would deliver this in person, but since it is what appears to be a
simple Consent Agenda item, it is unlikely this will be pulled for
discussion. I request that this communique be made a part of the
public meeting record and minutes for the upcoming meeting.
I've attached the pertinent Ordinance for Consent Agenda Item C
and highlighted the most important section in yellow.
For those of you that campaigned for office under the banner of the
terrible horrors of "blading and grading" along with its videos, I'd like
to point out the section of this dealing with the numbers of acres
reduced for development, i.e. what was originally entitled being
reduced from 250 acres to 131. Along with this also came 600
acres of permanent open space and the very trails that are part of
the upcoming meeting agenda.

Perhaps there was some misunderstanding of what was approved
by the pervious Council or perhaps misrepresented as part of
election rhetoric.
In any case, I think this is worth noting this for its true value to the
community.

AN ORDINANCE OF THE TOWN OF ORO VALLEY, ARIZONA,
AMENDING THE RANCHO NISTOSO PLANNED AREA
DEVELOPMENT TO REMOVE THE EXISTING ZONING
DESIGNATIONS OF COMMERCIAL (C-1), MEDIUM HIGH
DENSITY RESIDENTIAL, AND RECREATION AREA/GOLF
COURSE AND TO RECONFIGURE THE REMAINING ZONING
DESIGNATIONS OF OPEN SPACE AND MEDIUM DENSITY
RESIDENTIAL FOR THE 131 -ACRE RESIDENTIAL
DEVELOPMENT LOCATED NORTH OF TANGERINE ROAD
AND WITHIN THE RANCHO VISTOSO BOULEVARD LOOP
WHEREAS. the Applicant has requested a rezoning, amendment to the Rancho Vistoso
Plarmed Area Development (PAD) to remove the existing zoning desl2mations of
Con-uwrcial (C-1). Mediim High Dei-tsity Residential, and Recreation Area/Golf Course
and to reconfigure the reimitl*ma zoning designations of Open Space and Medium
Denser Residential for the 131 -acre residential development located north of Tangerine
Road and within the Rancho Vistoso BOLdevard Loop, attached hereto as Exhibit "A"...

WHEREAS, the rezoning anrndn-rnts to the PAD will ipprove the existing land Use
design to: 1) slrink- the developable area kom 250 acres to I'] -acres- I) better respect
the floodplain boundaries and adjacent uses: J) create approxirmtely 600 -acres of
permanent open space; and 4) dedicate legal and continuous access for existingtrails on
the property,- and
WHEREAS, the Plaruikg and Zonings Commission held duly noticed public hearings on
October 3, 2017, and November 8. ?017. and voted to recon-unend approval to the Town
COL11161, subject to the conditions hi Exhibit "B"; and

t submit to you that these assertions, action stems, etc.
do not reflect the importance of Public Art in the daily fives
and culture of Oro Valley.
Further, I submit that there are ample examples where large
developments that included 1% Public Art have not only
been proven to be a positive factor, but motivated the
management to expand the appreciation of Public Arts.
1, When Ventana Medical proposed their Headquarters
in Oro Valley, some of us were able to meet with dr.
Tom Grogan, founder to discuss the 1%. He embraced
the program and carried it to a higher level by
establishing a Corporate Art Gallery to encourage
young artists to exhibit and also have showings of
prominent artists.
Z. The Oro Valley Hospital spent 432,,800 dollars
complying with the 1%. It received awards from
Industry Groups as well as a prominent recognition
by the Metropolitan Pima Alliance, a prestigious
Non Profit that supports Business Development
Projects that effect the community in a positive
way. It is part of what they call "Common Ground
Award" given at a popular yearly banquet.
The Hospital management continues their enthusiasm
for the Art.
There are other examples, such as the (conic Sun Dial on
Innovation Drive,, that started out as a $104,000 project, but
soon got the developer enthused and exceeded his
requirement to around $125,000.
It is natural that Developers would balk at first learning of the
1%. I believe negotiation and willingness to conclude a plan
that includes Art is possible in every instance. Public Art is
The Soul of Our Town and will always be something to be
proud of.

containing an example of the first ten years projects. If not,

in conclusion, I ask the Council to recognize the important

value of Public Art to the community and to reject the anti
public art sections of the proposal.

As the Chair of the Arts Advisory Board, I am writing to begin implementation of a General Plan action
item related to funding for public art. The plan recognizes public art as a key element of our community's
cultural resources.
Table 4.10.5-1, as unanimously adopted by the Town Council, calls for the adoption and implementation of
a Percent for Public Art Ordinance. The members of the Arts Advisory Board believe that the ordinance
dealing with funding for arts tied to public projects should become part of the Town Code.
Provisions for public art within private commercial and office projects should also be accommodated
within the Zoning Code. We understand that these changes may be handled as part of amendments related
to the development review process.
We recommend that the Council initiate amendments to the Town Code allocating 1% of the cost of all
public projects to provide funding for public art related to public projects.
We further recommend that the Council direct the Planning and Zoning Commission to initiate
amendments to the Zoning Code to provide a similar allocation for public art in private commercial
developments.
The General Plan calls for this action item to be complete within one to three years of adoption. We are
now approaching one year past adoption of the plan. If we are to adopt and implement these provisions
within the prescribed timeframe, it is imperative that work begin as soon as possible. This is particularly
true as we approach development of the parks system.
