Take good care, Dave Wednesday, Feb. 15, 2017 Mayor and council Members of staff Friends, The Greater Oro Valley Chamber of Commerce is in support of amendments to Chapter 28, Sections 28.4 and 28.5, and other sections of the Oro Valley zoning code regarding taglines on wall signs. By allowing taglines, providing definitions and placing size limits, you'll be acknowledging an existing sign use within our community, giving predictability to future retail owners and managers, and providing merchants with one more tool to tell their story. The newly adopted General Plan update calls for "signage regulations to emphasize identification and direction over advertising goods or services to maintain compatibility and minimal intrusiveness. " We understand the intent of that language. However, at the P&Z in December, I expressed our belief that, while the Town of Oro Valley can tell business people how big a tagline sign can be in relation to its primary wall sign, government has less authority to tell merchants what those taglines can say. The U.S. Supreme Court ruling on Reed v. Gilbert suggests government can regulate sign size and placement, but not content. As proposed, tagline sizes within the amendments before you would have the effect of limiting verbiage, and thereby meet General Plan objectives without wading into free speech considerations.
