**3. EXECUTIVE SESSION AT OR AFTER 5:30 PM
Pursuant to ARS §38-431.03(A)(3), (A)(4) and (A)(7), Council may vote to
go into Executive Session for the purpose of consultation for legal advice
with the Town Attorney and for consultation with Town representatives
regarding the status of negotiations / eminent domain litigation for the
acquisition of all or part of the property known as Steam Pump Ranch
(Northwest side of Oracle Road, at Hanley Boulevard, Oro Valley).
**4. DISCUSSION AND POSSIBLE ACTION TO ACCEPT THE COUNTER-
OFFER REGARDING THE STEAM PUMP RANCH PROPERTY AND
AUTHORIZE THE TOWN MANAGER AND TOWN ATTORNEY TO TAKE

SUBJECT: Resolution No. (R)06-39 — Canvass of the Votes — Declaring and adopting the results of the
General Election held on May 16, 2006
SUMMARY:
The attached resolution declares and adopts the results of the General Election held on May 16, 2006. Attached
is the official canvass prepared by Pima County Elections dated 05/20/06.
Total number of valid ballots cast at said general election, was 7,928. (33.8%).
The following candidates received the highest votes, and are hereby elected to the Office of Council Member
effective June 7, 2006—May 2010:
Kenneth "KC" Carter 3472 (17.77%)
Al Kunisch 3445 (17.64%)
The following candidates are within three votes of each other concerning the third council seat, which triggers
the statutory automatic recount pursuant to ARS 9-821 and 16-661(A):
Paula Abbott 3430 (17.56%)
Don Cox 3427 (17.54%)
SUGGESTED MOTION: I move to approve Resolution No. (R)06-39.

RESOLUTION NO. (R)06-39
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF ORO
VALLEY, ARIZONA, DECLARING AND ADOPTING THE RESULTS OF THE
GENERAL ELECTION HELD ON MAY 16, 2006, AND DECLARING AN
EMERGENCY.
WHEREAS, the Town of Oro Valley, Pima County, Arizona did hold a general election on
the 16th day of May 2006, for the election of three council members for four year terms, and
WHEREAS, the election returns have been presented to and have been canvassed by the
Town Council,
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Oro
Valley, Pima County, Arizona, as follows:
SECTION 1. That the total number of valid ballots cast at said general election, was 7,928.
SECTION 2. That it is hereby found, determined and declared of record that the
following candidates received the highest votes and are hereby elected to the Office of
Council Member effective June 7, 2006—May 2010:
Kenneth "KC" Carter 3472 (17.77%)
Al Kunisch 3445 (17.64%)
SECTION 3. That it is hereby found, determined and declared of record that the following
candidates are within three votes of each other concerning the third council seat, which

WHEREAS, it being necessary for the preservation of the public peace and welfare, IT IS
FURTHER RESOLVED BY THE MAYOR AND TOWN COUNCIL that an emergency
exists because this resolution deals with time-sensitive election matters, therefore, this
resolution shall be in full force and effect immediately upon its adoption.
PASSED AND ADOPTED by the Mayor and Council of the Town of Oro Valley, Arizona
this 25th day of May, 2006, by a rate of ayes, nays and abstentions.

Funds included in the Oro Valley Water Utility Budget for FY 2006-07:
Enterprise Fund
This Fund accounts for the general operations and maintenance of the potable and
reclaimed water systems. Sources of revenue include water rates, service fees and
charges, interest earned on cash reserves, groundwater preservation fees and other
miscellaneous income. Expenditures include personnel, operations & maintenance costs,
debt service and existing system capital improvements. The groundwater preservation
fees are contributed to the AWRD Fund to assist with debt service.
Alternative Water Resource Development Fund (AWRD Fund)
This Fund accounts for expenditures for alternative water resource capital costs and any
related debt service. Revenues are received from impact fees and interest earned on cash
reserves. Groundwater Preservation Fees collected through the Enterprise Fund are
contributed to the AWRD Fund to assist with debt service. Specific activities include
analysis, planning, design and construction of infrastructure required to deliver
alternative water resources (CAP and reclaimed water)to the Town.

Development Impact Fee Fund (DIF Fund)
This Fund accounts for expenditures for potable water capital improvements that are
growth-related and debt service. Revenues are received from potable water development
impact fees. The impact fees collected are used for repayment of bonds sold to finance
the capital projects. Specific activities include design and construction of infrastructure
required to deliver potable water to meet the needs of future customers.

Water Utility Acquisition Fund
This Fund accounts for the possible acquisition and operation of water systems lying
within the Town boundaries that are not currently owned by the Town. Revenue for this
Fund would be proceeds from the issuance of bonds. Expenditures would include the
purchase of assets from other water providers and construction of improvements that
would allow those water systems to be connected to the Oro Valley Water system.

SUBJECT: Consideration of Additional Staffing in FY 2006-07
Oro Valley Water Utility (OVWU) respectfully requests the Town Council to consider the
addition of one new employee for the Water Utility for FY 2006-07. Initially the OVWU
requested 3 full time positions and 1 part time position. These included a planner, utility
operator, electronics technician and part time customer service representative. None of these
positions were included in the Town Manager's Budget in his effort to minimize new staffing
in order to implement the proposed salary adjustments. We are now requesting that one of
the positions be re-considered through Council's review of the proposed budget. We concur
with the proposed salary adjustments but also believe there is significant need to fill this
particular position.
Introduction
The position we are requesting is a Water Service Operator II that would be assigned to the
Water Quality Division of the Utility. There are currently two employees assigned to this
division. In addition to water quality, they are also responsible for the Backflow Prevention
and Safety Programs. The growth of our community has increased the size and complexity of
our water distribution system water quality sampling requirements. Additionally, drinking
water regulations continue to evolve in quantity and complexity. Water Quality and Backflow
Prevention are highly regulated programs that must meet rigid compliance requirements to
maintain a safe drinking water supply. Non-compliance in these programs may result in
violations, fines and/or legal action against certified operators as well as the Town. The Safety
Program must meet all OSHA requirements.
Water Quality
Currently, one employee is assigned to the Water Quality Section. The function of the Water
Quality Section is to insure the safety of our drinking water system by performing required
testing in accordance to federal and state regulations. In addition to collecting water samples
for testing, the duties include research and education pertaining to current and upcoming
drinking water regulations, establishing working relationships with federal, state and county
agencies to insure proper monitoring and compliance, coordination with local laboratories for
g � equipmentanalysis, interpretationanalytical data. Also, this
required sampling and anal.sis, and of
employee is required to manage the water quality data base and generate reports for the utility,customers and other governmental agencies. Additional non-compliance water quality
g
samp lin is performed when resolving customer problems. The number of required samples
fluctuates during a nine year monitoring cycle consisting of three monitoring periods. The
following table illustrates the number of required water samples from 2004 through 2007.

WaterqtY uali testing will increase in the near future as a result of new and modified federal

regulations on the Stage 2 Disinfectants and Disinfection By-products Rule which is intended
to reduce the risks associated with disinfection by-products. Other new federal rules that are
pending include radon aimed at protecting people from exposure to radon in drinking water
p g
and in-door air and the Ground Water Rule intended to protect people from disease-causing
viruses and bacteria. For operational purposes, basic water quality parameters such as pH,
total dissolved solids and conductivity should also be performed on a more regular basis.
Backflow Prevention & Safety
Y
oP, one employee tee is assigned to the Backflow Prevention Section. This employee is
also responsible for the Utility's Safety Program. The function of the Backflow Prevention
Program is to reduce the risk of contamination or pollution of the public water system in
accordance with federal and state regulations. By law, all commercial customers must install
and maintain private backflow prevention assemblies to protect against water system
contamination. The duties involved in this section include the inspection of all new
assemblies, maintaining a data base on all existing assemblies, notifying the owners of each
assembly when their assembly must be tested, and following up on the notifications to assure
that the testingis done and the assembly is in compliance. In addition, this employee
maintains and tests all Town-owned backflow assemblies. After the Utility installed fire
hydrant lockingdevices as a security measure, this employee became responsible to install,

repair, relocate and remove all construction related hydrant meters with backflow assemblies.
The following table illustrates the number of commercial and irrigation backflow assemblies
that are monitored, the number of hydrant meter assemblies, the number of new assemblies
that are inspected and entered into the data base and the number of Town-owned assemblies
tested and maintained during the years 2004 through May 17, 2006:

With the current staffing level, we are unable to survey all existing services that require
backflow. Additional surveys should be done to locate private wells that could possibly be
tied into thep ublic water system. With the use of reclaimed water for irrigation of medians,
schools, andp
P arks, the importance of backflow prevention becomes even greater. In the near
future, residential backflow protection should be investigated and considered to further
protect our water supply.
The Safetysection is responsible for safety related issues of Utility employees. The employee
p
attends Town meetings, conducts departmental training on a monthly basis, researches safety
issues and p
u
eqi ment and purchases all safety equipment for the Utility. The Utility has not
j
experienced a major accident and our Safety Program will help us maintain this record.
Summary
The addition of a new employee in the Water Quality/Backflow Division of the Water Utility
will significantly increase our capability to meet the needs of both programs. The workload
for these employees will continue to grow with the community as well as with the

implementation of new federal and state regulations. Additionally, it will facilitate the
opportunityfor cross-training in the different areas and provide back-up staffing for absences
related to illness and vacations.

The estimated costs associated with this position total $95,904 and are as follows:

The request for increase in costs is a result of the design engineering not being completed in FY 05-06.
Design will be completed early in FY 06-07 therefore the funds need to be included in the upcoming budget.
All of these projects are being funded with existing bond proceeds which remain available in either year.

The request for increase in costs for the in-line booster is a result of increased construction costs and change orders.
The request of increase in costs for mains is that the design will not be completed in FY 05-06. Funding for both
the in-line booster and the design and construction of the mains for Phase 2 is proposed to be accomplished by
advancing funds from the Enterprise Fund in FY 06-07 and then borrowing the total cost with the debt being
repaid by the AW RD Fund.

THE ORO VALLEY TOWN COUNCIL HELD ON MAY 16, 2006, AND
AUTHORIZING THE TOWN ATTORNEY TO FILE A PjTITION IN
SUPERIOR COURT, ACCOMPANIED BY SAID FACTS, FOR A RECOUNT BY
THE PIMA COUNTY ELECTIONS DIVISION; AND DECLARING AN
EMERGENCY TO EXIST
SUMMARY: Under ARS §16-661.A, the recount of the vote is required when the canvass of returns in
a general election shows that the margin between the two candidates receiving the greatest number of votes for
a particular office is less than ten votes in the case of an office to be filled by the electors of a town.
There is only a three vote difference between council candidates Paula Abbott and Don Cox according to the
final information from the Pima County Elections Department. We researched the automatic recount procedure,
conferred with Brad Nelson, County Elections Director, and determined the appropriate approach as set forth
below. The plan is for everything to be done so that the new council may be sworn in on June 7, 2006.
There is a statutory automatic recount process. Under §16-662, when the canvass shows that a recount is
required, the Mayor and Council shall forthwith certify the facts requiring a recount to the Pima County
Superior Court. A copy of the resolution certifying the facts requiring a recount for the third council seat is
attached.
A certification and request for a recount order will go with the resolution and a draft order, to be filed with the
Superior Court on Friday, May 26, 2006, and presented to the judge on duty that same day. The order should be
issued on Friday and delivered to County Elections. See ARS §16-663: "The superior court to which the facts
requiring a recount are certified shall forthwith make and enter an order requiring a recount of the votes cast for
such office." Sections 16-663 and 16-664 direct how the recount shall be conducted.
Pursuant to our discussion with Brad Nelson, we will provide in the order that the recount shall commence on
Wednesday, May 30, 2006 at 9 am. Candidates may attend if they wish. The process will be open to
observation.
ARS §16-665.A provides that: "The result of the recount shall be presented to the court, and the court shall
then announce the result and make and enter an order setting forth its determination." We will propose to the
judge that the return to court be set for sometime Thursday, June 1. Brad Nelson is in agreement with that
timing. A certified copy of the order of the court determining the election result shall then be delivered by the
clerk of the court to the Town Clerk who shall immediately deliver it to the candidate who has been certified by
the court as elected.

WHEREAS, Arizona cities and towns are required to canvas elections not less than six days and not
more than fifteen days following the election(ARS § 16-642[A]); and
WHEREAS, the Mayor and Council did canvas the May 16, 2006 election according to ARS § 16-
642(A)on May 25, 2006; and
WHEREAS, pursuant to the canvas of the election, the first two (2) council seats will be filled by K.C.
Carter and Al Kunisch as recipients of the highest vote totals; and
WHEREAS, Candidate Paula Abbott received only three (3)more votes than did Candidate Don Cox for
the third and final available council seat; and
WHEREAS,under Arizona law, an automatic recount of the vote is "required when the canvas of returns
. . . of a general election shows that the margin between two candidates receiving the greatest number of
votes for a particular office . . . is less than or equal to. . . [t]en votes" in the case of an office to be filled
by the electors of town (ARS § 16-661[A][6]); and
WHEREAS,the procedures under ARS § 16-662 are to be followed by Arizona cities and towns with the
difference being that under ARS § 9-821 "returns shall be made to the clerk of the city or town, and the
governing body of the city or town shall canvass the returns, declare the result and issue the certificates of
the election"; and
WHEREAS, pursuant to ARS §§9-821 and 16-662, when the canvas of the vote shows that a recount is
required the Town Council shall forthwith certify the facts requiring a recount to the superior court in the
county in which the canvass was conducted; and

WHEREAS, once the action is filed in the court, "[t]he superior court to which the facts requiring a
recount are certified shall forthwith make and enter an order requiring a recount of the votes cast for such
office" (ARS § 16-663); and
WHEREAS, once ordered by the court, the Pima County Elections Division performs the recount, and
"[t]he result of the recount shall be presented to the court, and the court shall then announce the result and
make and enter an order setting forth its determination" (ARS § 16-665[A]); and
WHEREAS, after the election results are announced by the court, a certified copy of the order of the
court determining the result shall forthwith be delivered by the clerk of the court to the Town Clerk who
shall forthwith deliver it to the candidate entitled thereto (ARS § 16-665[B][3].
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF ORO VALLEY, ARIZONA, certifying the fact that an automatic recount of the votes cast
in the May 16, 2006 election for Town Council is required pursuant to ARS § 16-661(A)(6) because
Candidate Paula Abbott received only three (3)more votes than did Candidate. Don Cox for the third and
final available council seat, seven (7) less than the minimum ten (10) required by law for an automatic
recount to be triggered.
BE IT FURTHER RESOLVED BY THE MAYOR AND TOWN COUNCIL authorizing the Town
Attorney to act on behalf of the Town and file the necessary documents with the Pima County Superior
Court and take all steps necessary for the Town to comply with the automatic recount statutes.
WHEREAS, it being necessary for the preservation of the public peace and welfare, IT IS FURTHER
RESOLVED BY THE MAYOR AND TOWN COUNCIL that an emergency exists because this
resolution deals with time-sensitive election matters and immediate action is necessitated by the recount
statutes; therefore this resolution shall be immediately effective upon adoption.
PASSED AND ADOPTED by the Mayor and Town Council of the Town of Oro Valley, Arizona this
25th day of May, 2006, by a vote of ayes, nays, and abstentions.

A number of issues were raised during the Mayor and Council's Budget Review Session
on May 15th. This memorandum serves as staff follow-up to these issues.
1) Issue: Add to May 25th Budget Work Session agenda the discussion of
additional personnel requests.

2) Issue: A list of facilities utilized by Parks and Recreation

• $125k for Magee Road overlay
• $80k for lighted street signs along Oracle Rd.
• $80k for an Asphalt Patching truck
• $1M loan transfer to the Roadway Impact Fee Fund
Response: The items have been added to the cumulative budget
adjustments worksheet.
5) Issue: Add line item to Stormwater Utility budget to reflect a possible
stormwater fee.
Response: A line item has been added with no revenue attached. Staff will
explore the feasibility of charging a stormwater utility fee during FY 06/07.
6) Issue: Utility truck bed for Custodial/Facility Maintenance.
Response: $10k has been added to the Minor Assets line item in
Custodial/Facility Maintenance budget.
7) Issue: A review of fees for Plan Reviews and Grading Inspections in Public
Works.
Response: Staff is reviewing this issue to determine when a study may be
completed and whether new fees would be ready to be adopted before FY
06/07 year-end.
8) Issue: A plan for the move of the Calle Concordia facility to the new
Municipal Operations Center.
Response: A master plan is being conducted by Deutsch and Associates
and should be completed by November 2006 with the design phase to be
performed December 2006 — May 2007. The Town Engineer will explore the
feasibility of an interim relocation plan from the Calle Concordia site.
9) Issue: Request for information on Arizona Municipal Risk Retention Pool
(AMRRP) liability insurance deductibles and coverage limits and Pool
coverage of legal expenses.
Response: Attached please find a response from the Town Attorney,
Melinda Garrahan.
10) Issue: Carry forward project costs for Economic Vitality Model.
Response: From the total project cost of$65k for FY 2005/06, $50k will be
carry forward to FY 2006/07.
11) Issue: Cost/benefit analysis on Public Works requested positions for Sr. Civil
Engineer Tech and Landscape Techs.
Response: Attached please find a 5 year cost benefit analysis for the three
positions requested.
12) Issue: Carry forward project costs for Enterprise Resource Planning (ERP)
system to FY 2006/07.
Response: The $125k estimated for FY 2005/06 year end will be carried
forward to the FY 2006/07 budget of $225k resulting in a total of $350k.
13) Issue: A request from Water Utility for a potholing machine originally omitted
from the Town Manager Recommended budget.
Response: $50k has been added to the cumulative budget adjustments

Re: Municipal Liability Coverage for 05-06
A request has been made for a summary of the specifics of our current insurance
policy throughthe Arizona Municipal Risk Retention Pool (AMRRP). The following
information addresses who and what is covered under the current policy, as well as the process
by which claims are made. Attached is a schedule of the current policy monetary limits
detailing the maximum coverage for each type of claim.
Who Is Covered?
1. The Town
a) Except for housing and redevelopment authority, economic development
authority,or municipal redevelopment authority
b) A joint ventures (joint powers agreement, IGA, mutual aid agreement, or similar
agreement)
2. Any Town elected or appointed official
3. Any person serving on the Town Council
4. Any employee loyee acting within the scope of their employment on behalf of the

Town orp ursuant to a mutual aid agreement with another government entity
5. Anyperson on a Town board, commission,or committee unless excluded above
6. Any Town volunteer while they are acting on behalf of the Town and at the Town's
direction
7. Any other authorized person or agent of the Town while acting on behalf of the Town

Independent contractors and "leased workers", those that are "leased" to the Town by a
labor leasing firm, are not covered by the policy. In addition, in the event a suit arises between
any of the above mentioned persons, the policy does not apply, i.e. if the Mayor sues the
Council, AMRRP would not cover any expenses related to the suit. This does not apply,
though, when the Town is itself the defendant in a suit or claim by another person listed
above.
What Is Covered?
AMRRP has the right and a duty to defend the Town against any covered claim or
lawsuit up to the policy's monetary limits. AMRRP reserves the right to investigate and settle
any claim or suit that arises. AMRRP will only cover acts that occur within the time periods
set forth in the policy and if the claim is presented to the Town within those same coverage
dates. Listed below are situations that are covered by the policy.
1. Claims and suits for monetary damages arising from "wrongful acts" of anyone listed
under "who is covered". "Wrongful acts" refers to accidents and negligent acts, but
does not include criminal, intentional or reckless acts. The policy also allows for the
payment of medical expenses related to claims for bodily injury, provided the
treatment and claim occur within one year of the date of the accident. In addition, the
injured party must agree to submit to medical examinations arranged by AMRRP as
often as they reasonably require.
2. Claims and suits for declaratory judgment or injunctive relief does a cost
share with the Town in these types of actions whereby AMRRP pays 50% of the first
$25,000 of the legal fees, 25%of the second$25,000, and the Town pays all expenses
over$50,000. In some cases,AMRRP will pay all the costs upfront and the settle with
the Town as to the cost sharing after the suit is resolved. The most AMRRP would pay
under these circumstances is $100,000.
3. Claims and suits arising from employment related situations. AMRRP will pay
damages for past or future wages and employment benefits, but not for claimed
increases in pay/benefits or fringe benefits.
4. Claims and suits arising from the enforcement of land use, zoning or subdivision
regulations and the approval/disapproval or any development/redevelopment project.
This is the only provision in the policy that requires a 20/80 cost split. The Town must
pay 20%of the cost of litigation or settlement and AMRRP pays 80%.
There are other situations covered by the policy that are not mentioned here as they are not
areas in which the Town is regularly involved.

What Is Not Covered?

enforcement to protect persons or property
2. Damages arising from contracts entered into by the Town
3. Workers' compensation,unemployment or disability claims
4. Damagesarisingfrom anytaking, annexation, condemnation, adverse possession or
similar action

6. Special events,i.e. fireworks displays,rodeos, skateboard facilities

What Is the Process Involved in Making a Claim?
Therocess begins when a wrongful act that may result in a claim occurs. The policy

sufficient details for AMRRP to begin an investigation. If and when the Town receives notice
claim, needs to be notified, in writing, as soon as possible. The Town must also
