Note that the 100-year existing and post-development peak discharge values have been shown on the attached Preliminary Plat, as well as the 100-year pre- and post-development floodplain limits (see attached calculations) and minimum finish floor elevations as shown following this letter. Also note that we have attached a copy of our August 23, 1994 letter to Jim DeGrood regarding satisfaction of threshold retention requirements for this area of Rancho Vistoso which addressed the requirements for Ratliff Parcel K. Note that the threshold retention requirements for Parcel K is satisfied by basins located in Parcels H and G of Neighborhood 7. Also note in the attached calculations that a P-1 value of 1 .24, as obtained from the individual Pima County Peak Sheets, was utilized in determining the retention volume. Finally, it should be noted that this project is not located within the Highlands Wash critical basin, and therefore threshold stormwater detention is not required and therefore, attenuation of the peak flow to levels 10 percent below existing would not be required for this project. Councilmember Hoyt SECONDED the motion which CARRIED 4-0. ITEM 6 - OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K PRELIMINARY PLAT (CONTINUED FROM 11/16/94) Planning and Zoning Director Don Chatfield stated that the preliminary plat as submitted was not in compliance with a rezoning condition and asked that the item be continued. Mayor Parker asked how many times this item had been before Council. Mr. Chatfield replied that he thought it had been three or four times. Mayor Parker then MOVED to DENY OV 12-94-18, Rancho Vistoso, Neighborhood 7, Parcel K, preliminary plat. Councilmember Kautenburger SECONDED the motion. Discussion: Councilmember Skalsky asked Mr. Chatfield whether he felt that a compromise could be reached with the applicant. Mr. Chatfield said that the applicant was facing losing 12 lots and the idea of using retaining walls had been entertained. Councilmember Hoyt asked whether this could go back to the Planning Commission. Mr. Chatfield explained that the condition states that there would be an apron area maintained between the 100-year flood plain that is twice the height of the fill adjacent to the flood plain. He said that when the applicant first indicated there was a problem, staff suggested that an application for an amendment be filed that would take it back to Planning and Zoning and to the Council. He said the applicant had expressed the preference to work things out with staff. He added that staff would not be amenable to removing that condition. Councilmember Kautenburger asked what the applicant would do if this were denied. Mr. Chatfield said that they would have to prepare a new plan and come back to the DRB. Mayor Parker invited the applicant to speak. Bruce Schroeder of UDC Homes stated they were working with a map that says one thing and a condition that says something else. He said the condition is not reflected on the map. Mr. Chatfield clarified for Council that the map was part of the tentative development plan and as such was subject to conditions attached. He added that in this case, the conditions clearly supersede a tentative map. 12/07/94 COUNCIL STUDY/REGULAR SESSION 9 Mr. Schroeder said they would have to go back and reconfigure the lots to meet the condition. Mayor Parker withdrew his motion to deny OV 12-94-18. Councilmember Skalsky MOVED to CONTINUE OV 12-94-18, Rancho Vistoso, Neighborhood 7, Parcel K, preliminary plat pending resubmittal of a revised preliminary plat which addresses concerns related to rezoning conditions. (This is the last time.) Councilmember Kautenburger SECONDED the motion which CARRIED 4-0. ITEM 7 - OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K PRELIMINARY LANDSCAPE PLAN (CONTINUED FROM 11/16/94) Councilmember Kautenburger MOVED to CONTINUE OV 12-94-18 Rancho Vistoso, Neighborhood 7, Parcel K, Preliminary Landscape Plan, to such a time as the Preliminary Plat is deemed acceptable by staff for Town Council review. Councilmember Hoyt SECONDED the motion which CARRIED 4-0. Mayor Parker declared a five minute recess at 9:10 p.m. and called the meeting back to order at 9:15 p.m. ITEM 8 - OV12-94-17 ROCK RIDGE APARTMENTS LANDSCAPE PLAN (Property located on the west side of Oracle Road, north of Greenock Drive, the main entrance to Oro Valley Estates, fka as a portion of Cancha del Golf) Planning and Zoning Director Don Chatfield reviewed the Council Communication, stating that per staff's request, the applicant submitted a fact sheet of proposed plants which satisfied staff that the plants will embellish the landscape treatment and create a lush, "oasis" appearance. Mr. Chatfield added that the proposed Eucalyptus trees are prohibited. He said the DRB had recommended approval of the landscape plan on November 8, 1994, subject to the removal of Eucalyptus trees from the plant list. He said that the landscape architect agreed to this condition and all other staff suggested conditions have been met. Mr. Chatfield stated that a staff member had visited the Rock Ridge site and noted that Trees H and EE are significant Mesquite trees. He said that staff recommended that these trees be evaluated by a person with expertise in plant salvage as to the potential for side-boxing and chances for survival. Mayor Parker invited the applicant to speak. Rick Shoenfeld of Cella Barr Associates stated that the eucalyptus trees had been removed. He said it had been determined that Tree H could not be salvaged, but Tree EE would be, along with two other trees. Mayor Parker asked for questions of the petitioner. There being none, he called for a motion. oDoNL 110113 23124 24 119 26125 L MOM AREA Cr w1a IUROFlAIOI■ &T.t AOtf1 31 A((STAOQ 0 TIC Pumas ME]MOT(aOH1U!OR Vlf AC>9TAMC=0 ANr 0 - ------- 2330 ...AL 0d lAcl- 232 ACRC1 1141.0.10..... , _ THIS „, RARE EA Amu - sat AKS 1_ .Au.a(s)META....CR own TErg31 3 5 I °"'"""`'- " S.. He said that staff had recommended to the DRB that a small amount of turf should be included as a passive play area. He added that DRB did approve the plan but opted to eliminate the turf areas along the WAPA trail in both Parcel T and Parcel G, based on the feeling that the turf would consume water and be difficult to maintain. He stated that staff did support the DRB's recommendation for approval, but still maintained their differing opinion regarding the use of turf. He said that staff recommended approval with one condition: 1. The picnic node within the WAPA trail shall be provided with a turf area of 500± square feet in size, to be maintained by the Homeowners' Association. Mayor Parker asked for questions of staff by Council. Councilmember Skalsky suggested that fast-growing trees be placed alongside of the turf area for shade and slower growing trees be planted to come along behind the others. Mayor Parker invited the applicant to speak. Tim Ensign, of The WLB Group, representing Pulte Homes, stated that the Master Homeowners Association would maintain the trail and the picnic areas. He said that the picnic areas are small and remote from each other, and if they were turfed, that would be the only reason to have to bring in a water system. He said that turf is difficult to maintain and is inconsistent with the desert atmosphere along the trail. Mr. Chatfield stated that the picnic nodes would be adjacent to subdivisions and would not be distant from homes and would probably be used regularly by the people living nearby. He said that staff did not feel that a turfed picnic area would be any more incompatible with the desert than a golf course would be. He said that staff has pressure to provide play areas for children to get out and romp around in. Councilmember Skalsky MOVED to APPROVE OV 12-94-10B, Rancho Vistoso, Neighborhood 5, Parcel T, Recreation Area Plan, as forwarded by the Development Review Board; with the condition that a 500± turfed picnic node be provided, along with fast-growing shade trees, supplemented by slower-growing trees. Councilmember Kautenburger SECONDED the motion which CARRIED 4-0. ITEM 11 - OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K PRELIMINARY PLAT Planning and Zoning Director Chatfield reviewed the Council Communication, stating that Parcel K is an eight-acre parcel (30 lots) which will be a southerly extension of Parcel C - both parcels to be developed by UDC Homes. He said that the preliminary plat had been recommended for approval by the DRB, with conditions; and that Council considered a revised preliminary plat at the October 26, 1994 meeting, but were concerned that the solution the project engineer and UDC 11/16/94 Minutes, Town Council Regular Session 9 Homes had devised would create lots that were not viable. As a result, this item was continued to November 2nd pending further study and on November 2nd it was continued to November 16th, pending resolution to the wash protection problem. Mr. Chatfield stated that Planning and Engineering staff members had consulted with the project engineers and representatives of UDC Homes and had performed a site visit, and found that no resolution to the wash protection problem had been reached. He said that staff was recommending another continuation. Mayor Parker asked for questions of staff from Council. Councilmember Skalsky asked what possible compromise could be attained. Mr. Chatfield stated that UDC had proposed using retention walls instead of sloped fill. He said that staff was working on the feasibility of that proposal. Ms. Skalsky said that she could see no reason for more negotiations. Mr. Chatfield said that staff was working to respond to the applicants' requests and would have a resolution of the situation by the next council meeting. Councilmember Skalsky MOVED to CONTINUE OV12-94-18, Rancho Vistoso, Neighborhood 7, Parcel K, to the December 7 Council Meeting. Councilmember Hoyt SECONDED the motion which CARRIED 4-0. ITEM 12 - OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K PRELIMINARY LANDSCAPE PLAN Councilmember Hoyt MOVED to CONTINUE OV12-94-18, Rancho Vistoso, Neighborhood 7, Parcel K, Preliminary Landscape Plan, to the Town Council meeting of December 7, 1994. Councilmember Kautenburger SECONDED the motion which CARRIED 4-0. ITEM 13 - OV12-94-24 RANCHO VISTOSO, NEIGHBORHOODS 10, 11, & 13, GOLF COURSE NATIVE PLANT SALVAGE PLAN Don Chatfield, Planning & Zoning Director, reviewed his Council Communication, stating that the salvage plan was approved by the DRB on October 25, 1994. This plan addresses the inventory of salvageable trees and cacti and the retention and placement of trees and cacti on the golf course property. The DRB approval was conditioned on a resubmittal with revised information which has been received and reviewed and is acceptable. This revised plan has significantly reduced the impacts to sensitive habitat and wash areas. Total graded area has been reduced to 125 acres. Staff has the following concerns: 1. The grading limits for the sixteenth green encroach into significant riparian habitat area EXCERPT FROM THE SEPTEMBER 6, 1994 DRB MINUTES aimink OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K, LOTS 1-30, PRELIMINARY PLAT The P&Z staff report was read by Linda Frew. Joanne Homer read the Engineer's Report and added the following change: 3 . Where fill is proposed adjacent to the existing wash, an apron area equal to two times the height of the fill shall be provided along the pre-development 100-year floodplain limit lines of said wash and no grading shall occur within that apron area. Lot lincs shall be adjustcd so that no part of any lot is locatcd within that apron area. Further lot lines and building pads shall be adjusted so that each lot does not encroach within the pre-development 100-year floodplain limit. Bill Adler said, in the Public Works report, item three states: Where fill is proposed. . . Bill Adler asked if fill has not been approved. Joanne Homer said the approval of the fill would be part of the preliminary plat process. She said they are showing finished floor elevations above existing topography. She said the fill that is being proposed to the site is within the conditions of the PAD for Rancho Vistoso. Joanne Homer said they meet the requirements of the PAD. Marty Wells wanted clarification on the calculations for retention requirements. He asked if these were standard. Jim DeGrood said yes, the amount of runoff is computed prior to the site being developed, with basically a 1.26 inch rainfall and the runoff would be after development with that same 1.26 inches of runoff or rainfall and determine what that runoff volume is and that is what they are obligated to retain onsite and dispose of through percolation. The petitioner, Bruce Schroeder, UDC Homes was present. He explained the sewer stub and shallow sewer. He said the sewer along this project, and Parcel C, would have to covered. He said they want to eliminate the back to back retaining walls. Richard Underwood asked if this is to balance the site overall. Mr. Schroeder said, this site is 7,000 yards of cut and 50,000 yards of fill. Parcel. C is about 75,000 of cut and 35,000 of fill. Parcel K & L, to the north, has over 75,000 yards of excess material to generate to fill these two areas. He said they do not to move any more dirt than is necessary. The whole subdivision is lower than surrounding streets. Mr. Schroeder said they will satisfy all of the staff conditions addressed in staff reports. The Chairman entertained a motion. Richard Underwood MOVED to APPROVE OV12-94-18 RANCHO VISTOSO, NEIGHBORHOOD 7, PARCEL K, LOTS 1-30, PRELIMINARY PLAT pursuant to staff conditions, as follows: 1. A legal description of the preliminary plat shall be submitted to the Town of Oro Valley. Bearings and distances for the boundary of the proposed plat shall be provided on the preliminary plat plan. 2. The following hydrologic data shall be shown on the preliminary plat: a. All entering and exiting Qn, values for pre- and post-development conditions. b. Pre- and post-development 100-year floodplain limits through and exiting the plat. c• Q100 values for flows within the streets. 3. Where fill is proposed adjacent to the existing wash, an apron area equal to two times the height of the fill shall be provided along the pre-development 100-year floodplain limit lines of said wash and no grading shall occur within that apron area. Further lot lines and building pads shall be adjusted so that each lot does not encroach within the pre-development 100-year floodplain limit. 4. The upstream improvements which reduce peak flows during the 100-year storm shall be completed prior to final plat approval of Parcel K. 5. The natural open space associated with the wash shall be fenced off and protected from disturbance during construction. 6. Prior to release of assurances for Parcel K, street and utility improvements within Parcel C that provide access and service to Lots 1 through 8 of Parcel K shall be completed. 7. Prior to scheduling the preliminary plat for Town Council approval, a drainage statement shall be provided to the Town of Oro Valley Public Works Department and shall contain the following information: a. Pre- and post-development 100-year floodplain limits. b. Calculations for retention requirements. These calculations should use 1.26 as the one-hour rainfall, reflect the proposed plat layout, and retention of runoff should limit the runoff to at least 10% below pre-development level. c. An analysis showing how down-stream retention basins will meet the necessary retention requirements (as calculated in item 7.b. above) for Parcel K. d. A table showing pre- and post-development WSEL versus FFE for each lot adjacent to the wash; and 8. Provided that all P&Z Commission and Town Council conditions of rezoning for this parcel are met on the plat, and, in particular, that all items related to wash preservation are addressed to the Town Engineer's satisfaction. 9.
