F.Resolution No. (R)16-57, providing notice of intent to increase water rates for the Oro Valley Water Utility Councilmember Rodman clarified the reason for providing notice of intent to increase water rates for the Oro Valley Water Utility. MOTION:A motion was made by Councilmember Rodman and seconded by Councilmember Hornat to approve Resolution No. (R)16-57, providing Notice of Intent to increase water rates for the Oro Valley Water Utility. MOTION carried, 7-0. 12/7/2016 Minutes, Town Council Regular Session 5 H.Request for approval of a proposed Final Plat Amendment for the Pusch Ridge Subdivision (Lots 13-32), located in La Reserve near the intersection of N. Pusch Wilderness Drive and N. Della Crestia Court Councilmember Hornat asked for clarification regarding the approval process for item (H). Planning Manager Bayer Vella clarified the approval process for item (H). MOTION:A motion was made by Councilmember Hornat and seconded by Councilmember Snider to approve the proposed Final Plat Amendment for the Pusch Ridge Subdivision (Lots 13-32), based on a finding that the request is consistent with the intent of the original Final Plat. MOTION carried, 7-0. REGULAR AGENDA 8.PUBLIC HEARING: ORDINANCE NO. (O)16 -15, PROHIBITING THE USE OF HANDHELD MOBILE TELEPHONES OR PORTABLE ELECTRONIC DEVICES BY AMENDING CHAPTER 10, OFFENSES, BY ADDING ARTICLE 10-14, DISTRACTED DRIVING, TO THE ORO VALLEY TOWN CODE Oro Valley Police Lieutenant Chris Olson presented item #8. Discussion ensued amongst Council and staff regarding item #8. Mayor Hiremath opened the public hearing. The following individuals spoke in support of item #8. Member of cycling community Bill Koehler. Registered Nurse and Trauma Outreach and Injury Prevention Coordinator at Banner- University Medical Center Trauma Center Susan Kinkade. Executive Director of Look! Save a Life and former firefighter Brendan Lyons. Mayor Hiremath closed the public hearing. MOTION:A motion was made by Vice Mayor Waters and seconded by Councilmember Snider to adopt Ordinance No. (O)16-15, prohibiting the use of handheld mobile telephones or portable electronic devices by amending Chapter 10, Offenses, by adding Article 10-14, Distracted Driving, to the Oro Valley Town Code. 12/7/2016 Minutes, Town Council Regular Session 6 MOTION carried, 7-0. 1.NOMINATION AND ELECTION OF VICE MAYOR Councilmember Hornat nominated Vice Mayor Lou Waters to serve as Vice Mayor for 2017, seconded by Councilmember Rodman. MOTION:A motion was made by Councilmember Hornat and seconded by Councilmember Rodman to approve the nomination of Vice Mayor Lou Waters as Vice Mayor for 2017. MOTION carried, 7-0. 2.PRESENTATION AND ACCEPTANCE OF THE TOWN’S ANNUAL FINANCIAL AUDIT FOR FISCAL YEAR ENDING JUNE 30, 2016 Town Finance Director Stacey Lemos gave an overview of the Town's annual financial audit for fiscal year ending June 30, 2016 and introduced Mr. Jim Rebenar, CPA, Audit Manager with Heinfeld, Meech & Co., P.C. Mr. Rebenar gave an overview of the process and highlights regarding the completed financial audit for the Town for fiscal year ending June 30, 2016. MOTION:A motion was made by Councilmember Solomon and seconded by Vice Mayor Waters to accept the Town's financial audit for fiscal year ending June 30, 2016. MOTION carried, 7-0. 3.AMENDING SECTION 22.5, CHAPTER 23, CHAPTER 25 AND OTHER RELATED SECTIONS OF THE ORO VALLEY ZONING CODE TO UPDATE THE CONDITIONAL USE PERMIT REVIEW CRITERIA AND TABLE OF PERMITTED USES a.RESOLUTION NO. MOTION carried, 7-0. 4.AMENDING VARIOUS SECTIONS OF ARTICLE 8 -3 OF THE ORO VALLEY TOWN CODE REGARDING SPECIAL EVENTS PERMIT a.RESOLUTION NO. MOTION:A motion was made by Vice Mayor Waters and seconded by Councilmember Snider to approve the amendments to the various sections of the Special Events Permits code of the Oro Valley Town Code. MOTION carried, 7-0. 5.PUBLIC HEARING: ORDINANCE NO. (O)16 -14, AMENDING VARIOUS SECTIONS OF ARTICLE 8-2 OF THE ORO VALLEY TOWN CODE ESTABLISHING LICENSING REQUIREMENTS FOR MOBILE FOOD VENDORS Town Clerk Mike Standish gave an overview of the proposed amendment to various Sections of Article 8-2 of the Oro Valley Town Code establishing licensing requirements for mobile food vendors. Discussion ensued amongst Council and staff regarding item #5. Mayor Hiremath opened the public hearing. No comments were received. Mayor Hiremath closed the public hearing. MOTION:A motion was made by Councilmember Hornat and seconded by Councilmember Rodman to approve Ordinance No. (O)16-14, amending Chapter 8 of the Oro Valley Town Code to establish licensing requirements for mobile food vendors and to provide proof of inspection by Golder Ranch Fire District ("GRFD") at the time of application and every six (6) months thereafter. MOTION carried, 7-0. 12/7/2016 Minutes, Town Council Regular Session 9 6.RESOLUTION NO. (R)16-65, AUTHORIZING THE EXECUTION AND DELIVERY OF AN AGREEMENT, A TRUST AGREEMENT, A PLACEMENT AGREEMENT AND AN OBLIGATION PURCHASE AGREEMENT; APPROVING THE SALE, EXECUTION AND DELIVERY OF EXCISE TAX REVENUE OBLIGATIONS, SERIES 2016 (BANK QUALIFIED), EVIDENCING A PROPORTIONATE INTEREST OF THE OWNERS THEREOF IN AN AGREEMENT BETWEEN THE TOWN OF ORO VALLEY, ARIZONA AND A TRUSTEE; AUTHORIZING AND RATIFYING THE TAKING OF ALL OTHER ACTIONS NECESSARY TO THE CONSUMMATION OF THE TRANSACTIONS CONTEMPLATED BY THIS RESOLUTION; AND DECLARING AN EMERGENCY Town Finance Director Stacey Lemos gave an overview of item #6 and outlined the following: - Background - Final Energy Audit Recommendations - Project Details - Project Financing Recommendation - Next Steps/Project Results - Questions Discussion ensued amongst Council and staff regarding item #6. MOTION:A motion was made by Councilmember Rodman and seconded by Councilmember Snider to approve Resolution No. (R)16-65. MOTION carried, 7-0. 7.DISCUSSION AND POSSIBLE ACTION REGARDING THE REQUEST BY THE EL CONQUISTADOR HOA TO USE THE TOWN GOLF COURSE AND WATER UTILITY PUMP SITE PROPERTY FOR A SHED AND REQUESTING AUTHORITY FOR THE TOWN MANAGER, IN CONSULTATION WITH LEGAL SERVICES, TO NEGOTIATE AND APPROVE A CONTRACT Water Utility Director Philip Saletta gave an overview of item #7. Discussion ensued amongst Council and staff regarding item #7. MOTION: A motion was made by Councilmember Snider and seconded by Councilmember Rodman to allow the El Conquistador HOA to lease Town property for the use of a maintenance shed and further MOVE to delegate the authority for the appraisal if necessary, negotiations and any settlement and contract to the Town Manager and other administrative staff. Discussion continued amongst Council and staff. 12/7/2016 Minutes, Town Council Regular Session 10 MOTION carried, 6-1 with Councilmember Hornat opposed. LA CANADA DRIVE SPECIAL SESSION AT OR AFTER 7:45 AM CALL TO ORDER Mayor Hiremath called the meeting to order at 7:45 a.m. ROLL CALL PRESENT:Satish Hiremath, Mayor Lou Waters, Vice Mayor Joe Hornat, Councilmember Bill Rodman, Councilmember Mary Snider, Councilmember Steve Solomon, Councilmember ABSENT:Rhonda Piña, Councilmember EXECUTIVE SESSION -Pursuant to ARS 38-431.03(A)(1) to discuss personnel matters - conducting interviews of Town Manager candidates MOTION:A motion was made by Vice Mayor Waters and seconded by Councilmember Snider to go into Executive Session at 7:45 a.m. pursuant to ARS 38-431.03(A)(1) to discuss personnel matters - conducting interviews of Town Manager candidates. MOTION carried, 6-0. Mayor Hiremath said the following staff members would join Council in Executive Session: Human Resources Director Gary Bridget, Stuart Satow with CPS-HR and Bill Wade with Organizational Quality Associates, Inc. Mayor Hiremath reconvened the meeting at 5:01 p.m. Mayor Hiremath invited Interim Police Chief Larry Stevens into Executive Session. Mayor Hiremath adjourned the meeting to return to Executive Session at 5:02 p.m. The Administration Building was evacuated due to a gas leak and the Executive Session was moved to the Oro Valley Police Department Building at 5:03 p.m. 12/16/16 Minutes, Town Council Special Session 2 The Administration Building was cleared for re-entry by Golder Ranch Fire Department at 5:30 p.m. Mayor Hiremath reconvened the meeting at 5:33 p.m. ADJOURNMENT MOTION:A motion was made by Vice Mayor Waters and seconded by Councilmember Snider to adjourn the meeting at 5:35 p.m. MOTION carried, 6-0. EXECUTIVE SUMMARY: The Town of Oro Valley and the Regional Transportation Authority of Pima County (RTA) have entered into an Intergovernmental Agreement (IGA) to provide funding in the amount of $2 milion for the design of La Cholla Boulevard from Overton Road to Tangerine Road. On December 8, 2016, an amendment to the original IGA was adopted by the RTA Board of Directors to add an additional $1.8 million to finalize the right-of-way phase. BACKGROUND OR DETAILED INFORMATION: On April 1, 2015, the Town of Oro Valley approved Resolution No. (R)15-26, authorizing the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley for the roadway design improvements to La Cholla Boulevard: Overton Road to Tangerine Road (Exhibit A). The proposed amendment will provide additional funds to purchase additional right-of-way identified in the design phase of the final segment from Overton Road to Tangerine Road. The right-of-way acquisition is needed in advance of the construction phase in order to provide an area for public utility companies to relocate their infrastructure in conflict with the new roadway improvements. FISCAL IMPACT: There is no fiscal impact for this IGA amendment. The RTA will provide all of the funding for the design and right-of-way acquisitions.  After the design and right-of-way are complete, the project will move into the construction phase. The RTA will provide considerable funding for the construction, in which the Town and Pima County will supplement with dedicated impact fees, as depicted below. Per the RTA plan, the Town of Oro Valley has committed $800,000 of impact funds to be used towards the construction cost.   The breakdown of total project funding responsibilities are as follows:  RTA - $23,000,000 Pima County - $1,000,000 Oro Valley - $800,000 SUGGESTED MOTION: I MOVE to (approve / deny) Resolution No. (R)17-01, authorizing the amendment of the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley for design and right-of-way acquisitions to La Cholla Boulevard project. In the event the disposal of the property occurs after the Project is completed, the funds shall be returned to the RTA for reallocation to other projects. This subsection shall survive termination of this Agreement The effective date of this Amendment shall be December 5, 2016. EXECUTIVE SUMMARY: During this past legislative session, H.B. 2429 (Laws 2016, Ch. 196) amended the financial disclosure statement that is required for candidates and public officers. The primary change was a new category on the statement that requires reporting of certain travel-related expenses, which when reported are exempt as a “gift” under the law. Additionally, the law no longer requires the specific names of the public officer’s spouse or children to be included on the statement as long as a general description is provided and allows the public officer to provide a home or work address. Lastly, the Secretary of State is authorized to prescribe the electronic format for the local public officer’s financial disclosure statements. The law is effective on January 1, 2017. BACKGROUND OR DETAILED INFORMATION: On December 15, 1983, the Oro Valley Town Council adopted Resolution No. (R)166, prescribing standards of financial disclosure for local elected officials. Due to the recent adoption of H.B. 2429, which amended the financial disclosure statement, it is necessary to adopt the amended financial disclosure statement as required by state law. A.In addition to other statements and reports required by law, every local public officer, as a matter of public record, shall file with the Town Clerk on a form prescribed by the City/Town Clerk a verified financial disclosure statement covering the preceding calendar year ending December 31. All real property interests and real property improvements, including specific location and approximate size, located in the Town of Oro Valley, in which the local public officer, any member of his household or a controlled or dependent business held legal title or a beneficial interest at any time during the preceding calendar year, and the value of any such interest, except that this paragraph does not apply to a real property interest and improvements thereon used as the primary personal residence or for the personal recreational use of the local public officer. If a local public officer, any member of his household or a controlled or dependent business acquired or divested any such interest during the preceding calendar year, he shall also disclose that the transaction was made and the date it occurred. If the controlled or dependent business is in the business of dealing in real property interests or improvements, disclosure need not include individual parcels or transactions as long as the aggregate value of all parcels of such property is reported. 6. The names and addresses of all creditors to whom the local public officer or members of his household, in their own names or in the name of any other person, owed a debt of more than one thousand dollars or to whom a controlled business or dependent business owed a debt of more than ten thousand dollars which was also more than thirty percent of the total business indebtedness at any time during the preceding calendar year, listing each such creditor. This paragraph shall not be construed to require the disclosure of debts owed by the local public officer or any member of his household resulting from the ordinary conduct of a business other than a controlled or dependent business. Nor shall disclosure be required of credit card transactions, retail installment contracts, debts on residences or recreational property exempt from disclosure under paragraph 5 of this subsection, debts on motor vehicles not used for commercial purposes, debts secured by cash values on life insurance or debts owed to relatives. It is sufficient disclosure of a creditor if the name and address or a person to whom payments are made is disclosed. If the local public officer, and any member of his household or a controlled or dependent business incurred or discharged a debt which is reportable under this subsection during the preceding calendar year, the report shall disclose that the transaction was made and the date it occurred. 7. The identification and amount of each debt exceeding one thousand dollars owed at any time during the preceding calendar year to the local public officer and member of his household in their own names, or to any other person for the use or benefit of the local public officer or any member of his household. The disclosure shall include the identification and amount of each debt exceeding ten thousand dollars to a controlled business or dependent business which was also more than thirty percent of the total indebtedness to the business at any time during the preceding calendar year. This paragraph shall not be construed to require the disclosure of debts from the ordinary conduct of a business other than a controlled or dependent business. If the local public officer, any member of his household or a controlled or dependent business incurred or discharged a debt which is reportable under this subsection during the preceding year, the report shall disclose that the transaction was made and the date it occurred. 8. The name of each source of any gift, or accumulated gifts from a single source, of more than five hundred dollars received by the local public officer and members of his household in their own names during the preceding calendar year, or by any other person for the use or benefit of the local public officer or any member of his household except gifts received by will or by virtue of intestate succession, or received by way of distribution from any intervivos or testamentary trust established by a spouse or by an ancestor, of gifts received from any other member of the household or relatives to the second degree of consanguinity. TRAVEL- RELATED EXPENSES AND POLITICAL CAMPAIGN CONTRIBUTIONS SHALL NOT BE CONSTRUED AS GIFTS IF OTHERWISE PUBLICLY REPORTED AS REQUIRED BY LAW. 9. A list of all business licenses issued, by the Town of Oro Valley, or by any other governmental agency which requires for its issuance the consideration of the application for such license by the city/town council of the Town of Oro Valley, to, held by or in which the local public officer or any member of his household had an interest at any time during the preceding calendar year, including the name in which the license was issued, the type of business and its location. 10.
