A RESOLUTION OF THE MAY4R AND COUNCIL OF THE TOWN �F
ORO VALLEY, ARIZONA, �VACATING A PORTiON OF AN ALLEY
WITHIN THE SHADOW M4lJNTA1N ESTATES SU�DIVISION.
WHEREAS, the Town of Oro Valley is a political subdivision
� of the State of Arizona, and pursuant to Article 13, Section 7 of the Arizona
Constitution, is vested with all rights, privileges, benefits and is entitled to
the immunities and exemptions granted municipalities and political
subdivisions under the Constitution and laws of the State of Arizona and the
U n ited States; a nd �
WHEREAS, the Town of Oro Valley has the authority to
vacate dedicated rights-of-way pursuant to Section 7-7 of the Oro Valley
Town Cod e; a nd
WHEREAS, the alley in question has been previously
dedicated to Pima County by the final plat of Shadow Mountain Estates and
later to the Town by process of annexation from; and
WHEREAS, the dedicated alley is not needed for public use;
and
, WHEREAS, no land adjoining said dedicated right-of-way
wou Id be left without access to a pu bl ic street;
NOW, THEREF�RE, BE IT RESOLVED, by the Mayor and
Council of the Town of Oro Valley, Arizona, to approve the vacation of a
portion of the alley as described in Exhibit 1, to the adjacent property
owners.
PASSED �►IVD ADOPTED by the Mayor and Town Council of the Town of Oro
Valley, Arizona this 6th day of September , 2006.
