POSTED: 01/25/06 4:00 p.m. Ih V1 TOWN OF ORO VALLEY STUDY SESSION MEETING DATE January 31, 2006 TO: HONORABLE MAYOR & TOWN COUNCIL FROM: Scott Nelson, Special Projects Coordinator SUBJECT: ARIZONA STATE LAND DEPARTMENT- BACKGROUND, MISSION STATEMENT, ANNEXATION AND PLANNING PROCESS SUMMARY: Prior to Arizona statehood Congress placed more than 10 million acres of then Federal land into trust. The State of Arizona was designated trustee, with the beneficiaries being primarily public schools. Congress intended that when Arizona became a state that Federal lands given to the state were to be administered by the state as trustee so that the state would maximize the benefits to the trust that come from the sale of urban undeveloped lands. In order to ensure the highest rate of return, the state is required by law under its responsibilities as trustee of the land to sell lands at auction, and to the highest bidder. Arizona State Land Department Mission Statement: To manage State Trust lands and resources to enhance value and optimize economic return for the Trust beneficiaries, consistent with sound stewardship, conservation, and business management principles supporting socioeconomic goals for citizens here today and generations to come. To manage and provide support for resource conservation programs for the well-being of the public and the State's natural environment. In the Town of Oro Valley General Planning area there are three areas of state land. Two of those areas are outside of the current town limits. They are the 4,620 +1- acres located north of Rancho Vistoso (Sun City area), and 640 +1- acres located west of Stone Canyon; the third area is located in the Town and is a 32+!- acre located at the southwest corner of La Cholla Blvd. and Tangerine Rd. For cities or towns to annex State Trust Land, they must follow the guidelines that the Department has set forth and must be consistent with the Arizona State Land Department mission statement. (The guidelines for Annexing State Trust lands are attached for your review). A major component to the annexation guidelines is planning; conceptual planning between the Arizona State Land department and local jurisdictions contemplates a variety of land uses for urban lands, and can include open space. Conceptual planning of State Trust Lands is in accordance with Arizona's Growing Smarter statutes. The Southern Arizona land department office has scheduled a conceptual plan for the Oro Valley area in fiscal year 06-07. From a historical perspective, the Town of Oro Valley has attempted to annex the state lands north and west of current town boundaries. In 1997 an application was submitted to annex the 4,620 acres of State Trust Land north of Ranch Vistoso, but that annexation was put on hold by the State Land Commissioner due to the Incorporation efforts of Catalina. In 2003, an application was submitted to annex the 640 acres west of Stone Canyon, but that annexation was also put on hold by the State Land Commissioner due to a pending Pima County Arizona preserve application. This action is a follow up to our previous discussion on September 8th in which I indicated it was the Town of Oro Valley's intent to file said annexation maps. As discussed with your office and Mr. Tony West, State Treasurer, it is imperative that the State Land Selection Board meet in early October 1997 to take action on this application for annexation of this state land into the Town of Oro Valley. The State Land property for annexation into Oro Valley is described as a Master Planned Community in the Town's General Plan which was just recently updated in July 1996. As you are aware, there are other significant events occurring in the Pima County area in regard to incorporation and it is the Town of Oro Valley's position that it is in the best interest of Oro Valley and the State Land Trust that this property be part of the Town of Oro Valley. Complete Legal description All of Section 16 in Township 11 South, Range 13 East, Gila and Salt River Meridian, Pima County, Arizona Existing County zoning The State land within the annexation area is zoned Pima County zone RH (Rural Home stead) which allows for one home per 4.1 acres. Proposed zoning Once the State land is annexed into Oro Valley, the Town would translate Pima County zoning(RH) Rural Homestead to Oro Valley zoning R1-144 with conditions, pursuant to ARS 9-462.04 (e) (Attachment B).However the Oro Valley Mayor and Council at their May 28, 2003 regular council meeting plan to consider this section of State Land as Open Space designation for the Oro Valley General Plan update. It is the Town's intent to then take the entire Plan, to the Voters of Oro Valley for ratification in the November election. Any County Overlay Plan While there are no formal overlays by Pima County, the section of State Land proposed to be annexed is subject to the Sonoran Desert Conservation Plan being proposed by Pima County(per Attachment C), and is in an A.P.I. application before the State Land Commissioner. The Town of Oro Valley supports Pima County request for this A.P.I. designation. (Per Attachment G) General Plan (map & description) The General Plan map for State Land Section 16 designates this area as (RLDR) Rural Low Density Residential and is depicted in Attachment D. Legal access to Trust property OR future planned access State Land Section 16 has no public access except through private roads in Pima County or through a gated community road in Oro Valley. Is the area in an established water service area? If not, will status change after annexation? This State Land is not in an established water service area. This status would change if the State Land is annexed into the Town of Oro Valley, by automatically becoming part of the Oro Valley water utility service area. Existing water infrastructure for potential development Currently there does not exist any water infrastructure within this State Land parcel. Oro Valley has existing water infrastructure in the section of land immediately adjacent to the east. This system could be extended and enhanced to provide water to this State Land parcel. Available sewer infrastructure As mentioned above the section of land immediately east of this State Land parcel has sewer infrastructure which could be extended to State Land. Any capital improvement plans or program to improve infrastructure Currently there are no capital improvement plans for this area. Existing land uses in vicinity The existing land uses in the vicinity of this State Land parcel are either vacant land or rural low density residential, and is illustrated in Attachment E. Development trends in vicinity The current development trends in the vicinity of this State Land parcel are(RLDR)rural low density, and is illustrated in Attachment F. Physical opportunities and constraints which may influence land use Much of the State Land in this request is rugged and mountainous in nature and has areas of intensive flooding during the summer monsoon rains. Anable State Land Commissioner 1616 W.Adams Street Phoenix, AZ 85007 Dear Mr. Anable: Thank you for the opportunity to comment on thea application submitted ubmitted by Pima County to reclassify over 9500 acres of State Land for conservation purposes. The Town of Oro Valley shares enthusiasm and support for the Tortolita Mountain Park in its totalityto pp majority of the request. Enabling would be become a preserve through the Arizona Preserve Initiative(API) a tremendous accomplishment and areat asset to the 9 State of Arizona. The Tortolita Mountain Park Plan (TMPP)was adopted in 1997 and includes its expanded boundary. The pendingrequestp a total of 6118 acres with from Pima County includes an additional 3441 acres that is not within the adopted Plan boundary. Although the additional area has been referred to a possible biological corridor, its inclusion in this request est poses some questions and concerns. First, if the primary purpose of this effort is to secure the beauty upland area, the area defined bytheadopted and pristine value of the Tortolita Tortolita Mountain Park Plan accomplishes this. Lands outside the TMPP area do not share the same characteristics topographically or biologically. Second, certain lands outside the TMPP boundaryfront onto for commercial and industrial development State Highway 77 which are designated in our adopted General Plan. Much of the frontage along Highway 77 has already been developed and includes a school, solid g numerous retail establishments and recentlyapproved waste transfer station, churches, housing developments. The Town's desire is to ensure the integrity of our General Plan and provide appropriate land usela p nning. Third, the Town is still interested in pursuing the annexation of State Lands within this area. Our goal would be to achieve the right balance of preservation and land use based on proven principles. We are concerned that inclusion of additional lands not contemplated in the Tortolita Mountain Park Plan ma restrict our options for annexation as well as thwart our desire to carry out our General Plany Plan. Lastly, The Town is more that willing to work out a logical wildlife Mountains and the Catalina Mountains to address the goal corridor between the Tortolita al of Pima County's Conservation Plan if the State Land Commission has interest in designating such lands.
