(R)04- 18 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, VACATING A PORTION OF THE CALLE ALMENDRA RIGHT-OF-WAY. WHEREAS, the Town of Oro Valley is a political subdivision of the State of Arizona, and pursuant to Article 13, Section 7 of the Arizona Constitution, is vested with all rights, privileges, benefits and is entitled to the immunities and exemptions granted municipalities and political subdivisions under the Constitution and laws of the State of Arizona and the United States; and WHEREAS, the Town of Oro Valley has the authority to vacate dedicated rights-of-way pursuant to Section 7-7 of the Oro Valley Town Code; and WHEREAS, portions of the Calle Almendra right-of-way have been previously dedicated to the Town by process of annexation from Pima County; and WHEREAS, the dedicated right-of-way is not needed for public use; and WHEREAS, no land adjoining said dedicated right-of-way would be left without access to a public street; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Town of Oro Valley, Arizona, to approve the vacation of a portion of the Calle Almendra right-of-way as described in Attachment 1, to the adjacent property owners.
