Special Warranty Deed
For consideration of one dollar and the mutual benefit of the Grantor and Grantee, KB
Home Tucson Inc. ("Grantor") does hereby convey and dedicate to the Town of Oro
Valley ("Grantee") for a right-of-way all right, title and interest of the Grantor in that
certain real property located in Pima County, Arizona described as follows:
All water infrastructure, mains and appurtenances located within the property as
described by plat of Countryside Manor as recorded in the Pima County Recorder's
Office at Book 61, Pages 34-1 and 34-2 and further described by the Town of Oro Valley
Water Utility Plan Number Parcels 221-11-1300 and 221-11-1320 and attached hereto as
Exhibit "A" and incorporated by this reference; and further described in the Pima County
Department of Environmental Quality "Approval to Construct", P.O. Number 79505 and
attached hereto as Exhibit "B" and incorporated herein by this reference. Said water
infrastructure as described herein has the value of One Hundred and Thirty Two
Thousand Nine Hundred and Thirty Three Dollars ($132,933) as described in Exhibit "C"
and incorporated herein by this reference.
This conveyance is subject only to taxes, assessments, patent reservations, covenants,
conditions, restrictions, servitudes, easements, encumbrances, liens, liabilities,
declarations, restrictions imposed by governmental entities, and any other matter of
record or any matter which an accurate survey or physical inspection would reveal. ;1i�
Grantor warrants title only as to the acts of Grantor. ;r
Exempt from Affidavit of Value pursuant to A.R.S. Section 11-1134(A)(3). �

Approval to construct the above, described facilities as represented in the approved plan on file with the Pima
County Department of Environmental Quality is hereby given subject to the following provisions:
AFTER COMPLETION OF CONSTRUCTION,A PROFESSIONAL ENGINEER, REGISTERED IN
THE STATE OF ARIZONA SHALL COMPLETE A FINAL INSPECTION AND SUBMIT AN
ENGINEER'S CERTIFICATE OF COMPLETION,ACCURATE"AS BUILT"PLANS,PRESSURE
TEST RESULTS, CHLORINATION RESULTS AND MICROBIOLOGICAL TESTING RESULTS
TO PIMA COUNTY DEPARTMENT OF ENVIRONMENTAL QUALITY IN ORDER TO OBTAIN AN
APPROVAL OF CONSTRUCTION. THOSE PLANS MUST BE CLEAR BLUELINE PRINTS
SUITABLE FOR MICROFILMING AND SHALL CLEARLY AND ADEQUATELY REPRESENT
THE FACILITIES AS THEY ARE CONSTRUCTED.
The State law,A.R.S. 49-353, requires that construction of the project must be in accordance with the rules and
regulations of the Arizona Department of Environmental Quality.

If construction has not started within one year of the date of this issue, this certificate will be void and a written
