and visual improvement of the Nature Preserve. The current condition of the former retention pond
and watering source for the former golf course is not only visually objectionable but a safety and
liability hazard as well. Some correction to this area of the Preserve is sorely needed and funds for
this purpose should be allocated as soon as fiscally possible.

Hello —
I'm writing this email as you prepare for the upcoming March 6 council meeting. You'll be discussing future funding for
the Vistoso Trails Nature Preserve. You have big decisions to make for all of Oro Valley, and of course, I hope you set
aside a fair amount of funds for the Preserve — especially to address the pond and revegetation.
Here's an affordable idea to consider for revegetation. Why not get the community involved? We all have landscaping
with native plants that sprout pups. The community can help with the revegetation for FREE if we have a day or two set
aside to bring and plant specified plants from our yards or purchased. The city can provide guidelines for plant types,
planting tips and areas to be addressed. it'll take some organization from you and the Preserve Vistoso folks, but I'm
guessing the passion from the community with shine through.

Recent emails from the Preserve group suggest funding is being debated for the former golf course. I
agree we need to meet the challenges necessary to 'preserve' the property. But my expectation is
well short of their suggestion that The Town allocate $2M to dress it up in nicer clothes. I don't agree
with a Taj Mahal should be in the offing. The former sod areas will be overtaken in time. Allowing
Mother Nature to take the lead. She works well and cheap. And the pond will forever be an eyesore
without expensive maintenance and continual intervention. It would need 24/7/365 pumping
aeration? How much water will we waste keeping it full. Even recycled. Contact pool and home
builders who have fill dirt to dispose of and fill in the pond. Then we can permanently take down the
Gone Fishin' sign.

Valley.
Provide the necessary funding on an ongoing basis for the Vistoso Trails Nature Preserve pond

Our community donated nearly $2M dollars to purchase the property. Our expectation is that the
Town of Oro Valley should be willing to match what we've already donated!
This nature preserve is a true jewel for Oro Valley and shows residents and future residents that the

In July 2022, we celebrated the transfer of Vistoso Trails to the Town of Oro Valley. It was with greal
joy and hope that we celebrated the opening of the nature preserve, knowing that it would be cared
for and improved by the Town. I was particularly moved by Mayor Winfield's comments at the ribbon
cutting. I was hopeful that Vistoso Trails would be a priority, but it is not.
Many of us participated and provided information to Sites Southwest but that Master Plan has been
stalled and ignored. We were clear about what needed to be done -- pond restoration and the
revegetation of the former fairways, greens, tees and bunkers. Once Naranja Park is completed, we
also need to apply for state and federal grants.
The property right now looks like and is an old closed golf course. It should be an embarrassment
that the Town vowed to add this property to its parks and care for it, but refuses to fund the changes
we already have said need to be made. Our community raised almost $2 million to purchase the
property so we expect the Town to step up and provide funding to make the improvements we have
said are needed.

Dear Mayor Winfield and Town Council Members,
As 22-year residents of Rancho Vistoso Highlands #1 we are writing to address the upcoming budget funding for the
Vistoso Trails Nature Preserve. Rancho Vistoso must receive adequate funds for improvements, preservation and safety
enhancements for the Nature Preserve.
It is our understanding: the OV Town Council continues to support significant town budget allocation /funding for
Canada Hills and Pusch Ridge. Rancho Vistoso (focus on the Nature Preserve) has failed to receive funding that would
"support basic maintenance and natural preservation of the Vistoso Trails Nature Preserve". TOV issued a survey to
residents regarding priorities for upkeep/maintenance of this land. I emphasize "natural Nature Preserve". Resident top
three priorities/focus include:
1. Existing WALKING PATH maintenance and upkeep (former golf cart path — no additional "interstate system " of
walking paths resulting in a negative impact to the land and wildlife). In addition, there are significant problems
with unauthorized vehicles (ATVs — non TOV, trucks) accessing the nature preserve during the day as well as at
night. This creates a MAJOR SAFETY THREAT TO HOMEOWNERS AND THEIR PROPERY THAT MUST IMMEDIATELY
BE ADDRESSED.
2. Natural revegetation of the Nature Preserve.
3. The former POND AREA needs to be re -constructed to reflect all other areas of the natural preserve. We
understand there are efforts to reconstruct it as a pond to be used as an entertainment/picnic area (tables,
benches, etc.)., This should not be the goal. Refurbishing the pond from an optic perspective (water usage) and
our general understanding that Rancho Vistoso has 18 wells (8 of which are deficient) does not reflect
responsible water conservation and planning by TOV. In addition, we understand parking will be added to
Vistoso Highlands Drive to accommodate the proposed entertainment destination. There are already major
traffic and pedestrian safety issues regarding Vistoso Highlands Drive (note: this does not include future traffic
hazards to be created by the Rulney —132-unit apartment development). Further, what about the residents
that live adjacent to the proposed Pond area and the disruption/impact it will have to their quality of life, home
values and safety?
TOV has lost credibility and citizen support as a result of the neglect of the Nature Preserve and funding allocation to
other community initiatives. The TOV has provided significant funds for the Community Center, Naranja Park, Canada
Hills and Pusch Ridge. Have the residents of these communities contributed approximately $2 million (private resident
funds, non-OV tax dollars) for these projects? Rancho Vistoso stepped up to save the former golf course and guarantee
green space in perpetuity only to be ignored and underfunded for basic upkeep and maintenance of the 202 acres. In
addition, there is now a focus to make Vistoso Highlands Drive unlivable and a further safety hazard —traffic on a 2-lane
winding road, proposed pond parking, 132 apartments on approximately 6 acres with a 15-foot setback from the
street. The common sentiment is as long as it is "NOT IN MY BACK YARD — NIMBY" it is acceptable.

As 22-year residents of Rancho Vistoso Highlands #1, we are writing to address the Rulney development on Vistos
Highlands Drive.
Why did the Town of Oro Valley (TOV) not provide full disclosure and transparency to the residents of Vistoso
Highlands/Rancho Vistoso prior to finalizing the Settlement Agreement? It is clear the residents of Vistoso Highlands
Drive are collateral damage to allow Rulney to maximize profits. It was recently shared, prior to this agreement, TOV
approached other developers to purchase this property. However, several declined due to the small size of the
property.
The Town Council must vote "NO" on Rulney's current request for expansion and rezoning of "the whale" and the
"trailhead parking". The trailhead parking will be used for apartment complex overflow parking. These areas must
remain Preserve Vistoso open space. Residents contributed approximately 2 million dollars to preserve the green space
and natural aesthetics.
Below are the Pima County requirements for zoning/building which obviously were not adhered to nor considered by
TOV.
Per Pima County:
What Are Zoning/Building Codes?
Zoning and Building codes area set of ordinances or rules that are approved and adopted by the Pima County
Board of Supervisors under authority of the State of Arizona. Theses codes are intended to promote the health,
safety, and welfare of the community; to provide for orderly growth and development; and to regulate land
use, protecting property values and preserving natural aesthetics.
All residents should have been informed that multi -family residential for this 6.07 acres meant apartments (132) not the
existing condominium footprint. There are no apartments currently north of Tangerine Road in Oro Valley.
Further, the residents learned the 6.07 acres is zoned HDR (as of 1987). However, the General Plan lists this 6.07 acres
as MDR. Please note: all the surrounding areas were originally zoned HDR but only single-family homes and
condominiums (multi -family) currently exist. TOV continues to pass blame to the residents that they did not inherently
know that for Rulney, multi -family development is 132 apartments.
Request for TOV Mitigation Strategies prior to Rulney's initiation of the build:
1. Vistoso Highlands Drive is a two-lane winding road (alongside condos and neighborhoods) with no possibility
of expansion. It currently presents serious traffic and pedestrian dangers. There is excessive speeding all
along Vistoso Highlands Drive.
2. There are serious traffic. dangers (rear -ending) for residents turning left into condominiums. There is now
talk of refurbishing the pond area across from the condominiums and adding parking places along the street
for visitors. This will further the serious traffic and pedestrian dangers.
3. The volume of increased traffic will seriously impair the safety of existing neighborhood residents who must
turn left onto Vistoso Highlands Drive. What is the plan for intermittent stops signs or speed bumps to stop
or slow down oncoming traffic? The only other option for residents is to turn right and seek a safe place to
turnaround (e.g., condos, the proposed apartment complex, proposed trailhead parking or, neighborhoods
e.g., Fairfiled or U-turn at Stone Canyon).
4. For 20+ years there has been an early morning traffic back-up at the Stone Canyon gate (at the end of
Vistoso Highlands). Within the last two months, TOV has posted no parking signs from 5:00 a.m. — 9:00 a.m.
along Vistoso Highlands. Will this traffic then move to the Trailhead parking, Neighborhood visitor parking,
the proposed apartment complex (anywhere the signs are not enforced)? What about 9:01 a.m. to 4:59
a.m. the next day?
5. We have already experienced flatbeds and delivery trucks parking along Vistoso Highlands (two-lane area)
requiring all traffic to enter the oncoming traffic lane to get around. Also, how will the apartment complex
accommodate garbage trucks, moving vans, delivery trucks, etc. with the limited driveway space? What will
be the impact for emergency vehicles responding to Vistoso Highland residents?
Per Rulney, during the Zoning and Planning meeting on 2/6/24 (recorded), he was told by the TOV this is a done deal and
he would not be required to appear before the public. Further, he indicated this was a done deal negotiated by TOV
Senior Town Staff behind closed doors. Why was this transaction not required to be made public to the residents of
Vistoso Highlands?

Helto! I am unable to attend the Mar 6 Council Meeting but as a long time Oro Valley Resident I'd like to
express my opinions regarding the Vistoso Golf Course property.
We have lived on the 14th "green" for almost 11 years now so we have seen it at it's best and at its
worst. Here's my short answer... less is more.
Please just continue to maintain the landscaping, trash cans, dog waste stations, and any areas of
buckling sidewalks. Maybe add a few benches. And for us, that's enough.
At one point I saw a master plan which included many, many additional cement paths that criss-crossed
the old greens and fairways, several of which intersected less than 25 feet from my hot tub. My first and
biggest question was .... WHY? Why do you need to waste money and funds and time and resources on
making more paved paths? Please just maintain the one that's currently there.

Dear Council:
I encourage you to listen to -your constituents and vote to NOT rezone the 0.7 acres that the developer,
Ross Rulney, wishes to use for his apartment development off of W. Vistoso Highlands Dr. The
community has sent you a loud and clear message by working tirelessly to raise $1.8M to protect as
much land as possible. To vote to simply give any more land to the developer is a slap in the face to this
community.
I am also concerned that OV Planning Staff may have acted out of turn by making a deal with Mr. Ross
Rulney to build a parking lot near the proposed apartments. A deal Mr. Rulney threatened to rescind
during the February 6, 2024 meeting with the Planning Committee; stating "if you don't give me what
want I won't build your parking lot". I'm surprised Mr. Rulney felt empowered to not only threaten the
committee but also to back out of whatever deal was made. Why did staff make a deal with Mr. Rulney in
the first place? If anything is to be built on public land by the government shouldn't it follow the rules of
issuing a government contract? And if a contract was awarded to Mr. Rulney why did he believe he could
back out of the contract so easily? And why wasn't Mr. Rulney asked to leave the meeting after
threatening the committee displaying poor conduct?
I.additionally encourage this Council to locate the preserve parking lot where you already have a paved
Lot on W Pebble Creek Dr. It has been brought up in numerous meetings that the traffic along W. Vistoso
Highlands Dr. is far more numerous than anyone would rightfully expect given it is a two lane residential
road that dead ends to a manned gate. The developer used in his traffic study was a capacity of 10,000
vehicles (semi -trucks included) per day is allowed along that road. I question that capacity. Please
request staff to look into that number and determine the accuracy. I can't imagine what other two lane
residential dead end roads in Oro Valley are expected to allow 10,000 vehicles per day.
I also encourage you to match the community's effort by allocating funds to restore the golf course by
planting native plants and restoring the pond. Once again, to do anything less is a disservice to this
community.

appears neglected and unfinished as it is now. We know that it takes many years for a desert to return to
a natural state after man has destroyed the natural vegetation. Nothing does that more effectively than
turning it into a water gobbling golf course. But now, Oro Valley has the opportunity to help turn Vistoso
Trails back into a natural desert landscape. Funding at this time would be appreciated by the residents
of Oro Valley and an action that could be done at modest cost compared to all the money spent on parks
south of Tangerine..
Please put up the funding to help kickstart the regrowth of desert vegetation. We have been told that $2
million in funding, UP FRONT, like in the coming year, would go a long way toward accomplishing
that. Like Naranja Park, some money spent now will go toward immediate improvement. However,
future costs for operating the nature preserve will be far less as revegetation is a onetime
expense. Improve Vistoso Trails now and make this your legacy to the town.

Please just continue to maintain the landscaping, trash cans, dog waste stations, and any areas of
buckling sidewalks. Maybe add a few benches. And for us, that's enough.
At one point I saw a master plan which included many, many additional cement paths that criss-crossed
the old greens and fairways, several of which intersected less than 25 feet from my hot tub. My first and
biggest question was .... WHY? Why do you need to waste money and funds and time and resources on
making more paved paths? Please just maintain the one that's currently there.

picture my wife and I took in front of the beautiful pond back in pre -blight days. Along with the

touted so called 'nature preserve' which one would think encourages such activity; 2.) fix and restore the abandoned,
dilapidated golf course pond now labeled 'community lake'; and 3.) remove invasive flora species.
I must, also, comment on a few other areas of the development of OV 132- First, I see that now you are unilaterally,
without consent from the community renaming and redirecting this site from RV PAD 'Open Space' to RV PAD 'Open
Space / Recreation'. This direction is not keeping with the original framework of why the Vistoso community turned this
parcel over to you.
Second, you should not rezone the'additional 0.69 acres for use by this development on a number of grounds - the first
being all contractual, tangent land obligations have been granted to the developer - by the original contract with the
town and no more of the nature preserve land should be granted.
Third, pages 16-17 of the RV PAD Amendment 30 shows that this area is designated 'Critical Resource Area' and should
be kept untouched.
Fourth, your traffic study comparisons look to be using vastly not parallel streets for'allowing up to 10,000 vehicles per
day'. Looking at pages 24-25 of same RV PAD Amendment 30, streets within a certain proximity (one -quarter mile or
one -mile)- citing Tangerine Road and Moore Road - both traveling for tens of miles are not equivalent comparisons for
Vistoso Highlands Drive. Tangerine Road is actually, also, designated Arizona State Route 989 - to say that this is a
comparable thoroughfare as Vistoso Highlands is an egregious mistake.
I will leave the comments for OV 132 here for now.

We hope that the Town of Oro Valley continues to support the Reserve through funding for its
maintenance including the revegetation project, tending to the state of the pond, and restoration of the
rest rooms. Vistoso Trails Nature Reserve is a natural gem for the residents and taxpayers of Oro
Valley. It deserves as much attention and funding from the Town as the members of Preserve Vistoso
have already provided. There is a master plan and it behooves the Council to advance this great plan for
the benefit of all stakeholders.
We strongly urge Council to strongly back this valuable asset with the budget to put the master plan into

As a resident of Oro Valley, I ask that you strongly consider funding the restoration of the Vistoso Trails Nature Preserve
in a manner that reflects fairness to Rancho Vistoso residents relative to funding given to golf and other Town amenities.
I am told that the Town is considering $200k per year as a start to rehabilitate the property as it currently sits. This
amount is simply NOT enough. We need a significant investment now to address the condition.of the property. The
citizens/voters are not asking for many amenities to be added to the property. Actually, many have stated that what we
want to see are re -seeding and re -vegetation, address the cart path issues, and remedy the appearance of the
pond. We do not expect nor want added trails and butterfly gardens and many other nonsense projects to be
added. You are well aware that there is also a Conservation easement which disallows many items proposed for this
property during past P&R Master Plan meetings. And to date, there still is no Master Plan for Vistoso Trails.
I heard a comment at the last Town Council Meeting that this property does NOT generate a profit or any income. Yes,
parks don't do this. But to say a Town golf course shows a $20 thousand a year profit is simply ridiculous. Did you factor
in the $23 million that the Town has spent on golf in the past 9 years? Or, the $8 million for a new irrigation system for
36 holes of golf? How again does golf show a profit? Please don't tell us that the long term maintenance costs for
Vistoso Trails will be greater than the annual operation of 45 holes of golf.
The citizens of Oro Valley and Rancho Vistoso residents donated almost $1.9 million to buy this property. You cannot
expect that this gift to the Town will be funded additionally by the same donors who facilitated the purchase of this
property; that will not happen. Again, please support this project with a fair share of funding as you would other Town
amenities. We don't believe this is an unreasonable request.
Please fund the rehabilitation of the property that the Town accepted as a wonderful amenity for all Oro Valley
residents.

1. Traffic volumes at the intersection of W. Hidden Springs Drive and Vistoso Highlands Drive (dangerous
intersection). What are the TOV mitigation strategies to address current and future state safety issues:
a. Excessive speeds currently — increased traffic will exacerbate this issue.
b. Intersection Vistoso-Highlands and W. Hidden Springs Drive (2 entrances— Centre Point entry and Richmond
America entry)?
I. Potential solutions -- 4 way stop or traffic lights. Potential resulting issues are below (what will be
the TOV mitigation strategies)?
i. Back-up of traffic on Rancho Vistoso Blvd. (left and right turns off of Rancho Vistoso Blvd.)
e.g. blocking oncoming traffic.
ii. Back-up of traffic on Vistoso Highlands Drive — apartment residents, condo and single-family
residents, Stone Canyon residents and workmen (including large trucks), delivery vehicles,
moving vans, increased number of garbage trucks, etc. This will block residents leaving the
condominiums, neighborhoods, etc. and will result in long wait times to get through stop
signs/lights.
iii. Will formal pedestrian crosswalks at the intersections be installed?
2. Crosswalk near the former pond area (dangerous curve). We have witnessed many times pedestrians trying to
cross and almost being hit by oncoming traffic both ways. This is VERY DANGEROUS. How will this be addressed
and mitigated by the TOW
3. Increased traffic volumes and speeding: a. Centre Point - along Pebble Creek onto LaCanada and b. along W.
Desert Fairways — Innovation Academy. What are the TOV mitigation strategies? These are highly traveled
throughways for Rancho Vistoso generally.
4. Displayed below are the zoning standards for Pima County. What are the comparable zoning standards for Oro
Valley and the formal resident complaint process? I am formally requesting Bayer Vella and Michael Spaeth
share the TOV information with the Vistoso Highlands residents.

• Zoning and Building codes are a set of ordinances or rules that are approved and adopted by the Pima

necessary funds for its much needed improvements and upkeep. The people of Oro Valley/Rancho Vistoso and
the Highlands area will thank you and the wonderful animals who share their habitat with us will also delight in the

I would once again like to express my thanks and appreciation for your support and your contributions in
securing the former Vistoso golf course and creating the Vistoso Trails Nature Preserve. As you all are
well aware, the community was passionate enough about this project to raise nearly $2M to fund the
purchase of the property ourselves. However, since then, while some maintenance work has been
completed to restore the bathrooms and improve the pathway, there has been no investment, or any
activity at all, beyond that. The master.plan has been in limbo for over a year, .and in the meantime tens
of millions of dollars have been invested and committed toward the El Con golf courses and Naranja
Park. In fact, money is being spent in Naranja Park for items that were low on the priority list while the
high priority items for the Preserve remain unfunded.
I understand that funding is not unlimited, however there must be a way for a more fair and equitable
division of the budget so that the priority items for the Preserve, (primarily the pond and the revegetation
of,the tees, greens and fairways) can receive the attention that has been sorely lacking. My
understanding is that as things stand today the Preserve is expected to receive continued minimal
funding for at least the next 10 years, barely enough to cover the maintenance required on an annual
basis. In the meantime the pond will continue to be an eyesore and the revegetation will never be
addressed. This is unacceptable when the Town continues to spend the community's tax dollars on golf,
which is only used by a small minority of the citizens.
The community stepped up with their own money when the opportunity arose to purchase the
Preserve. It's time for you to honor that investment by providing the funds needed to take the next steps
in funding the rehabilitation of the property and completing the master plan.

I am sorry not to be able to attend the meeting tonight in which the future of Vistoso Preserve is to be
discussed. I do have a few thoughts for consideration:
1. Please allocate funds for the maintenance of the Preserve. We homeowners in the area donated nearly
$21VI to help purchase the park. We really need the city to step up with funds for maintenance.
2. Please open the restrooms. It seems like they have been under construction for the past two or three
years. They need to be opened.
3. The big pond continues to be an eyesore. Please come up with a master plan to do something with this
big hole in the ground.
4. Word has spread and the park is used by people on a very regular basis. This will only continue to grow
especially with the paved pathways being accessible for people with disabilities.
5. Those of us surrounding the park contributed a lot of money to help buy the property. The city needs to
come up with the money to maintain
