WHEREAS, the Town of Oro Valley entered into an agreement on April 9, 1984, whereby the Town would abandon a portion of North First Avenue to the adjoining landowners as part of a development plan for the subdivision known as Cancha del Golf; and WHEREAS, a portion of the North First Av�nue to be abandoned is adjacent property owned by the Rooney Family and this portion of North First „Avenue was in Pima County and not in the Town of Oro Valley on April 9, 1984 ; and � WHEREAS , this portion of North First Avenue, as described in Exhibit "A" , Parcels III, IV, V and VI, attached hereto is now within the Town of Oro Valley; and WHEREAS, the Canada del Oro Partners through their manager has petitioned the Town, in Exhibit "B" , to abandon said portion of North First Avenue; and � � �WHEREAS, sucY� abandonment is .permitted pursuant to ARS Section 28-1902 ; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ORO VALLEY, ARIZONA: Section 1. SUMMARY: . � , In 1984, the Rooney family entered into and a reement with Pima Cotlnt � _ whereby the Rooneys would dedicate 76.79 acres to PIma County for� the CDO Flood Control Project and the realignment of North First Avenue. As part of the agreement, Pima County was to deed to the Rooneys, �he ha l f rig�it-o f-way o f old First Avenue ad 'acent to the ir ro ert 1 ' � . � p p y lne. This was never done and the property now lies within the Town -�f Oro Valley. � . The Rooney Family has petitioned to Town Council askin that the Town vacate the ' • • g- � right-of-way and, at the same tlme, deed lt to the CANADA DEL �RO PARTNERS, the Rooney Family partnershipo DISCUSSION: A ma is attached showin the ' • .p g portlons to be vacated and deeded. Thls sub�ect was be f ore the Town in Apri 1 o f 19 8 6 when the Town did abandon ��e other half right-of-way and vested it in the owners of the ro ert � p Y adjacent to the roadway (Cancha del Golf� [see Resolution No. 247 and 248a] . Abandonment of the remaining half of the roadway is what is before, you at this meeting. The Town Engineer's Of f ice has r�o ob�ectior� to the abandor�ment. The utility companies, as- per tY�e copies of the attached letter, have no objection to t�e abandonment.
