Meeting Date:05/18/2023   Submitted By:Yarina Hynd, Public Works SUBJECT: PRESENTATION AND DISCUSSION OF STORMWATER BILLING RECOMMENDATION: N/A EXECUTIVE SUMMARY: The previous Water and Stormwater Utility billing and customer account management software, Cubic, in use since 2008 by the Stormwater Utility was in need of update for compatibility with future operating system software updates. It was understood by both entities that the Cubic software was unable to be updated for capability and thusly a solicitation was put forth to select a new billing and customer account management software.  The new software, SpryPoint, was launched in August 2022 and the presentation will walk the commissioners and the public through the benefits of the new software and how the Stormwater Utility interacts with the software and our customers.   BACKGROUND OR DETAILED INFORMATION: Town of Oro Valley Stormwater Utility and Water Utility Billing and Customer Portal Software Update 2008  Oro Valley Water Utility added the Stormwater Utility Fee to the Town of Oro Valley Water accounts. Today there are approximately 20,000 Oro Valley Water Utility accounts that bill the Stormwater Fee. Stormwater Utility opened individual customer accounts to bill Town Of Oro Valley residents that have Tucson Water, Metro Water and Wells. Today we have approximately 1500 Stormwater Only accounts that we maintain. 2022  Oro Valley Water Utility and Stormwater Utility chose Sprypoint as the new billing software. Legacy accounts were migrated. This involved testing and auditing of accounts. August 29, 2022 - GO LIVE WITH SPRYPOINT SOFTWARE Sprypoint Products SpryCIS, SpryEngage, SpryMobile SpryCIS  Customer Accounts Invite to Customer Portal Payments Bill Delivery Statements Statements Collections Receivables Emails Support Tickets Billing Calendar SpryEngage  Self-Service Customer Portal Customer Support Tickets SpryMobile Town Code Article 15-24-13  Stormwater Utility Fee System 15-24-13-D. Establishment of Stormwater Utility Fund.  1. The Stormwater Management Plan is established to provide for the Town’s compliance with the AZPDES Phase II Municipal General Permit requirements and to provide the stormwater system necessary to convey stormwater, control flooding, and to protect the natural environment. The costs of complying with the AZPDES Phase II program and FEMA Regulations along with designing, developing, improving, operating, maintaining, and monitoring the stormwater system required in the Town should, therefore, be allocated, to the extent practicable, to all property owners based on their impact on the stormwater system. In order to provide revenue to fund those costs and to fairly allocate those costs, a Stormwater Utility Fund (the “fund”) is established. 2. All revenues collected from the Stormwater Utility fee, from grants, permit fees, penalties and other charges collected under this article, shall be deposited to the fund. The Town Council may make additional appropriations to the fund. All disbursements from the fund shall be for the purposes of the fund as set forth in subsection E of this section, and the fund shall be used for those purposes only.      15-24-13-E. Purposes of the Fund. The fund shall be used for the following purposes:  1. All costs of implementation and administration of the Stormwater Management Plan, including the establishment of reasonable operating and capital reserves to meet unanticipated or emergency stormwater management requirements. There shall be a reserve fund of fifteen percent (15%) of the collected annual stormwater fees as specified under Section 15-24-10 of this code. 2. Inspection and enforcement activities. 3. Billing and administrative costs. 4. Other activities that are reasonably required to accomplish the mission of the Stormwater Management Plan.   15-24-13-F. Stormwater Utility Fee. A monthly service charge is imposed upon all real property in the Town, as of the first day of each month, beginning January 1, 2008, to fund the Stormwater Management Plan and stormwater system with invoicing as defined in subsection J  of this section. This service charge shall be known as the Stormwater Utility fee (“fee”). As any real property is developed or developed real property is annexed into the Town it will be subject to the fee. The fee is based on the cost of implementing a stormwater management program. 15-24-13-H. Base Rate. 1. The Town Council shall, by resolution, establish the annual (fiscal year) monthly base rate for the Stormwater Utility fee. The base rate shall be calculated to ensure adequate revenues to fund the costs of stormwater management and to provide for the operation, maintenance, and capital improvements of the stormwater system in the Town.  15-24-13-J. Billing.  15-24-13-J. Billing.  1. Each property served by the Oro Valley Water Utility shall be billed monthly for the Stormwater Utility fee. Properties not served by the Oro Valley Water Utility shall be billed quarterly. The bill may be part of the Oro Valley Water Utility bill, a separate billing, or some other reasonable mechanism. 2. Service charges shall begin January 1, 2008, with invoicing at the end of the month or quarter, as appropriate. ERU's 15-24-13-C-3. “Equivalent residential unit (ERU)” means approximate average amount of impervious area associated with single-family residential property in the Town.  Parcels 15-24-13-C-8. “Fee” or “Stormwater Utility fee” means the charge established under this section and levied on owners of parcels or pieces of real property to fund the costs of stormwater management, implementation of the Stormwater Management Plan together with constructing, operating, maintaining, repairing, and improving the stormwater system in the Town. Meeting Date:05/18/2023   Submitted By:Yarina Hynd, Public Works SUBJECT: DISCUSSION OF 2022/2023 TOWN OF ORO VALLEY MS4 COMPLIANCE SCHEDULE, THIRD QUARTER REPORT RECOMMENDATION: This report is for informational purposes only. EXECUTIVE SUMMARY: The Town of Oro Valley's (Town) Stormwater Management Program and Annual Report to ADEQ identify Minimum Control Measures (MCM’s) used to manage and control quality of stormwater runoff from the MS4. Each MCM has been given specific implementation dates and frequencies, measurable goals, and responsible departments. This memorandum is a report on the Town’s Stormwater Management Program for the third quarter of the Annual Reporting Period for 2022-2023 (July 1st through June 30th). It has been prepared to keep stakeholders informed of the status of project implementation in terms of completed tasks that are either (A) ongoing or continuous, or (B) to be done a minimum of once each year. Accompanying this Memorandum is a summary Table listing each of the six (6) required MCM’s along with their specific subset of Best Management Practices (BMP’s). This summary Table shows that the Stormwater Utility is on track to meet all required tasks for the current reporting period  BACKGROUND OR DETAILED INFORMATION: The Town manages stormwater quality in accordance with the Arizona Pollutant Discharge Elimination System (AZPDES) Permit AZG2020-001 that authorizes the discharge of stormwater from the municipal separate storm sewer system (MS4) to receiving waters, including Waters of the United States (WOTUS). The MS4 generally consists of roads, storm drains, and infrastructure carrying runoff into drainage ways or ephemeral stream channels. The Town has a Stormwater Management Program (SWMP) that describes the control measures it uses to manage the quality of discharges from the MS4. These Best Management Practices (BMPs) are: MCM-1. Public Education and Outreach MCM-2. Public Participation and Involvement MCM-3. Illicit Discharge Detection and Elimination MCM-4. Construction Site Runoff Control MCM-5. Post-Construction Runoff Control MCM-6. Pollution Prevention/Good Housekeeping for Municipal Operations The Town’s Stormwater Management Program describes specific practices it uses to achieve compliance with Part 6.4 of the AZPDES Permit related to Minimum Control Measures, including specific implementation dates and frequencies, measurable goals, and responsible departments. Our staff keeps track of these thirty-three (33) targeted responsibilities, and has prepared the attached summary table showing project implementation in terms of completed tasks that are either (A) ongoing or continuous, or (B) to be done a minimum of once each year. This attached summary Table shows that the Stormwater Utility is fully up to date, and has met this quarter’s goals for implementing BMP’s that are ongoing and continuous The next scheduled update will be prepared and distributed sometime after the 4th quarter ends on June 30th, 2023.
