Dep ee; FORM 4.13 North COVENANT RUNNING WITH LAND AND NO ACCESS EASEMENT That __Atlas-Glenex, Ltd., an Arizona partnership • , owners of those • certain lands subject of Oro Valley Development Plan , for themselves, their successors, grantees and assigns herewith publishes and declares this instrument as and for a covenant running the land herein described for the purposes set forth herein and for the consideration of One Dollar ($1.00) and other valuable considerations do hereby grant to THE TOWN OF ORO VALLEY, PIMA COUNTY, C`•? CZ: ARIZONA, A Body Politic, a one (1.0) foot NO ACCESS EASEMENT and do place a restriction on the use and occupancy of the land abutting said easement described as follows: A part of Section 13, Township 12 South, Range 13 East, G. & S. R. B. & M., Pima County, Arizona; Commence at the East one-quarter (E1/4) corner of said Section 13; Thence North 00° 05' 27” East along the East line of said Section 13, a distance of 45.00 feet; Thence South 89° 54'.35" West, 843.36 feet to the POINT OF BEGINNING at the point of curvature of a tangent curve concave to the. Northeast; Thence Westerly and Northerly along the arc of said curve, to the right, having a radius of 25.00 feet and a central angle of 95° 29' 58" for an, arc distance of 41.67 feet to a point of compound curvature of a tangent curve concave to the East, being the East right-of-way line of Oracle Road; • Thence Northerly along the said East right-of-way line, along the arc of said curve, to the right, having a radius of 3,719.72 feet and a central angle of 06° 04' 59" for an arc distance of 394.93 feet of a point on a non- , tangent line; Thence North 89° 53' 47" East, 1.02 feet to a point on the arc of a non-tangent curve concave to the East, a radial line of said curve through said point having a bearing of North 78° 30' 16" West, being 1.00 foot East of and parallel with the said East right-of-way line; Thence Southerly along the said parallel line, along the arc of said curve, to the left, having a radius of 3,718.72 feet and a central angle of 06° 05' 11" for an arc distance of 395.02 feet to a point of compound curvature of a tangent curve concave to the Northeast; Thence Southerly and Easterly along the arc of said curve, to the left, having a radius of 24.00 feet and a central angle of 95° 29' 58" for an arc distance of 40.00 feet.to a point on a non-tangent line; Thence South 00° 05' 25" East along a radial extension of the last described curve a distance of 1.00 foot to the POINT OF BEGINNING. The Grantee shall have the right under this easement over the above described property to maintain a NO ACCESS EASEMENT and to enter upon said above described iroperty for the purpose of maintaining said easement. CONDITIONS: 1. That all grants, covenants and provisions herein shall be binding on and inure to the benefit of the heirs, successors and assigns of the parties hereto.
