Project improvements completed:
An additional 12-foot wide travel lane in each direction for a total of six travel lanes throughout the project area
10-foot wide shoulders allowing cyclists to use widened shoulders (7-foot wide with curb in Catalina)

Wildlife Crossings
Two wildlife crossing structures allow wildlife to migrate safely between the Santa Catalina and Tortolita mountains, without crossing the roadway at street level

Temporary signs in the right-of-way
Purpose
Current enforcement suspended
U.S. Supreme Court Ruling - Reed v. Town of Gilbert
Content neutral regardless of sign type

At a September 2015 council meeting we learned about the United States Supreme Court ruling, Reed vs. Town of Gilbert, that forever changed how we are to look at signs in the ROW. At
that Council meeting there was a vote to suspend sign code enforcement until we could work out the details.
The Supreme Court ruling tells us that we must look at signs in a content neutral manner. That means we can no longer look at the message on the sign to determine if a sign is allowed
or prohibited in the ROW. We can only focus on the design, size and location.
We have also learned that State Law will continue to allow certain signs in the ROW regardless of Town Zoning….. which includes political signs and sign walkers.

State Law Supersedes Zoning
The political signs are allowed in the ROW within a specific time frame associated with an election.
Also sign walkers are allowed in the ROW within certain parameters.
This preempts the Towns ability to substantially regulate either these sign types.

Looking at a sign in a content neutral manner means we can no longer regulate the specific message on the sign or who can place the sign in the right-of-way.
Each sign type currently in the code and shown on this slide, must now be allowed for virtually any message.

But now that we know we cannot regulate the message on the sign, we must determine how to move forward knowing that we must allow any message on the sign.
