LIND, husband and wife, for and in consid- eration of One Dollar ($1.00) and other valuable considera- tion, the receipt of which is hereby acknowledged, do here- by convey and by these presents do hereby grant unto the TOWN OF ORO VALLEY, a municipal corporation of the State of Arizona, the two (2) perpetual easements hereinbelow set forth, which easements concern the following PARCEL OF LAND which is situate in Pima County, Arizona (herein called the "PARCEL OF LAND") : BEGINNING at the Southeast corner of Lot 11 of Oro Valley Estates as recorded in Book 13 of Maps and plats at Page 60 in the office of the Pima County Recorder, G. & S. R. B. & M. , Pima County, Arizona, thence S 0°11'20" E perpendicular to the South Section line of Section 14, T 12 S, R 13 E, a distance of 5.00 ft. , thence along a gdurve to the left having an initial tangent of S 89 48'40" W, thence along a curve to the left having a radius of 50.00 f t. and an angle of 133°34'41' a distance of 99.12 f t. to the South line of said Section 14 and the TRUE POINT OF BEGINNING, thence continuing with the curve having a radius of 50 f t. and an angle of 66°04'03" a distance of 57.65 f t. to a point on the North line of Lot 22 of Linda Vista Citrus Tracts No. 2 as recorded in Book 6 of Maps and Plats at Page 79 in the office of the Pima County Recorder, G. & S. R. B. & M. , Pima County, Arizona, G796 63 thence S 89°48'40"W along the North line of said Lot 22 a distance of 425.44 ft. more or less to the Quarter Section line, thence North along the Quarter Section line a distance of 30 ft. more or less to the North Quarter corner of Section 23, T 12 S, R 13 E, thence along the North line of Section 23 a distance of 379.61 ft. to the TRUE POINT OF BEGINNING. EASEMENT NUMBER ONE: EASEMENT NUMBER ONE covers all of the PARCEL OF LAND, and is given for the limited purpose of ratifying and con- firming the validity, as well as the location, of all exist- ing public utility services, lines and the like (whether above, below, under or on the surface of the PARCEL OF LAND) . EASEMENT NUMBER ONE does not authorize and shall not be used to expand or place new public utility services, lines and the like above, below, under or on the surface of the PARCEL OF LAND. However, public utility services, lines and the like which are above, below, under or on the surface of the PARCEL OF LAND on May 15, 1982 may be maintained, repaired or re- placed (with services, lines and the like of similar capa- city, character, kind and size -- which replacements shall be placed above, below, under or on the surface in the same fashion as that which presently exists and which is being replaced) under the authority herein granted -- and in doing any such maintenance, repairs or replacements, the public utility companies may go on or upon any part of the PARCEL OF LAND. It is also a condition of this Grant of Easements that once Grantors, or their successors in interest, have paid to the public utility companies to secure placement of the existing public utility services, lines and the like below 2. G79c rir; 640 or under the surface of the PARCEL OF LAND, such services, lines and the like must thereafter remain below or under the ground and may not be placed on or above the surface of the PARCEL OF LAND. EASEMENT NUMBER ONE is for public utility purposes only, and does not authorize use of the PARCEL OF LAND for any other purpose. EASEMENT NUMBER TWO: EASEMENT NUMBER TWO applies, covers and pertains only to the northerly ten (10) feet of the PARCEL OF LAND; no other part of the PARCEL OF LAND may be used under the authority of EASEMENT NUMBER TWO. EASEMENT NUMBER TWO is strictly limited (a) to instal- lation, maintenance, repair and replacement of public utility and cable television services, lines and the like (b) which are placed below or under the surface of the PARCEL OF LAND; such services, lines and the like may be new or additional services, lines and the like (that is, EASEMENT NUMBER TWO is not limited to the maintenance, repair and replacement of existing services, lines and the like) . THE TOWN OF ORO VALLEY, and its assigns and successors of record, shall have and hold EASEMENT NUMBER ONE and EASE- MENT NUMBER TWO forever. 1t` DATED this day of ay, 1982. // Dw4/117t L' d Barbara S.
