WHEREAS, The Town of Oro Valley is a municipal corporation within the State of Arizona and is vested with all the rights, privileges and benefits and entitled to the immunities and exemptions granted to municipalities and political subdivisions under the Laws of the State of Arizona;and WHEREAS,The Town is developing a network of multi-use paths throughout the Town;and WHEREAS,the Town's paths are vigorously used;and WHEREAS, such a path is presently being planned along Big Wash, north of Tangerine Road; and WHEREAS,the continuity of this path will require that the path cross the Northwest Hospital, L.L.C.property adjacent to the east bank of the Wash;and WHEREAS, Northwest Hospital, L.L.C. is willing to grant the necessary Multi-Use Path Easement to the Town;and WHEREAS,the Town deems it necessary and in the best interests of the residents of the Town to accept the Multi-Use Path Easement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Oro Valley, Arizona, that the Town of Oro Valley, Arizona, will approve the granting of the Multi- Use Path Easement to the Town by Northwest Hospital,L.L.C.,attached hereto as Exhibit A. .�., BE IT FURTHER RESOLVED that the Mayor and any other administrative officials of the Town of Oro Valley are hereby authorized to take such steps as are necessary to execute and implement the terms of the Multi-Use Path Easement. Grantor is the owner of certain real property located in the Town of Oro Valley, Arizona, and more particularly described in Exhibit"A" attached hereto ("Grantor's Land"). Grantor hereby grants and conveys to Grantee, for the use and benefit of the public, an approximately ten foot (10') wide non-exclusive easement over, upon, and across approximately 8,007 square feet along the western boundary of a portion of the Grantor's Land, such easement being more particularly described in Exhibit"A" and designated as a multi-use path for the sole, exclusive, and limited purpose of recreational pedestrian and non-motorized usage by the public only. SUMMARY: The Town has been developing a series of multi-use paths at various locations throughout the Town. One of the planned paths travels along the east bank of Big Wash north of Tangerine Road. This easement would allow for continuity of that path across property belonging to Northwest Hospital, L.L.C. The documents have been reviewed and approved as to content by Department of Public Works staff. The documents have been reviewed and approved as to form by a representative of the Town's legal staff. ATTACHMENTS: Resolution (R)05- 43 ; Multi-Use Path Easement; Exhibit "A" Legal Description; Sketch Plan for Exhibit"A" FISCAL IMPACT: None. FACTORS FOR ADOPTION OF THIS ORDINANCE: Factors for this ordinance would include the need to achieve continuity of the Multi-Use Path along Big Wash. I FACTORS AGAINST ADOPTION OF THIS ORDINANCE: None. SUGGESTED MOTION: I move to adopt Resolution No. (R) 05- 43 , A Resolution of the Mayor and Council of the Town of Oro Valley, Arizona accepting a Multi-Use Path Easement over and across property belonging to Northwest Hospital, L.L.C.
