Ms. Araiza has asked me to respond directly to your letter of September 19, 1991 regarding "Mutterer's Ditch." The Assessor's office has no problem with the acquisition of the drainage way by the Town of Oro Valley. As I understand it, there is to be a dedication. The lien for delinquent taxes will be extinguished upon acquisition of the parcel by the Town. Therefore, I suggest that you obtain a deed to the property from Mrs. Mutterer and present it to Ms. Araiza, who will assist you with the adjustment of the tax records. North Deputy County Attorney /pw cc: Ms. Delma Araiza • TOWN OF ORO VAL EY COUNCIL COMMUNICATION MEETING DATE: December 4, 1991 TO: HONORABLE MAYOR AND COUNCIL FROM: James E. Riley - Acting Town Engineer SUBJECT: MUITERERIS WASH SUMMARY: The Oro Valley Tamhouse Homeowner's Association has requested that the Town maintain an existing drainageway adjacent to their development. A comprehensive title search confirmed that due to an oversight, ownership of this parcel has never been transferred to the Association and was still held by the former developer. No one was accepting aanership or maintenance of this drainageway. The Town has permitted upstream drainage from Valle del Oro Townhomes and the Colony to flaw through this drainageway to the Canada del Oro. The ownership of this property needs to be resolved to permit the Town to manage the maintenance of this drainageway. Additionally due to the confusion aver ownership back taxes have accrued on this property. Considering all of the above this office recommends that the Town acquire this property provided that legal dedication is offered and that the back taxes are resolved. Two Deeds have been prepared; one from the former developers family, and one from the Homeowners Association to preclude any unforseen claim of ownership. Additionally, we have enclosed a letter from Pima County indicating that back taxes will be forgiven should the property revert to public ownership. SUGGESTED MOTION: That the Mayor and Council accept both Deeds on behalf of the Town of Oro Valley, direct staff to have the Deeds recorded, and instruct the Town Engineer to include subject drainageway in their maintenance program and schedule.
