Soil Conditions and Conditions of Approval
The Town Engineer has added Conditions
of Approval as more soil information
became available:
All drainageways will be required to be concrete,
gunite, or shotcrete lined, and mixed to match
adjacent soil and rocks in color. No soil or riprap
over filter fabric lined channels will be allowed.
All homes will need gutter systems directing roof
drainage to the adjacent street.
All wet utilities, up to and including home services
– must be in HDPE sheet lined trenches with poorly
graded sand (USGS) bedding and shading. The
utility system must have a hydrostatic drainage
outlet away from the subdivision.
Additional soil tests during construction may be
required in locations and to specifications as
determined by the Town Engineer.

Are regulated by Town Code, Section 7-7 and allowed by State law statute: ARS § 28-7202 and ARS § 28-7205
Can only be granted by the Town Council through a public hearing process
The decision to grant the request for vacation shall be solely at the discretion of the Town Council
Process
Application filed and associated $780 fee paid
All necessary clearances by public utilities have been met
All required public notification of this hearing has been posted
The Town Engineer concurs with the applicants' request and does not see any present or future benefit of these
sections of ROW to the public
Council Action – can choose one of three
Vacate ROW to Town West;
Sell ROW at previous purchase price (likely less than ten dollars) after incurring publication costs
Do nothing keeping ROW as town property.
