(R)97- 61 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, VACATING A PORTION OF THE CALLE ALMENDRA RIGHT-OF-WAY WHEREAS, the Town of Oro Valley has the authority to vacate dedicated rights-of-way pursuant to Section 7-7 of the Oro Valley Town Code; and WHEREAS, portions of the Calle Almendra right-of-way have been previously dedicated to the Town through the platting process for Linda Vista Citrus Tracts and Linda Vista Citrus Tract No. 2; and WHEREAS, the dedicated road is unimproved and is not needed for public use; and WHEREAS, no land adjoining said dedicated road would be left without access to a public street; THEREFORE, BE IT RESOLVED, BY THE MAYOR AND THE TOWN COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA, to approve the vacation of Calle Almendra as described in exhibit A, to Robert E. and Barbara A. Tschanz SUMMARY: Mr. & Mrs. Tschanz desire to acquire the Calle Almendra right-of-way for the purpose of constructing a driveway to access their property at lot 4 of Linda Vista Citrus Tracts. The asphalt driveway would be twelve foot in width, with a minimum four foot of clearing on one side, or two feet on either side. The right-of-way was dedicated to Pima County with the acceptance of the Linda Vista Citrus Tract plat, and was acquired by the Town of Oro Valley when the property was annexed. The right-of-way is presently unimproved natural desert. None of the other adjacent lots rely on this right-of-way for access. Lot 3 has been developed as Desert Sky Club and has access from Desert Sky Road from the north. Lot 9 has been split into east and west portions both with access from Linda Vista Boulevard. A license agreement was approved by the Town Council on April 16, 1997 to install an asphalt driveway within the existing right-of-way. The driveway would have a total pavement width of 14 feet with 8 foot graded shoulders on each side. The drive would also require a "V" ditch for drainage, an emergency turnaround, and at least 2 "No Parking" signs. The agreement also stated that a grading plan and permit application would need to be submitted for review and approval of the Department of Public Works. By acquiring the vacated property, the Tschanz's would be able to utilize a more normal driveway section. Upon vacation, the right-of-way would be split among the adjacent property owners. The Tschanz's have made arrangements to acquire the parcel from the other adjacent property owners. An utility easement would be required as a part of the vacation to serve existing and future utilities. MDWID has no objection to the proposed abandonment. However,MDWID has an existing 6"water line in Calle Almendra and therefore will require that a 15' public water easement be dedicated for perpetual maintenance. The easement should be written to encompass the entire length of the right-of-way to be abandoned. Any future improvements within the easement must be approved by MDWID prior to construction.
