According to the construction plans the sewer is 10 feet west of the west property line of Sunnyslope Townhouses. We would require an easement over the easterly twenty feet of the fifty foot wide parcel being vacated. I have no information on how the property was acquired by the Town of Oro Valley. If the fifty foot wide parcel was a part of the ADOT right-of-way, easement rights should have been maintained when the right-of-way was abandoned. I would recommend that a twenty foot wide easement be granted specifically centered over the existing sewer alignment so that it will be clear in the future.
