PUBLIC NON -MOTORIZED TRAIL EASEMENT
This EASEMENT is granted this day of % , 2023, by and between
Steven Keppler and Kristi Halvorson Living Trust and of otherwise ("GRANTOR"), and the
Town of Oro Valley, a political subdivision of the State of Arizona, ("TOWN").
GRANTOR, for valuable consideration, herby grants unto TOWN, its successors and assigns,
a public non -motorized recreational trail easement (the "Easement") exclusively for public trails
access and the preservation of natural open space purposes on the property legally described
and depicted on the attached Exhibit A (the "Property").
TOWN and GRANTOR herby agree to the following conditions:
The Easement shall run with the Property and shall be binding upon Grantor's heirs,
successors, and assigns.
2. TOWN has the right to enforce its regulations within the Easement.
3. TOWN shall indemnify Grantor for any liability caused by public trail use.
4. TOWN, at its discretion, may make improvements to the trail and the structures or features
deemed necessary or desirable to ensure functionality, security, and aesthetics of the trail.
From time to time, the TOWN will maintain the trail easement for the use by the public.
This may entail vegetation trimming and path work and could necessitate the use of
motorized vehicles necessary for said work.
