HomeMy WebLinkAboutMinutes - Board of Adjustment - 8/28/2018 MINUTES ORO VALLEY BOARD OF ADJUSTMENT REGULAR SESSION August 28,2018 ORO VALLEY COUNCIL CHAMBERS 11000 N.LA CANADA DRIVE REGULAR SESSION AT OR AFTER 3:00 PM CALL TO ORDER Chair Dankwerth called the meeting to order at 3:00 p.m. ROLL CALL PRESENT: Helen Dankwerth,Chair Stephen Roach,Vice Chair Michael Schoeppach,Member David Perkins,Member Ocatvio Barcelo,Member* *Member Barcelo arrived at 3:07 p.m. STAFF PRESENT: Principal Planner Michael Spaeth Council Liaison Steve Solomon PLEDGE OF ALLEGIANCE Chair Dankwerth led the Board and audience in the Pledge of Allegiance. CALL TO AUDIENCE There were no speaker requests. COUNCIL LIAISON COMMENTS Council Liaison Steven Solomon did not have any comments. REGULAR SESSION AGENDA 1. REVIEW AND APPROVAL OF THE JUNE 26,2018 REGULAR SESSION MEETING MINUTES August 28,2018 Board of Adjustment 1 MOTION:A motion was made by Member Schoeppach and seconded by Vice Chair Roach to approve the June 26,2018 meeting minutes as written. MOTION carried,4-0. 2. PUBLIC HEARING:REQUEST FOR A VARIANCE TO REDUCE THE REQUIRED SIDE YARD SETBACK FROM 15'TO 8'TO ALLOW FOR THE ADDITION OF AN ATTACHED PORCH ONTO THE SIDE OF THE HOUSE LOCATED AT 12502 N COPPER SPRING TRAIL(OV1801669) Planner Hannah Oden provided a presentation that included the following: -Purpose -Location of subject property -Zoning requirement -Five criteria -Summary Discussion ensued among the Board and staff. The applicant/homeowner Shu-Fang Chen provided a presentation that included the following: -background on move to Oro Valley -photos of patio showing sun exposure -view showing location of neighbor's house to the south -proposed louvered structure for the porch Discussion ensued between the applicant and the Board. Chair Dankwerth opened the public hearing. Oro valley resident John Lallensack,who is the neighbor to the south of Ms.Chen, stated he did not have any objection to the proposed structure. Chair Dankwerth closed the public hearing. MOTION:A motion was made by Vice Chair Roach and seconded by Member Perkins to approve OV1801669,a variance to reduce the side yard setback from 15'to 8',based on the finding that the five criteria have been met. MOTION carried,5-0. 3. DISCUSSION ONLY:UPDATE ON THE CODE AMENDMENT RELATED TO SETBACKS IN RESIDENTIAL ZONING DISTRICTS August 28,2018 Board of Adjustment 2 Senior Planning Technician Patty Hayes provided a presentation on proposed code amendment changes that included the following: -code amendment changes are related to accessory structures and features only -proposing a 50%side yard setback reduction,but will include a limitation of five feet -rear yard setback can be as close as 10 feet,including posts -applies to open porches only(open on three sides) -reducing front yard setbacks by 50%;the porches can project into the setback -reducing the distance between buildings on the same property from 10'to 5' -allowing an additional 20%setback reduction in special circumstances -further amendments to above ground spas,courtyard and driveway gate entries -updating the language related to other architectural features to make more clear and understandable Discussion ensued among the Board and staff.
