At their January 10, 2006 meeting, PRAB designated a sub-committee to work on this assignment. The sub-committee met regularly over the next three months, delivering a final draft to the Legal Department in April of 2006. On May 2, 2006, PRAB unanimously approved a final draft to be presented to Town Council for review and consideration. SUMMARY: The draft Naming and Branding Policy includes three sections as follows: 1) Official naming and renaming of Oro Valley Parks; 2) Receipt of general gifts and donations; and 3) Sponsorship agreements and corporate naming. Each section of the proposed policy includes background, definitions, criteria, process and/or guidelines. OFFICIAL NAMING AND RENAMING OF ORO VALLEY PARKS BACKGROUND Parks are integral to Oro Valley's identity. As an agency devoted to public service through Parks and Recreation, it is a goal of Oro Valley Parks and Recreation to be seen as part of the fabric of the community. Stewardship of the public parks and recreation system for the greatest benefit of the community-at-large over the long term is a primary value. Names with geographic references, names based upon distinguishing characteristics and/or commonly used names have become the standard for this community. At the same time, it is recognized that individuals and community organizations may periodically wish to honor individuals or groups by naming parks after them. The challenge is to accommodate this wish, where warranted, while still supporting the primary community values. DEFINITION Parks or park sites are Town owned parks, preserves and open space. Park sites include developed and undeveloped park areas and designated open space areas. CRITERIA Park sites within the Oro Valley Parks and Recreation system will be named through an administrative process in accordance with the following established criteria which emphasize community identity and service through the Parks and Recreation system. However, Oro Valley Parks and Recreation is willing to consider any proposal submitted by the public. • If the Town elects to accept land by property donation or deed, any condition placed on the naming of the park shall be honored. • Parks named after an individual should include the geographic, natural, or geological features as part of the name. PROCESS: INITIAL NAMING OF PARKS AND FACILITIES A) Oro Valley Parks and Recreation may generate and/or receive written proposals for the naming of park sites. B) Written proposals shall include the following: 1) A statement as to how the name is consistent with the criteria stated in this Policy. 2) Justification for the suggested park name. C) In the event a park site is jointly or wholly acquired by other public agencies,but managed by Oro Valley Parks and Recreation, the other involved agencies shall be consulted and given the opportunity to submit a written recommendation as to the proposed name . D) All proposals shall be forwarded to the Oro Valley Parks and Recreation Advisory Board for review and recommendation. If the park site has significance to any other boards and/or committees, the proposal will also be forwarded to those boards and/or committees for their review and recommendation. E) All proposals and associated recommendations shall be forwarded to the Town Council for review and possible action. F) A majority vote of the Town Council will be required for naming a park. PROCESS: RENAMING OF PARKS Renaming of parks carries with it a greater burden of process compared to the initial naming of a park. Tradition and continuity of name and community identification are values that supersede fads and fashion. Each application must meet the criteria stated in this Policy, but meeting all criteria does not assure renaming a park. Donations are not intended as a substitute for basic government tax support. DEFINITION A gift, or money donated for a gift, is any equipment, furnishings, program materials, art or general cash donations to Oro Valley Parks and Recreation or to the Town of Oro Valley and specified for Oro Valley Parks and Recreation. This does not include special endowments or grants, which are handled on an individual basis. CRITERIA • Oro Valley Parks and Recreation highly recommends and strongly encourages groups and/or individuals discuss the possible donation with the Oro Valley Parks and Recreation Administrator prior to the actual donation. • Donations may be accepted on a restricted or unrestricted basis. The procedures for processing either type of donation are described below. • In the discretion of the Oro Valley Parks and Recreation Administrator, donated equipment, furnishings, program materials and/or art will be evaluated for quality and will only be accepted if they meet or exceed the standards set forth by the Administrator. GENERAL GUIDELINES All donations are considered final upon acceptance by Oro Valley Parks and Recreation. Oro Valley Parks and Recreation will make every effort to honor the donor's requests and specifications as closely as possible. Oro Valley Parks and Recreation will work with potential donors to develop mutually satisfactory donations. If it is not possible to meet a specific request, Oro Valley Parks and Recreation shall inform the donor who may reserve the right to withdraw any offer. Oro Valley Parks and Recreation reserves the right to reject any offer. All donations are tax deductible. However, Oro Valley Parks and Recreation staff cannot provide assessments of value of donated items. If needed for tax purposes, donors should have a professional appraisal performed prior to donating any items. Oro Valley Parks and Recreation, upon request, will provide a donation receipt that the donor may fill out for their own use. PROCESS A) Procedure for Restricted Donations: 1) Monetary donations of any amount that are given for a specific purpose shall be used for that purpose upon approval of the Parks and Recreation Administrator and Parks and Recreation Advisory Board. Should the requested use not be possible, the Parks and Recreation Administrator shall inform the donor, who may withdraw their offer for donation. 2) p Eq ui ment, artwork, and other materials donated upon condition of specific use will be approved by the Parks and Recreation Administrator on a case-by-case basis. B) Procedure for Unrestricted Donations: 1) The Oro Valley Parks and Recreation shall provide a priority wish list to citizens andp otential donors outlining Oro Valley Parks and Recreation needs. All accepted donations are appropriately and gratefully acknowledged in writing 2) Acceptance of Monetary Donations : a) Those making monetary donations are encouraged to do so by check. Checks should be made out to the "Town of Oro Valley" and forwarded to the Oro ValleyParks and Recreation Administrator. Cash gifts will be acknowledged by letter from the Oro Valley Parks and Recreation Administrator. Information regarding how the money will be spent will be included in the letter. b) Oro Valley Parks and Recreation staff will follow the Town's Procurement process for the expenditure of any monetary donations. Oro Valley Parks and Recreation and the donor must agree in writing to the payment method before final acceptance of any donation. c) Donations of$20,000 or more: (i) Donations of$20,000 or more will be reviewed by the Parks and Recreation Administrator who will submit a use recommendation to the Parks and Recreation Advisory Board based on current needs within Oro Valley Parks and Recreations. (ii) Parks and Recreation Advisory Board will review the Administrator's recommendation and forward it on to the Town Council with any additions or changes their review generates. (ii) The Administrator shall submit their recommendation(s) to the Parks and Recreation Advisory Board for approval. e) Donations of$1,000 and under can be approved by the Oro Valley Parks and Recreation Administrator without consultation of the Oro Valley Parks and Recreation Advisory Board. 3) Acceptance of Other Donations: a) Unrestricted donated art will be selected by the Oro Valley Parks and Recreation staff with advice from GOVAC, based upon the appropriateness and space availability within the park,building or facility. b) Donated parks or playground equipment, furnishings and/or program materials shall become the property of Oro Valley Parks and Recreation upon final delivery. Donations received without any restrictions as to use may be used in parks or programs, forwarded for sale by the Friends of the Parks, or disposed of in other appropriate ways. c) Parks and Recreation does not offer pick-up services for donated materials. This policy is not intended to facilities, prop � address the parks, preserves namingof and open spaces, as that is addressed by the OFFICIAL NAMING AND RENAMING OF ORO VALLEY PARKS section of this policy. DEFINITION A Sponsorship Agreement is a contract between the Town of Oro Valley and an external maybe an individual, corporation, partnership or other business entity or party which � organization ("Sponsor"),by the terms of which the Sponsor provides funds, goods or y services to the Town of Oro Valley, as consideration for recognition, acknowledgement or other promotional considerations or benefits, with respect to Town facilities, properties, amenities, events and programs. Sponsorship Agreements are distinct from individual,business or other donations or gifts to the Town for which there maybelimited recognition or no consideration, which very are addressed in the RECEIPT OF GENERAL GIFTS AND DONATIONS section of this Policy. The intent of this Policyis to establish a consistent approach, criteria and guidelines specific to the exclusive right to use the names of the Town of Oro Valley p facilities, properties, amenities, events and programs as a means of acknowledging a Sponsor. CRITERIA The Town will determine and use selection criteria, based upon the nature and character of each proposed ro d S onsorshi Agreement, to evaluate potential Sponsorship Agreement Sponsorship opportunities. The selection criteria used to evaluate a prospective sponsor may include, but not be limited to: • Consistency of Prospective Sponsor's products, customers and promotional goals with the Town's character, values and service priorities; • The ve Pros ectiSponsor's historical participation and association with the Prospective p communityprojects, events and continued willingness to participate; pJ • ve he Prospective Sponsor's regard for and demonstrated success in valuing T p p diversity within the community; • The Prospective regard S ' and for and demonstrated success in environmental stewardship; • Community support for, or opposition to, the proposed Sponsorship; • The operating eratin and maintenance costs associated with the proposed Sponsorship; • The level and significance of the financial contribution offered, with stronger consideration p for sponsorships of at least 51% of the cost/value of the given facility, property, amenity, event or program. C\Documents and Settings\bsioclair\Local Settings\Temporary Internet Files\OLKICI\Parks Rec Naminqnd Branding Policy 042706.doc The Town will not enter into a Sponsorship Agreement with the following: • Businesses that are subject to regulation or monitoring by local, state, or federal law enforcement agencies, including the Oro Valley Police Department, for regulatory compliance, including, but not limited to sexually oriented businesses, bars, gun shops, manufacturers or sellers of firearms or weapons. • Religious or political organizations. • Commercial enterprises whose business is substantially derived from the sale and/or or manufacture of alcoholic or tobacco products. • Individuals or commercial enterprises having past, present, or pending business agreements or associations with the Town, if a Sponsorship Agreement would create the appearance of impropriety. PROCESS General Guidelines: • The Town may actively solicit proposals for sponsorships, including naming rights for Parks and Recreation facilities, properties, amenities, events and programs. • The Town will only enter into Sponsorship Agreements that are consistent with the Town's character, values and service priorities. • No Sponsorship Agreement will impair or diminish the authority of the Town and p p � p its responsibilities with respect to any municipal facility or event that is the subject of the Agreement. • All Sponsorship Agreements shall be subject to all state, federal and local laws, ordinances, rules, and regulations. • Sponsorship Agreements which generate more than $20,000 in annual revenue or in-kind goods or services to the Town will be subject to the approval of the Town Council. • All naming rights agreements, regardless of dollar amount, will be subject to approval by the Town Council. • The Town shall always have the right and opportunity to reject any submitted proposal. • Any Sponsorship Agreement entered into by the Town shall include the right at any time to suspend or terminate the agreement if the circumstances arise whereby the continued arrangement would no longer satisfy the selection criteria by which the Sponsorship was initially evaluated and approved. Management and Oversight: All sponsorship proposals must be reviewed by Town Staff and the Oro Valley Parks and p p Recreation Advisory Board ("PRAB"). A Request for Proposals ("RFP) process will be undertaken by Parks and Recreation Staff for all sponsorships anticipated to generate over$20,000 in annual revenue, in-kind goods or services to the Town, to provide a fair C:\Documents and Settings\bsinclair\Local Settings\Temporary Internet Files\OLKICI\Parks Rec Nam418nd Branding Policy 042706.doc and competitive process. Sponsorships that are anticipated to generate less than $20,000 in annual revenue, in-kind goods or services will be solicited on an informal basis through publication of sponsorship criteria and allowing a period of time for potential sponsors to respond. Procedure: A) Potential sponsorship opportunities may be initiated by the Mayor and Council, Town Staff or members of the public. Town Staff will prepare a written description of all sponsorship opportunities, defining the scope of a sponsorship program or project, including a description of the community benefit, financial goals, means of recognition and potential interested sponsors, and submit the description to the Parks and Recreation Advisory Board. Parks and Recreation Advisory Board approval is required prior to submitting a potential sponsorship opportunity to the Town Council. If a potential Sponsorship Agreement will result in a name change to an existing facility, the history and"legacy" of the current facility name should be taken into consideration and/or incorporated within the proposed new name. B) If the potential Sponsorship Agreement includes naming rights to a facility, property, amenity, event or program, Town Staff will obtain preliminary approval for the project from Parks and Recreation Advisory Board and solicit the assistance of a qualified third-party firm that will determine the value of the naming rights. • Valuations must be provided as part of the cost/benefit analysis. • The valuation will establish the present market value of the facility's naming rights. • Valuations must be supported by sufficient financial analysis and credible study documentation. Valuations shall consider the following: 1) tangible ible assets that are the quantitative benefits arising from a sponsorship g package, such as media advertising, printed ticket logos or other publications; and 2) All intangible assets, which are the qualitative benefits which may arise from such a sponsorship, such as audience loyalty, recognizability and prestige of the organization's marks, logos and standing in the community; and 3) Geographic reach/market impact factors, such as the number, size and value of the market(s) in which the sponsor will promote its affiliation with the facility, event, or the desirability of Town property to a particular sponsor category. C) If ap otential Sponsorship Agreement will result over$20,000 in annual revenue, in- kind goods or services to the Town, either through direct revenue or through the value of the naming rights, Parks and Recreation Staff shall follow the Town's Request for Proposal (RFP) process to solicit sponsorship proposals. The Sponsorship Agreement shall be awarded to the potential sponsor whose proposal best conforms in all material respects to the requirements and criteria set forth in the RFP. E) The Parks and Recreation Advisory Board will review and approve all Sponsorship Agreements,regardless of amount. More, FAICP Planning and Zoning Administrator SUBJECT: STUDY SESSION - Proposed Multi-jurisdictional Planning Process for State Trust Lands North of the Oro Valley Town Limits, into Pinal County. ISSUE: The Arizona State Land Department has asked the Town of Oro Valley to participate in a conceptual land planning process for state trust land to the north of the Town limits and into Pinal County. The planning process would include representation from the Town, Pima County, Pinal County, the State Land Department and a private sector planningconsultant working on behalf of the State Land Department. The purpose of this study session is to update the Town Council on preliminary discussions to date and to provide an opportunity for direction to staff on the extent of Town participation. SUMMARY: Representatives of the Town, including Council Members Dankwerth and Gillaspie, the Town Manager and Assistant Town Manager, Community Development, Town Engineer, and Planning and Zoning, have met twice to have preliminary discussions with the planning group. The planning group is made up of representatives from the above noted jurisdictions. The group has discussed tentative boundaries of the study area extending up to include the Oracle Junction area, but has not finalized it. We have discussed the need to form a partnership to carry out this process, select a consultant, agree on a scope of work, and start working on the planning process soon. ORO VALLEY RESOURCES: The planning process will occur over the next 18 —24 months and will require staff support and other Town resources. Updated mapping and resource inventories are necessary as a part of the initial data gathering. While the Planning and Zoning Administrator will be the designated Town representative on the planning team, additional staff resources from several departments will be needed as a part of the process. In addition, the Arizona State Land Department (ASLD) has asked for financial assistance from all of the participating jurisdictions. This funding will primarily support the hiring of the planning consultant working for ASLD. By helping fund the consultant, the Town is assured participation in the consultant selection and oversight of the project. The Assistant Town Manager has reviewed similar ASLD planning projects and has found that a commitment level of$30,000 would be an appropriate level of funding by the Town. ASLD wants to have a consultant selected in July. The Southern Arizona office of ASLD indicates that this project is one of their top priorities. ANNEXATION POLICY: One of the issues preliminarily discussed by the group is to what extent the Town's participation in the planning process is a commitment to annex all or part of the planning study area. The Oro Valley General Plan does include that area north of the Town limits up to the Pinal County line. The General Plan designations do not include specific development concepts, rather land use designations for open space, resource areas,residential, master planned community and campus park industrial land uses.
