U.S. Fish & Wildlife Service Letter Site Analysis and Tentative Development Plan Chapala 3 Acres & George 3 Acres WLB No. 105013-A-001 August 17, 2005 ii I INTRODUCTION This site analysis and Tentative Development Plan are being prepared in support of two rezoning proposals: approximately 3.3 acres for Chapala Partners, LLC and approximately 3.3 acres for Joe and Rosemary George. Based on recommendations from Town staff, cooperation between Chapala and the Georges is highly encouraged throughout the rezoning process as well as during the construction phase. To this end, the two have signed a Cooperation Agreement. Chapala Partners wishes to split their property into three one -acre lots for the purpose of building custom single-family residences. The Georges wish to split approximately one acre from the southern portion of their property for sale to a homeowner in the vicinity who intends to construct a home for a family member. Per an agreement with Bob Conant, Planner ll, and due to the fact that the proposals are both simplistic in scope and small in land area, this site analysis does not cover all areas specified in Section 3-104 of the Oro Valley Zoning Code Revised. Rather, it focuses on the most pertinent physical issues as they relate to development of the subject property. A. Existing Land Uses 1. Site Location The subject properties consist of approximately 3.3 acres each located within the Town of Oro Valley in Section 35, Township 11 South, Range 13 East, Pima County, Arizona. To the west of the properties is La Canada Drive, which is currently under construction. Once complete, La Canada Drive will serve as an arterial connection between Moore Road to the north and Tangerine Road to the south. Refer to Exhibit Al for a location map of the subject property, and to Exhibit A2 for an aerial photograph of the subject property. 2. Existing Land Uses - Onsite The Chapala Partners property is currently undeveloped and vacant. The George residence exists in the northern portion of their property and is visible in Exhibit A2. Existing Adjacent Land Uses The subject property is surrounded by the following existing zonings and land uses: a/b. North R1-20 (Vistoso Highlands subdivision) ' East R1-144 (One residence) East Beyond R1-20 (Moonridge subdivision) South R1-20 & R1-36 (Tangerine Heights subdivision) LR1-36 (Vistoso Gateway subdivision) West R1-144 (Vacant) Vacant land exists across La Canada Drive. To the north is the Vistoso Highlands subdivision featuring an average lot size of 28,514 square feet. South of the properties is the Tangerine Heights subdivision with an average lot size of 26,270 square feet. To the southwest is the Vistoso Gateway subdivision with an average lot size of 36,626 square feet. To the east are two 5-acre parcels on which a single house exists. Beyond this residence is the Moonridge subdivision with an average lot size of 26,626 square feet. The cover sheets of the nearby plats are included as Appendix C The current Town of Oro Valley General Plan designates all of the surrounding property are LDR-2.0 with the exception of the ten acres adjacent to the east, which is designated as LDR-1.2. The Town of Oro Valley General Plan Update 2020 current draft does not propose to change these designations from how they are shown in the existing plan. C. There are both one story and two story structures within one -quarter mile of the subject property. d/e. There are no pending or conditionally approved rezonings within one - quarter mile of the subject property. Several approved subdivisions exist within one -quarter mile of the subject properties, as described above in Section 3-a/b. g. Refer to Exhibit A3 for examples of architectural styles within one -quarter mile of the subject property. 4. Well Sites There are no wells within 100 feet of the subject properties. Topography 1. Topographic Characteristics The subject properties are located along a shallow ridge sloping gradually from a high point in the north to a low point in the south. Elevations range from 2844' to 2852' on the Chapala property and from 2836' to 2848' on the George property. There are neither areas of slope greater than 15 percent, nor any rock outcrops on the properties. Exhibit B shows the topography of the subject properties. 2. Pre -Development Average Cross Slope This figure was derived using the formula as set forth by the Hillside Development Zone, Section 10-110 of the Oro Valley Zoning Code Revised. The average cross slopes were calculated as follows: Chapala Partners Property (1)(L)(0.0023) = (2')(2,542')(0.0023) = 3.54 % A 3.3 ac. George Property (1)(L)(0.0023) = (2')(2,203')(0.0023) = 3.07 % A 3.3 ac. Hydrology 1. Offsite Watersheds Offsite drainage impacts the subject properties at one location along the northern property line. At this point, as shown on the Tentative Development Plan, approximately 34 cfs enters the site from the Vistoso Highlands subdivision to the north. A wash having a flow of approximately 460 cfs flows north -south through the property adjacent to the east of the subject property. 2. Offsite Natural or Man -Made Features The construction of La Canada Drive has altered flows in the area. A new CMP has been installed beneath the access drive off La Canada to the subject properties. All flows, from both on -site and off -site, exit the subject property via shallow sheet flow. 3. 100-Year Discharges Greater Than 100 cfs There are no areas with 100-year discharges greater than 100 cfs on the subject properties. 4. Onsite Hydrology The onsite drainage generally is conveyed in a southerly direction as shallow sheet flow draining at a slope of 3 to 4 percent. The contours of the land are generally parallel with minimal channelization of the flow. There are no onsite drainage facilities. The subject properties are located within FEMA Zone X: Areas determined to be outside 500-year floodplain. There are no federally mapped floodways or floodplains within one -quarter mile of this site. D. Vegetation The subject properties have moderate vegetative densities and are characteristic of the Sonoran desertscrub Palo Verde / Mixed Cacti community. One significant saguaro and several dozen mature Palo Verdes, Mesquites and Acacias exist on site. Numerous barrel and Cholla cactus are also present on the subject properties. Utmost care will be taken to preserve and transplant viable plants since they are integral to the genus loci of the property. Vegetative density is evident in Exhibit AZ Aerial Photograph. Exhibit C shows typical vegetation on site. Site Analysis and Tentative Development Plan 8 Chapala 3 Acres & George 3 Acres W " WLB No. 105013-A-001 August 17, 2005 E. Wildlife Preliminary analysis indicates a low probability for the presence of any threatened or endangered species on site. The edge of a xeroriparian area crosses through the eastern edge of the Chapala Partners property, as shown on the Tentative Development Plan. No disturbance is planned in this area. No aquatic ecosystems exist on site. A site file check was requested of the Arizona Game and Fish Department for review and comment on the potential for high densities of a given species' population or an unusually high diversity of species on the subject properties. In their response letter, included as Appendix D of this report, AZGFD staff did not express a high level of concern about the proposed development. According to the United States Fish and Wildlife Service (USFWS) and the Sonoran Desert Conservation Plan Priority Vulnerable Species lists, there are two State listed threatened and endangered species potentially having habitat on the subject property. These species are the Cactus ferruginous pygmy owl (Glaucidium brasilianum cactorum) and the Rufous -winged sparrow (Aimophila carpalis). The Rufous -winged sparrow has a medium potential for habitat on the subject property. The subject property is outside the USFWS November 27, 2002 proposed critical habitat for the Cactus ferruginous pygmy owl, although the entire community is within the proposed recovery area. A site file check has been requested of the USFWS. In their response letter, included as Appendix G of this report, USFWS staff did not express a high level of concern about the proposed development. F. Viewsheds 1. Distant views of the Catalina Mountains to the east and the Tortolita Mountains to the northwest are visible from the subject properties and across the properties from adjacent parcels. Affects on these views by the proposed four residences will be minimal, if any, due to the relatively large size of adjacent lots. 2. Both properties are fairly visible from offsite areas, especially from the west along La Canada Drive. The eastern portion of the Chapala property is less visible because it is on the far side of the shallow ridge that runs north -south through the properties. H. Trails The Glover Road Trail (#325) alignment runs north -south approximately 700 feet west of the subject properties. It will be intended for hiking, bicycling and equestrian use. The Oro Valley Pedestrian & Bicycle Plan designates a planned shared use path along La Canada between Tangerine Road and Moore Road. 2. As identified in the "Eastern Pima County Trails System Master Plan", there are no proposed trail rights -of -way located onsite. Site Analysis and Tentative Development Plan 10 Chapala 3 Acres & George 3 Acres WLB No. 105013-A-001 August 17, 2005 1. Cultural / Archaeological / Historic Resources A brief field survey indicates a low probability for the presence of any archaeological resources on site. A letter and conceptual site plan were submitted to the Arizona State Museum for review and comment on the potential for such resources on the subject properties. In their response letter, included as Appendix E of this report, AZSM staff did not reveal the existence of any known sites or express a high level of concern about the proposed development. J-K. Utilities Sewer A new manhole has recently been constructed along the western boundary of the Chapala Partners property as part of the Vistoso Highlands development. Preliminary discussion with Pima County Wastewater Management indicates that capacity exists and that this manhole is a suitable connection point. The location of the sewer line is shown on the Tentative Development Plan. 2. Water For its potable and irrigation water needs, the subject property will connect into the 12" line located within the Vistoso Highlands development, as shown on the Tentative Development Plan. Chapala Partners will coordinate with the Vistoso Highlands Homeowners Association and Oro Valley Water to design and construct this connection. 3. Dry Utilities The following companies are expected to provide dry utility service to the subject property: Phone: Electric: Gas: Cable: Solid Waste Disposal: L. Schools Qwest Tucson Electric Power Southwest Gas Comcast Waste Management 1. The site is located in the Amphitheater School District. Copper Creek Elementary is located approximately one mile south of the site. Painted Sky Elementary is located approximately 1.2 miles east of the site. Although the anticipated impact on local schools is minimal, the District has been contacted regarding the proposed construction. Their response letter mentions an acceptable voluntary contribution agreement that will be finalized prior to construction. The District's letter is included as Appendix F. Dear Mr. Oland: On May 25, 2005, we received a request for an archaeological records check for the above -referenced property. I have consulted our records with the following results. The property has not been inspected for archaeological. or historical resources, The Arizona State Museumtherefore recommends a surface inspection by a qualified archaeologist to determine whether there are archaeological or historical resources on the property. A list of qualified archaeological contractors can be viewed on our website at bttp://wN-,.v.statemuseum arizona.edyinTofsvcs/pennits/pen-nittees.ast) Archaeological surface inspection required under city or county ordinance, or a federal regulation, will require a written report describing the results of the surface inspection and will include recommendations. The archaeologist you select should prepare your report using the standards titled: Standards For Conducting and Reporting Cultural Resource Surveys. Most contractors in Arizona have a copy of these standards. You are responsible for providing the report to the appropriate office requiring the inspection.' When surface inspections are required on private lands under city or county ordinance the archaeologist will also submitted copies of your report to the appropriate archaeological site file office. If you have selected an archaeologist from the list provided, that contractor knows where and when to submit reports. If you have questions or need further assistance please contact me. OV9-05-04,6.6 acres (Chapala development) Dear Mr.. Oland: Amphitheater Public Schools is actively seeking the support of developers and liornebuilders; in the construction of new schools. We are doing so in a tirne.-when the District no longer exclusively controls such question.,; as when and where to build new schools. School districts may no longer issue Class A bonds for school construction. Under the Students First le gislation, tile Arizona State School Facilities Board (SFB) now finances new school construction. The-SFB uses different criteria than a local district might in determining whether to build a new school. Local districts have traditionally built schools, Nvith voter bond approval, in growing neighborhoods to accommodate increasing enrollment resulting from "new develo prilent. This tradition of building schools where homes are built ensured that students could attend "neighborhood schools." The SFB,. however, approaches things quite differently. 7he,SFB does not focus upon enrollment growth within specific neighborhoods, but instead across whole districts. Ifa district is experiencing growth in one neighborhood but enrollment is declining in another, the SFB decides whether there is need for a new school based upon "net growth," The SFB requires districts with capacity in some schools to absorb growth into those schools before tile SFB will build new schools. What this requires, of course, is that districts must redraw boundaries and/or bus students long distances to schools that are not within their neighborhoods. The SFB, when it does determine that a school must be built, is also building schools of a much lower pbvsical quality than those our local community has come to expect. Our recent experience has been that the SFB allocates about two- thirds of the resources we have normally allocated to build schools with bond fundin4y, Amphitheater Iligh Canyon d.-I Oro I ligh 0 b-onwood Rid -cc Hilt 0 Amphitheater Afternitiv.- ArMliftlicater Middle School 0 Coronado K-%* ScItooll Cross Middle Sch(ml 0 La Una Middle School * Wi6on K-8 Schuh Copper Creek r :guy * Wialck-n Elenumtuy itxrclsoii Ficnicut wy * I Iola" ay Elcrnenwy * Keeling Elcmcritary fanetr. I-LANIDLING SONORA T DESERT TORTOISES ENCOUNTERED ON DEVELOPMENT PROJECTS Arizona Game and Fish Department Revised January 17, 1997 The Arizona Game and Fish Department (Department) has developed the following guidelines to reduce potential impacts to desert tortoises, and to promote the continued existence of tortoises throughout the state. These guidelines apply to short-tenn and/or small-scale projects, depending on the number of affected tortoises and specific type of project,' Desert tortoises of the Sonoran population are those occurring south and cast of the Colorado River. Tortoises encountered in the open should be moved out of harm's tiaray to adjacent appropriate habitat. If an occupied burrow is determined to be in jeopardy of destruction, the tortoise should be relocated to the nearest appropriate alternate burrow or other appropriate shelter, as determined by a qualified biologist. Tortoises should' be moved less than 48 ` hours in advance of the habitat disturbance so they do not return to the area in the interim. Tortoises should be moved quickly, kept in an upright position at all times' and placed in the shade. Separate disposable gloves should be worn for each tortoise handled to avoid potential transfer of disease between tortoises. Tortoises must ; not be moved if the ambient 'air temperature exceeds 105 degrees Fahrenheit unless an alternate burrow is available or the tortoise is in imminent danger. A tortoise may moved up to two miles, but no fiirther than necessary from its original location. If a release site, or alternate burrow, is unavailable within this distance, and ambient air temperature exceeds 105 degrees Fahrenheit, the Department should be contacted to place the tortoise into a Department -regulated desert tortoise adoption program. Tortoises` salvaged from projects wlich result in substantial permanent habitat loss (e.g. housing and highway projects), or those requiring removal during long-term (longer than one week) construction projects, will also be placed n desert tortoise adoption programs. .r1 Managers of projects lik:e1j, to affect desert tortoises should obtain a scientific collecting pertrzit from the Department to facilitate temporary possession of tortoises. Likewise, if large numbers of tortoises (>5) are expected to be displaced by a project, the project manager should contact the Department for guidance and/or assistance. Please keep in mind the following points: • These guidelines do not apply to the Mohave population of desert tortoises (north and west of the Colorado River). Mohave 'desert tortoises are specifically protected tinder the Endangered Species Act, as administered by the U.S. Fish and Wildlife Service. • These guidelines are subject to revision at the discretion of the Department. We recommend that the Department be contacted during the planning stages of any project that may affect desert tortoises. • Take, possession, or harassment of wild desert tortoises is prohibited by state law. Unless specifically authorized by the Department, or as noted above, project personnel should avoid disturbing any tortoise. TOWN OF ORO VALLEY STAFF REPORT PLANNING AND ZONING COMMISSION TO: PLANNING AND ZONING COMMISSION FROM: Robert Conant, Senior Planner MEETING DATE: August 2, 2005 SUBJECT: PUBLIC HEARING — OV9-05-04, THE WLB GROUP, REPRESENTING CHAPALA AND GEORGE, REQUESTS A REZONING FROM R1-144 (RESIDENTIAL WITH 144,000 S.F. LOT MINIMUM) TO R1-36 (RESIDENTIAL WITH 36,000 S.F. LOT MINIMUM) FOR PROPERTY LOCATED ON THE EAST SIDE OF LA CANADA DRIVE SOUTH OF MOORE ROAD, PARCELS 219-49-0050 AND 219-49-0060 OWNERSHIP: AGENT: Joe and Rosemary George 1191 W. Moore Road Oro Valley, AZ 85737 The WLB Group 4444 E. Broadway Tucson, AZ 85711 Chapala Partners, LLC P.O. Box 69056 Oro Valley, AZ 85737 PETITIONER'S PROPOSED USE AND STATED REASON FOR THE REQUEST: The applicant states that the rezoning would allow the development of five (5) single-family lots on the 6.6 acres consistent with the General Plan. BACKGROUND: Currently, the Chapala property is undisturbed desert and the George property has a single home. The topography of the site is relatively flat. Vegetation consists of Palo Verdes, Mesquites, Acacias, Barrel Cacti and Cholla. There is one significant saguaro on the site to be preserved in place. The vegetation within the project area is representative of the Arizona Upland Subdivision of the Sonoran Desert. There are no riparian areas on site. Two small drainages originate in the site and flow south. A Preliminary and Final Plat will be required for the Chapala property in order to subdivide the site as depicted on the attached Tentative Development Plan. SURROUNDING LAND USES: Orientation Zoning Land Use North R1-20 Residential Vistoso Highlands South R1-144 and R1-20 Single House and Vistoso Gateway East R1-144 Single House West R1-144 and R1-20 Vacant and La Canada Hills TOWN OF ORO VALLEY PLANNING AND ZONING COMMISSION STAFF REPORT Page 2 TENTATIVE DEVELOPMENT PLAN: The Tentative Development Plan (TDP) submitted for the site is in general conformance with the requirements of the Oro Valley Zoning Code Revised (OVZCR). Currently, the George, Chapala, Knott/George and Mendoza properties all take access from La Canada Drive, via access easements (see attached aerial). The Tentative Development Plan for this rezoning proposes a private cul-de-sac street which will provide access for the George and Chapala properties. Staff has recommended a condition of this rezoning to extend the cul-de-sac in a manner to organize access by focusing on use of one main street — opposed to a patchwork of unimproved easements. If the cul-de-sac for the Chapala property is extended south between lots 2 and 3 to the Knott/George property, this will provide organized and improved access for the area. The need for this planning will be particularly important if the other properties are rezoned to a higher density in the future. Access has been provided for the Mendoza property from the north and south. North Tall Grass Drive in Tangerine Heights dead ends at the southern property line of the Mendoza property and a stub street has been constructed to the north property line from Vistoso Highlands. These two streets provide future access to the Mendoza property if and when it is rezoned and subdivided. Topography Impacts: The site is relatively flat with the following cross slopes: Chapala 3.54% and George 3.07%. Wildlife and Vegetation Impacts: Currently, there is little evidence of endangered wildlife habitat in the project area. A letter from the Arizona Game and Fish Department has been included in the site analysis report. Viewshed Impacts: Views of the Catalina Mountains to the east and the Tortolita Mountains to the northwest are visible from the subject properties and from adjacent properties. Affects on these views by the proposed four new residential lots will be minimal, if any, due to the size of the adjacent lots and the proposed lots. Traffic Impacts: This applicant proposes a private drive to serve the three lots created on the Chapala property, a new access easement out to the La Canada right-of-way for the George property, 'and the new lot created on the southern end of the George property. Grading Impacts: The developer of the Chapala property will install the street, utilities and drainage improvements via a type 2 grading permit. Each lot, including the new lot created on the George property, will require separate grading plans and type 1 grading permits to construct the homes. All requirements of the Grading Ordinance, Chapter 22, Section 22.10 of the Oro Valley Zoning Code Revised apply to this project. TOWN OF ORO VALLEY PLANNING AND ZONING COMMISSION STAFF REPORT Page 3 Drainage Impacts: This project has no areas with 100-year discharges greater than 100 cfs; therefore, there are no onsite drainage facilities. All existing drainage patterns will be maintained in the developed condition. Water Impacts: The Oro Valley Water Utility will serve this project. The average daily demand will be 120 gallons per person per day and the total demand will 1296 gallons per day. The developer and/or individual home owner will be required to pay for the infrastructure improvements. Water service will be provided via a 12-inch line located in the La Canada right-of-way. Sewer Impacts: The site will be served by public sewers and connections will be made to an existing 12-inch main in La Canada Drive. The individual home builders will have to receive approval from Pima County Wastewater to connect to the existing sewer line. SCHOOL IMPACTS: The Amphitheater School District has sent a letter included in the site analysis requesting the applicant consult with district. Based on the generation factors for the school district this rezoning will product the following number of school children: Elementary 2 Middle School High School In compliance with Resolution 04-15, the applicant has met with the school district. GENERAL PLAN CONFORMANCE: Staff has evaluated this rezoning proposal against the General Plan Land Use Plan and Policies, and finds that overall the proposal conforms to the General Plan based on the following: Land Use: The General Plan land use map designates this property as Low Density Residential 0.6-1.3 dwellings per acre. The density of the proposal is 0.76 dwelling units per gross acre. Natural Resources: The goal of this policy is to protect the Planning Area's natural attributes. Policy 8.1N states that "Mass grading is prohibited for all residential developments 2 RAC and under........" Because of the lot areas shown on the Tentative Development Plan, all lots will be custom graded in accordance with this policy and grading limits will be established to protect native vegetation. Saguaros will be preserved in place. There are no significant washes on the site. TOWN OF ORO VALLEY PLANNING AND ZONING COMMISSION STAFF REPORT Pau 4 Public Facilities and Services: The proposed plan complies with the goal to "ensure that adequate public facilities and services are provided when needed." The major service providers have no objection to this rezoning. NOTIFICATION: All property owners within 600 feet have been notified of the proposed rezoning. Furthermore, the property was posted in accordance with State Statute and the OVZCR. RECOMMENDATION: It is recommended that the Planning and Zoning Commission recommend that the Town Council approve OV9- 05-04, rezoning 6.0 acres located on the east side of La Canada Drive south of Moore Road form R1-144 to Rl- 36, subject to the conditions listed in Exhibit A finding: 1. That upon satisfaction of the conditions the project will be in compliance with the Oro Valley Zoning Code and General Plan. 2. The proposed rezoning is consistent with the General Plan land use designations to the north, south and east. 3. The proposed rezoning is consistent with the current zoning for properties to the north, south and west. 4. That the proposed rezoning will not be detrimental to the health, safety or general welfare of the residents in the area. SUGGGESTED MOTIONS: The Planning and Zoning Commission may wish to consider one of the following suggested motions: I move to recommend that the Town Council approve OV9-05-04, rezoning 6.0 acres on the east side of La Canada Drive south of Moore Road from R1-144 to R1-36, subject to the conditions listed in Exhibit A attached, herewith.
