Request
Per the Town Code, Article 7-8-1, an entity may request that the Town consider acceptance of existing private streets, sidewalks, trails, drainage and utility easements as public domain.
Monterra Hills HOA is requesting that private common area C (East of Tangerine Terrace) be accepted by the Town as a public drainageway and will also dedicate the common area west of
Musette Dr. as public domain.
Purpose of tonight's item – Obtain direction and commitment from Council before they spend time and money satisfying the conditions of approval.
Conditions of approval
Conditions 1 – 4: points of negotiation, to be resolved prior to formal acceptance
Conditions 5 – 9: Town Code requirements, to be completed prior to formal acceptance
Staff Support
The unnamed wash serves 3 separate subdivisions, therefore it’s within the community’s interest for the Town to manage its maintenance as a public wash
The parcel west of Musette is maintenance free and provides NTP with access options
Next step – if directed, return to Council at future date for formal dedication & acceptance
