Purpose
Align Zoning Code with:
Your Voice, Our Future General Plan
Arizona State Law
Amend Zoning Code Sections on General Plan Amendments
Types
Procedures
Adoption criteria
Clean up outdated references
Our purpose first and foremost with this item is to take an important next step with regards to the Your Voice, Our Future General Plan.
We are now implementing this policy document by updating our Town regulations.
As a reminder, most of this zoning code amendment includes items that come directly from the Your Voice Plan and as such have been reviewed by the Town Council at previous public meetings.
This is mainly a housekeeping item intended to align the Zoning Code with the Your Voice Plan and Arizona state statutes.
This will be done by amending sections of chapter 22 related to general plan amendments, this specifically includes:
Types of amendments
The procedures for the amendment process
Criteria to be used in judging amendment requests
And other references to outdated terminology.
Amendments in chapter 27 are to replace outdated terminology

Two of the sections in the requested zoning code amendment relate to the types of amendments and the procedures for processing an amendment
Previously Type 1 amendments were known as Major amendments and Type 2 amendments were known as Minor amendments
To help determine whether an amendment request is a Type 1 or 2, this section includes definitions and a revised amendment matrix
This will likely result in a greater number of amendment requests being classified as a Type 2 (minor) amendment, which includes the same public hearing requirements as are currently
required
The procedures for processing an amendment request are also being updated, to offer clarity and conformity with Arizona State law and Oro Valley standards

Criteria allow for review on specific topics
Effective public outreach
Economic stability
Special Area policies
The applicant may develop special area policies, which typically address concerns such as setbacks, building heights, screening and traffic management, with the understanding that they
may be refined during the rezoning process to address public safety concerns and new information.
The zoning code revisions also include information on how to judge the merits of a specific amendment request and are intended to be used by Town staff, the Planning and Zoning Commission
and the Town Council in decision-making. The criteria are directly pulled from the Your Voice Plan.
There is language which allows for the broad use of the entire general plan as a tool, as well as specific criteria related to:
Development character and land use patterns
Infrastructure and improvements
Public services
Natural beauty and environmental resources
For example: each request would be evaluated to determine if there is sufficient infrastructure in place, such as road capacity, to accommodate the potential impact from new development.
Amendment requests must also include effective public outreach efforts ā including identifying and responding to neighborhood concerns
Non-residential changes should also contribute to long-term economic stability of the Town
Special area policies may be created during the amendment process
This code amendment indicates these special area policies may be refined during the rezoning process when there are public safety concerns or new information that is available.
An example of this my be a traffic impact analysis, which would typically not be available during the general plan amendment stage. When that information is available during the rezoning,
this statement allows for flexibility to address that new information instead of sending the applicant back through the general plan amendment process again.
