Date: May 1", 2006 Background: Timeline: ■ November 22"d, 2005 - OV12-05-35, Pre -application submitted and meeting held. ■ Minor Land Subdivision Ordinance - Adopted by Council October 19th by Ordinance (0) 05-40. ■ Minor Land Subdivision Ordinance- Went into effect November 181h, 2005. ■ Lot split record from Pima County Assessor's recorded December 21", 2005 (review attached Exhibit 5) ■ March 8th, 2006 - OV12-05-35, Pre -application submitted and meeting held. ■ April 7th, 2006 - OV12-0535 - Formal Development and Landscape Plan application submitted. ■ April 20th, 2005 - OV12-0535A - Request for retro-active review of Minor Lands Subdivision submitted. Minor Land Subdivision Ordinance (review attached Exhibit 4): Applicable Section: Section22.9 C 3: Review Process: If the proposed land division does not constitute a subdivision, the application is reviewed for compliance with the following criteria: I. The lots resulting from the proposed minor land division conform to the minimum lot size requirements for the zoning classification of the property. II. Adequate access is available to public street(s) from the proposed lot(s). 1 III. The location of any existing building on any lot resulting from the proposed land division complies with building setbacks for the applicable zone. IV. Provision of, and access to, public utilities can be accommodated. V. Access for emergency vehicles and services. Staff Review of Minor Lands Subdivision: The proposed lot split for the property was already recorded, without Oro Valley Town approval as required by the OVZCR. A retro-active review of this Minor Lands Split has been requested for Parcels # 223-020-017M, 223-020-017N, and 223-020-017F. Staff has determined that the proposal does not meet the following requirement: II. Adequate access is available to public street(s) from the . proposed lot(s). Therefore, staff has provided the conditions listed below to be place on the properties. Public Works. - The Town Engineer will not permit any new curb cuts onto Rancho Vistoso Blvd. The parcels should utilize a shared access drive. The aerial photo shows the current curb cut and median cut on Rancho Vistoso Blvd for this very purpose (review attached Exhibit 1). The parcels should utilize a shared access drive. If the parcel was to be split, access to each parcel from this drive would have been a requirement (review attached Exhibits 2 & 3). Therefore, in order to accommodate this retro-active review of an illegal split, Public Works staff requests the following condition, as applied to Parcels # 223-020-017M, 223-020-017N, and 223-020-017F, in order to approve the request for Minor Land Subdivision: a) No new curb cut shall be made from Rancho Vistoso to serve this site; and b) A shared access drive from the current curb cut on Parcel #223-020-017M shall be provided in order to accommodate ingress/egress for both parcels. This access drive shall be development concurrently with the development of Parcel # 223-020-017N (Vistoso Memorial Chapel) to provide access to this parcel. Planning: Cross -access is a critical issue for this parcel, as well as the two adjoining parcels to assure the functionality of Rancho Vistoso Blvd. Approval of a lot split on these parcels will require cross -access and utilization of the shared access drive from the original parcel. Therefore, Planning staff requests the following conditions, as applied to Parcels # 223-020-017M, 223-020- 017N, and 223-020-017F, in order to approve the request for Minor Land Subdivision: a) A shared access drive from the current curb cut on Parcel #223-020-017M shall be provided in order to accommodate ingress/egress for both parcels. This shared access drive shall be developed at the time of development on either parcel. b) A cross -access drive for both Parcel # 223-020-017N and # 223-020-017F shall be provided at the northern entrance proposed at this site (review attached drawing). The site will be developed up to the property line and blocked off with bollards until the northern parcel is developed. Cnnrlucinn: Staff is aware of the concerns f rom the owners regarding through traffic. Passive traffic measures can be taken to ensure that access through Parcel # 223-020-017N is mitigated (such as placing traffic cones to block the drive access aisle during funeral processions). Planning and Public Works staff respectfully request the abovementioned conditions be applied to these parcels when rendering a decision on the OV12-0535A - Request for retro-active review of Minor Land Subdivision. approve; or deny OV12-05-35A, subject to conditions listed above.
