A.R.S. Sec. 11-1134.A.3.
SPECIAL WARRANTY DEED
TO TOWN FOR RIGHT OF WAY
The undersigned, INCA Capital Fund 23, LLC, an Arizona limited liability company,
as Grantor, in consideration of One Dollar paid by the Town of Oro Valley, as Grantee, in the
County of Pima, State of Arizona, receipt of which is hereby acknowledged, and in further
consideration of the roadway expansion does hereby release, sell and convey, forever quitclaim
unto the Town of Oro Valley all of the undersigned's right, title and interest in and to that
certain real property described on Exhibit A attached hereto and made a part hereof,to have and
to hold the same, together with all the privileges and appurtenances thereunto belonging to the
Town of Oro Valley forever.
Being a portion of the same property conveyed to the Grantor by deed dated June 30,
2003 recorded on July 1, 2003 at Docket 12083, Page 1932.
Subject to current taxes and assessments, reservations in patents, and all easements,
rights-of-way, encumbrances, liens, covenants, conditions, restrictions, obligations, and
liabilities as may appear of record and any matters as may be disclosed by an accurate survey of
the Property.
Grantor hereby binds itself and its successors and assigns to warrant and forever defend
the title to the Property against all acts of Grantor herein and no other.

66 in the Records of Pima County, Arizona and lying in the Southeast Quarter of the
Northeast Quarter of Section 3, Township 12 South, Range 13 East, Gila and Salt River Base
and Meridian, Pima County, Arizona, described as follows:
BEGINNING at a point on the South Line of said Verde Ranch, from which the East Quarter
Corner of said Section 3 bears North 89 degrees 28 minutes 26 seconds East, a distance of
1240,72 feet;
THENCE South 89 degrees 28 minutes 26 seconds West, upon said South Line, a distance
of 80.30 feet to the Southwest Corner of said Verde Ranch;
