INSTRUCTIONS TO SPEAKERS
Members of the public have the right to speak during any posted public hearing. However, those items not
listed as a public hearing are for consideration and action by the Commission during the course of their
business meeting. Members of the public may be allowed to speak on these topics at the discretion of the
Chair.
In accordance with Amendment #2 of the Mayoral Proclamation of Emergency issued on March 27, 2020, the
following restrictions have been placed on all public meetings until further notice:
1. In-person attendance by members of the public is prohibited.
2. Members of the public can either watch or listen to the public meeting online
https://www.orovalleyaz.gov/town/departments/town-clerk/meetings-and-agendas or, if they would like to
participate in the meeting (e.g. speak at Call to Audience or speak on a Regular Agenda item), they can attend the

The Stormwater Utility Commission Meeting was held electronically via Zoom. Commissioner Hawkinson
attended by telephone.
CALL TO AUDIENCE
Stormwater Division Manager John Spiker provided instructions regarding conduct and participation in the Zoom
meeting.
Chair Cuffari noted there were members of the audience in attendance, however, there were no speaker requests
or raised hands during the Call to Audience.
COUNCIL LIAISON COMMENTS (INFORMATIONAL ONLY)
Council Liaison Bill Rodman provided an update on the status of the Town budget and reported that the FY 20/21
Budget was passed.
DIRECTORS REPORT (INFORMATIONAL ONLY)
Mr. Spiker reported that there are two seats on the Stormwater Utility Commission Board that are opened to be
filled. We will be pursuing the filling of those seats in September.

2.DISCUSSION OF MEETINGS AND EVENTS
Mr. Spiker reported on Stormwater meetings and events.
3.DISCUSSION OF BIGHORN FIRE AND IMPACTS
Mr. Spiker reported on the impacts of the Bighorn Fire and that at this time there are approximately
119,500 acres burned, that is the largest forest fire in Pima County history, and it is about 90% contained.
It is believed that the upcoming monsoon season will bring 100% containment. We will then move on to
the next phase of potential flooding. Mr. Spiker reported on the efforts by the Town and Pima
County regarding outreach to residents, maintenance and post fire hazard mitigation mapping.
4.DISCUSSION OF THE PIMA COUNTY FLOOD CONTROL DISTRICT AND TOWN OF ORO VALLEY
RESTUDY OF THE NORTH RANCH WASH
Senior Stormwater Engineer Justin Turner reported on the restudy of North Ranch Wash.
5.DISCUSSION OF THE FALL 2020 STORMWATER UTILITY COMMISSION FIELD TRIP
Discussion ensued regarding the potential date for the October field trip and the availability of the
commissioners for attendance. The question was raised about our ability to maintain social distancing
during the trip if those rules are still in place.

DISCUSSION OF BIGHORN FIRE AND IMPACTS
RECOMMENDATION:

EXECUTIVE SUMMARY:
The Bighorn Fire has presented the Town of Oro Valley with an increased threat of flooding. Coordination with
Federal, State, and local agencies is ongoing in response to the fire and the post fire flood potential.
BACKGROUND OR DETAILED INFORMATION:
On June 5, 2020 lightning struck above Pusch Ridge in the Santa Catalina Mountains causing what would become
the largest forest fire in Pima County history. As of July 8, 2020 the Bighorn Fire has burned roughly 119,000 acres
across the entire mountain range. Pima, Pinal, and Cochise Counties all have watersheds that have become
affected by the fire. The Town of Oro Valley has joined with these Counties and our Federal, State, and other local
municipalities in a coordinated effort to address the fire response and post fire flooding potential.
The Town of Oro Valley has been proactive in outreach efforts to notify our residents of the potential flood hazard
associated with the fire asking folks to know their protect themselves and their property or business. Staff has
encouraged area residents to know their flood hazards near their homes and directing them to the National Flood
Insurance Program. In addition, the Town as encouraged folks to sign up for Pima County's ALERT System, where
available, to get near real time updates on rainfall and stream gauge data as rainfall comes off of the mountain. The
National Weather Service has also published a Bighorn Fire Burn Scar Flash Flood Briefing to provide specific
weather patterns associated with the fire. A new release published on June 19, 2020 outlines steps the public could
take to help themselves prepare

Coordination with Pima County Regional Flood Control District (PCRFCD) and the Arizona Department of
Transportation for maintenance activities along the Canada Del Oro and Rooney Washes has transpired in
preparation for potential flooding.
The Pima County Regional Flood Control District has also contracted with a consulting firm to perform post fire
hydrology and hydraulic models for the mountain to assess potential flood threats and identify areas of concern.
Coordination with PCRFCD is ongoing on this effort.

DISCUSSION OF ANNUAL STORMWATER UTILITY RATE ANALYSIS AND APPROVAL OF A NO RATE
ADJUSTMENT SCENARIO RECOMMENDATION TO MAYOR AND COUNCIL
RECOMMENDATION:
Staff recommends approval of a no rate adjustment scenario.
EXECUTIVE SUMMARY:
Town Code 15-24-13 Section H says the Stormwater Utility Commission shall annually review the Stormwater
Utility revenue requirements and recommend to the Town Council rate adjustments as necessary. Staff
reviewed ongoing Stormwater Utility revenue and expenditures, and have determined that the current rate of
$4.50/ERU will be sufficient for FY 20/21 to cover the costs of stormwater management and to provide for the
operation, maintenance, and capital improvements of the stormwater system in the Town. Staff is recommending
that the current Stormwater Utility Fee of $4.50 remain unchanged.

FISCAL IMPACT:
There is no fiscal impact associated with adopting a no rate increase scenario for the Stormwater Utility.
The current rate provides the necessary revenue and resources to meet the code mandates placed on the Town
by both the federal (EPA) and state (ADEQ) jurisdictional authorities. The current rate is budgeted in this current
fiscal year and assumed as the base rate in future fiscal scenarios as represented on the 5-year forecast attached.
SUGGESTED MOTION:
I MOVE to (approve or deny) a recommendation to Mayor and Council to support a status quo base rate for the
Stormwater Utility for the upcoming fiscal year 2020-2021.

Stormwater Utility Rate Analysis
The Town Code 15-24-13 Section H clearly states the
following as guidelines for the Base Rate for the Stormwater
Utility;
1.The Town Council shall, by resolution, establish the
annual (fiscal year) monthly base rate for the
Stormwater Utility fee. The base rate shall be calculated
to ensure adequate revenues to fund the costs of
stormwater management and to provide for the
operation, maintenance, and capital improvements of
the stormwater system in the Town.
2.The Stormwater Utility Commission shall annually
review the Stormwater Utility revenue requirements
and recommend to the Town Council rate adjustments
as necessary.

DISCUSSION OF ARIZONA DEPARTMENT OF WATER RESOURCES (ADWR) COMMUNITY ASSISTANCE
VISIT AUDIT

EXECUTIVE SUMMARY:
On July 17th, the Arizona Department of Water Resources (ADWR) conducted a telephone interview with
Stormwater Utility staff as part of a Community Assistance Contact (CAC). These consultations are typically
scheduled once every five years.
The purposes of the CAC were twofold. First it was to maintain an ongoing working relationship with the Town, and
second, it was to discuss the Town’s floodplain management program and to offer any assistance, if necessary.
The CAC is one of the key methods ADWR uses to identify community floodplain management program
deficiencies and violations and to provide technical assistance to resolve these issues.
Before this year's CAC, staff from the Stormwater Utility completed a questionnaire in which we were asked
to identify (1) key floodplain administrators, their staff, and years of service; (2) the location of where to find copies
of the Town's Floodplain Management Ordinance and FEMA Flood Insurance Studies and Flood Insurance Rate
Maps; (3) describe recent flood damage to properties located both inside and outside of FEMA Special Flood
Hazard Areas; (4) mitigation activities resulting in reduced flood losses (our successes); (5) a description of the
development or permitting review process that helps assure new development activities meet the minimum
floodplain management requirements in 44 CFR 60.3(d); and (6) a description of the Town's record keeping
procedures.
This year's Community Assistance Contact lasted roughly three hours, during which we were given ample time to
fully describe the Town's floodplain management program, including standard administrative procedures and
specialized GIS capabilities. Time was also spent reviewing the Town's 2017 Floodplain Management Ordinance,
including those areas where it differed from the state's Floodplain Management Model Ordinance. The CAC ended
with no programmatic deficiencies identified. The written follow up was a brief email, and consisted of an annotated
copy of the Town's Floodplain Management Ordinance identifying specific areas where changes were
recommended in order to provide better clarity and conformity. Staff are reviewing the recommended changes, and
will plan on making these revisions should the Ordinance need to go to Town Council.

DISCUSSION OF TOWN OF ORO VALLEY'S 2020 MS4 ANNUAL REPORT AND DISCHARGE MONITORING
REPORT
RECOMMENDATION:
This status report is for informational purposes only.
EXECUTIVE SUMMARY:
Each year, the Town of Oro Valley must submit an annual report to the Arizona Department of Environmental
Quality (ADEQ) describing the progress and success of the Town’s stormwater management program, including
an assessment of the effectiveness of stormwater management practices in reducing the discharge of pollutants
to, and from, the municipal separate storm sewer system.
The Town’s 2019-2020 Annual Report will be submitted to ADEQ on, or before, September 30, 2020, and it
shows that Oro Valley’s MS4 program is in substantial compliance with ADEQ permit number AZG2016-002.
BACKGROUND OR DETAILED INFORMATION:
The Town’s 2019-2020 Annual Report briefly identifies its success in completing all six minimum control
measures (MCMs) as follows:
(1) Public Education and Outreach
(2) Public Involvement/Participation
(3) Illicit Discharge Detection and Elimination
(4) Construction Site Stormwater Runoff Control
(5) Post-Construction Stormwater Management
(6) Pollution Prevention/Good Housekeeping for Municipal Operations.
Information in this year’s MS4 Annual Report is paperless, and will be submitted to the myDEQ web portal using
a new digital-reporting format. In addition to going paperless, this year ADEQ also asks MS4 permittees to
provide new information about their stormwater plan, and that this new information be submitted in an updated
Notice of Intent (NOI) with specific Best Management Practices (BMP’s) and measurable goals unique to the Town
of Oro Valley.
This year's Annual Report shows that the Town’s MS4 program is in substantial compliance with the permit.
This report will be submitted to the state by September 30, and in the meantime, Commissioners are welcome to
review a draft copy.

For the purposes of investigation and asset management, the Town of Oro Valley has mapped both
municipal and private stormwater infrastructure into the GIS/Cartegraph database. This process assists
the Town with investigation of illicit discharges, as well as potential flood control solutions. The Town of
Oro Valley stormwater sewer system at the time of this report, is complete to the maximum extent
practicable. This mapping process is an ongoing and continuous process due in large part to two factors
which preclude 100 percent completion of this mapping in any given year. Through the new
development and re-development process as well as the Town of Oro Valley asset inspection process,
new assets are being created, discovered and ultimately mapped into the stormwater GIS/Cartegraph
database throughout each year. Currently the Town of Oro Valley stormwater infrastructure inventory
includes 1710 inlets, 522 culverts, 1116 conveyance pipes, 1020 channels, and 222 detention basins.
This asset inventory increased by 236 assets mapped into the GIS/Cartegraph database during fiscal
year 19/20.

The Stormwater portion of the Town of Oro Valley webpage was completely revamped in fiscal year
2019/2020. This new content and formatting brought a large increase in traffic during the most recent
fiscal year as the Town of Oro Valley continues to reach out and foster a relationship with the public
during these unprecedented times. The website has been the main driver of public outreach during this
period in which traditional face to face public outreach has become impossible. The web page saw
2,571 site views in fiscal year 2018/2019 and 5,686 views in 2019/2020. This represents a 121%
increase in traffic from the previous fiscal year and has played a large role in helping the Town of Oro
Valley continue the public outreach necessary in informing the public.

On June 12, 2020 the Town of Oro Valley mailed a brochure specifically geared toward the commercial
construction business sector. This brochure is specifically geared toward proper ingress/egress track out
BMPs and washout activities of concrete, paint, stucco and other chemicals associated with the
construction process. The headquarters of 17 construction companies throughout the Tucson metro area
received this brochure. During fiscal year 2019/2020, the Town of Oro Valley received no reports of any
illicit discharges associated with this business type.

The Town is committed to making itself available for participation at school events each year. During
fiscal year 2019/2020 the Town of Oro Valley Stormwater Utility participated in the Wilson K-8
elementary school STEM Fair on January 22, 2020. With an annual enrollment of 1100 students and a
large number of those students actively participating in the STEM Fair each year the potential for
impressing on these students, the importance of pollution prevention and stormwater quality, is made
evident by the meticulous attention to detail by school faculty and high volume of participation by the
students. During this event 122 people received brochures and watched our demonstration on the
relationship between human activities and water quality.

The goal with this program is to create environmental stewardship and public participation through
volunteer opportunities. During the pandemic affected fiscal year 2019/2020, 68 volunteer cleanups were
still able to take place via our Adopt-A-Programs. This number is only twelve shy of the previous years
total and truly reflects an actively involved public even during these difficult times.

Public participation in Oro Valley is fostered through the 5 member volunteer Stormwater Utility
Commission (SWUC), volunteer cleanup efforts throughout Town via our Adopt-a programs, and
conduits through which the public can interact with Stormwater Utility Staff and make comments and

Currently the Town of Oro Valley conducts wet weather outfall monitoring at 5 locations within the Town.
3 locations that are Town owned municipal outfalls and 2 locations (screening points) chosen for their
close proximity to large commercial complexes. These 2 locations take a significant portion of the
drainage from these complexes. The locations of these 2 screening points allow the Town to quickly
assess the stormwater quality of these 2 areas as it outfalls into the Canada Del Oro Wash. The other 3
outfall locations also outfall to the Canada Del Oro Wash and were chosen either based on their close
proximity to commercial development or high density residential development. The Town conducted 4
wet weather monitoring sessions at each of these locations during fiscal year 2019/2020 and the water
was clear and free of pollutants and odors during each of the monitoring sessions.

good housekeeping at all municipal operations areas. These areas are inspected annually. Any
deficiencies are noted and corrected. Housekeeping policies are reviewed annually and updated as
needed. During fiscal year 2019/2020 the Town operated 2 facilities under site specific Operation and
Maintenance Plans (O&M plans) for both Town owned operations facilities. Applicable Town staff receive
annual training on illicit discharge prevention at municipal facilities. Town policy dictates that all major
streets are swept quarterly while all public residential streets are swept bi-annually. These are the
practices by which the Town of Oro Valley ensures good housekeeping and pollution prevention at all

DISCUSSION OF CARMACK WASH REMAPPING

EXECUTIVE SUMMARY:
In 2017, the Pima County Regional Flood Control District (District) finished hydrologic modeling and floodplain
mapping for the Carmack Wash and tributaries (Technical Data Notebook, [Draft] October 12, 2017). This earlier
study examined most of Carmack Wash, starting downstream at its confluence with CDO Wash near Interstate 10,
and continued upstream until Linda Vista Boulevard. Analyses were made using HEC-HMS for hydrology and
HEC-RAS and FLO-2D for floodplain mapping. Upon completion of the 2017 study, the Town requested that the
District continue the investigation, and this time focusing the mapping effort on the six major tributaries to Carmack
Wash located within the Town, especially those located in areas comprised of pre-FIRM homes (i.e., those built
before December 1974).
The updated 2020 study is nearly finished. This new study focuses on the watershed areas within the Town, and
more or less from Hardy Road on the south, Calle Buena Vista on the west, Linda Vista Boulevard/ Valle Del Oro
on the north, and the boundary with Coronado National Forest on the east. Computer models and floodplain maps
were received by the Town in early May, and the draft Technical Data Notebook (TDN) was received in late July.
Review comments were returned, and a final copy of the computer models, TDN and work maps are expected to be
received by mid- to late-September 2020.
In addition to receiving HEC-HMS and FLO-2D models of the study area, work products included a detailed
floodplain map (with north and south halves) at a scale of 1”=300’ and it showed the FLO-2D depths, floodplain
boundaries, and calculated 100-year discharges at the recording cross sections. The 100-year discharges were
calculated at numerous locations within the study area, and summarized in the report. Computed discharged were
favorably compared with those calculated using USGS Regional Regression Equation 5, as well as those reported
in the District's earlier 2017 report. Regulatory floodplain limits (i.e., those with 100-year peak discharges larger
than 50 cfs) were delineated for the main stem of Carmack Wash, and it six principal tributaries and sub-tributaries.
When finished, the Carmack Wash Floodplain Study will be used for floodplain management purposes, including (1)
evaluating whether new development activities are reasonably safe from flooding, and (2) informing homeowners of
their true floodplain risks and mitigation opportunities.
This study revealed unknown areas of possible uncontrolled flooding, and the Stormwater Utility is currently talking
to the District about having them continue with this investigation to include "mini-basin management plans" to better
identify flood risks to residential and commercial structures, and to recommend remedial structural or non-structural
flood-control methods.
At present, there is no plan to submit the report to FEMA. The Town will use this information for floodplain
management as a Local Floodplain Study as mentioned above.

The Stormwater Utility has been notified by the State of Arizona Department of Emergency and Military Affairs
(DEMA) that the Highland Wash Flood Mitigation project was reviewed for feasibility and cost-effectiveness and was
found to be technically feasible but not cost-effective; therefore, the National Technical Review Committee
recommended it not be given further consideration for the 2020 Funding cycle.
DEMA said the project scope of work was well-defined and clearly explained the activities necessary to complete
the work, however the project schedule and cost estimate did not include all items necessary to complete the
mitigation project, such as final design, construction services, easement costs, and engineering/survey already
completed by the Town. The notification also said the application was missing information for the reviewers to
recreate, or to perform, a new the Benefit Cost Analysis (BCA) for the project.
The Stormwater Utility has reviewed the Grant Application Review Summary and believe the deficiencies noted can
be overcome, and a new favorable, and more-complete application, can be submitted. Accordingly, the Stormwater
Utility will be submitting a Notice of Intent (NOI) for the Lower Highland Wash Flood Mitigation Project on
September 18, 2020, for FEMA funding opportunities for either a Building Resilient Infrastructure and Communities
(BRIC) grant, or for a Flood Mitigation Assistance (FMA) grant.
