COVENANTS RUNNING WITH THE LAND
AND NO ACCESS EASEMENT
That TITLE INSURANCE COMPANY OF MINNESOTA, a Minnesota corporation
as Trustee under Trust No. 10,171
, owners of
that certain land, for themselves, their successors, grantees and assigns
herewith publishes and declares this instrument as and for a covenant running
with the land herein described for the purposes set forth herein and for the
consideration'of One Dollar ($1.00) and other valuable considerations do
hereby grant to THE TOWN OF ORO VALLEY, A Body Politic, a one (1.0) foot NO
ACCESS EASEMENT and do place a restriction on the use and occupancy of the
land abutting said easement described as follows:
The Westerly 1.00 foot and the Southerly 1.00 foot of
that Private Drainage Easement recorded in Docket 6526 at
Page 186 in the Office of the Recorder of Pima County,
Arizona.
The Grantee shall have the right under this easement over the above described

property to maintain a NO ACCESS EASEMENT and to enter upon said above described CSD

CONDITIONS:
1. The Grantors, for themselves, their successors and their 4-"1
assigns, hereby waives any claim for any and all damages to Grantors re-
maining property contiguous to the right of way conveyed by reason of the
location, construction, landscaping or maintenance of said easement.

2. That if at any time hereafter the above described easement is
abandoned by the Grantee said parcel of land shall revert to the Grantors
or the successors in interest of the Grantors, and all right, title, in-
terest or claim existing by virtue and authority of this instrument shall
be extinguished.
3. That all grants, covenants and provisions herein shall be binding
on and inure to the benefit of the heirs, successors and assigns of the
parties hereto.

with the land herein described for the purposes set forth herein and for the

hereby grant to THE TOWN OF ORO VALLEY, A Body Politic, a one (1.0) foot NO
ACCESS EASEMENT and do place a restriction on the use and occupancy of the
land abutting said easement described as follows:
A one-foot (1.00) wide strip of land lying easterly and
southerly of and contiguous with portions of the westerly and
northerly boundary line of Placita Del Oro Patio Homes, Lots
1 through 42 and Common Areas A, B, C, D and E, as recorded in
Book 34 of Maps and Plats at Page 18 in the Office of the Recorder
of Pima County, Arizona, said boundary line being more particularly
described as follows:
Beginning at the Southwest corner of said Placita Del Oro
Patio Homes:
Thence, NO°00'35"E, 270.63 feet;
Thence, S89°59'25"E, 313.00 feet;
Thence, NO°00'35"E, 869.83 feet to the Northwest corner
of said Placita Del Oro Patio Homes, the northerly terminus
of said strip of land. Said strip of land shall be extended or
shortened, as the case may be, so as to terminate in the boundary
lines of said Placita Del Oro Patio Homes.
The Grantee shall have the right under this easement over the above described
property to maintain a NO ACCESS EASEMENT and to enter upon said above described
property for the purpose of maintaining said easement.
