed) in conjunction with the site plan could show what you mean by those references.
2. The color 3D rendering is good, but label which part of that drawing is the new addition and
then more specifically which part is related to the 5' variance request.
3. Comment to your answer in question 1: Explain how the 5' part of the building and the
topography are related. You seem to mention that the addition can't be built in other areas
which is good information but how does that affect the 5' part of the building in question?
4. Comment to your answer in question 2: It is good you explained the current conditions but
you'll also need to touch on why the owners are choosing to build the structure at its proposed
size so that it extends into the setback. The reference about the trees isn't clear.
5. Comment to your answer in question 3: Again, a floor plan explaining the kitchen reference
might be good and also focus on why the 5' projection into the setback is necessary.
Let's schedule a meeting to review this case, if not in person then most definitely by phone.
You may resubmit the new information directly to me via email if you like. This case will be placed on
the agenda for the Board of Adjustment once a complete submittal is received and has been determined
to be ready to forward to the board members.
