A RESOLUTION BY THE MAYOR AND COUNCIL OF THE TOWN OF
ORO VALLEY, ARIZONA, AUTHORIZING AND DIRECTING THE
MAYOR TO SIGN A QUIT CLAIM DEED OF EASEMENT, ALONG WITH
EXHIBITS 1 AND 2, TO PIMA COUNTY, ARIZONA, A BODY
POLITIC, WHICH INCLUDES THE MAIN CHANNEL OF THE CANADA
DEL ORO WASH AS WELL AS THE FLOODPLAIN AREA TO THE SOUTH
OF THE CHANNEL, AND DECLARING AN EMERGENCY
WHEREAS, the Town of Oro Valley recognizes that Pima County has
primary responsibility for flood control in the Canada del Oro Wash, and
WHEREAS, the Town of Oro Valley recently annexed a new section of
the Town which lies across the wash, and;
WHEREAS, there may be questions concerning the County's right to
operate within the bounds of the Zbwn of Oro Valley,
NCW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
ORO VALLEY, ARIZONA:
Section 1: The Town of Oro Valley recognizes the necessity for
Pima County to maintain and control the course of the Canada del Oro
Wash, and that in order to facilitate such operations, the Mayor of the
Town of Oro Valley, Arizona is authorized and hereby directed to sign a
Quit Claim Deed of Easement to Pima County, Arizona, a body politic.
Section 2: WHEREAS, it is necessary for the preservation of the
peace, health, and safety of the 'It n of Oro Valley, Arizona, an emergency
is declared to exist, and this resolution shall be effective immediately
upon its passage and adoption.
PASSED AND ADOPTED by the Mayor and Council of the 'Dawn of Oro Valley,
Arizona, this 12th day of January, 1984.
APPROVED this 12th day of January, 1984 by the affirmative vote of
three-fourths of the members of the Town Council of the Tuan of Oro Valley,
Arizona.

RE : Quit-Claim Deed to CDO Wash
DATE: December 22 , 1983
Charles H. Huckelberry through Thomas C. Jay, the Senior
Real Property Agent for Pima County, has submitted the attached
Quit-Claim Deed of Easement to the Town for your action.
Dooley-Jones has reviewed the legal description and
plotted the contained area. This is shown on the attached draw-
ing marked Exhibit 1 .
In order to present a clear picture of the area of the
easement , an overlay drawing of the recently annexed area to-
gether with an outline of the easement is attached as Exhibit
2 . The easement area includes the main channel as well as the
floodplain area to the south of the channel .
This agreement was prepared as a result of the meeting
held by Mr. Huckelberry and his people together with Mayor
Engle , Councilman Kriegh and myself. I see no problem with it
and urge the Council to pass a resolution directing the Mayor
to sign the Deed.
