EXECUTIVE SUMMARY: The Town Code and the Town Council Parliamentary Rules & Procedures and Code of Conduct both require the use of action minutes for all Town Council and board and commission meetings. As required by Arizona Revised Statute 38-431.01, Action Minutes contain the following information:  Date, time and place of a meeting The members of the public body recorded as either present or absent A general description of the matters considered A description of all legal actions proposed, discussed or taken, and the names of the members who proposed each The names of persons making statements or presenting material and the item to which their comments relate BACKGROUND OR DETAILED INFORMATION: Action minutes have been utilized since 2012 for all Town Council and board and commission meetings. The video and/or audio recordings of all Town Council and board and commission meetings serve as an important recordation method rather than detailed minutes, as the recordings are archived on the Town's website and can be accessed at any time by the public. The use of Action Minutes has greatly reduced staff time required to transcribe minutes, not only in the Clerk's Office but in every department that produces the various board and commission minutes. Since the change to Action minutes, nearly 1,200 staff hours per year have been saved. LA CANADA DRIVE REGULAR SESSION AT OR AFTER 6:00 PM CALL TO ORDER Mayor Winfield called the meeting to order at 6:01 p.m. ROLL CALL PRESENT: Joseph C. Winfield, Mayor Melanie Barrett, Vice Mayor Joyce Jones-Ivey, Councilmember Josh Nicolson, Councilmember Rhonda Piña, Councilmember Bill Rodman, Councilmember Steve Solomon, Councilmember PLEDGE OF ALLEGIANCE Mayor Winfield led the audience in the Pledge of Allegiance. TOWN MANAGER’S REPORT Town Manager Mary Jacobs presented the Town Manager's Report and included the following: - Town Manager Mary Jacobs recognized Town staff for their collaborative efforts in isolating and repairing a water main break that occurred on February 27, 2019. - Ms. Jacobs thanked the community for their patience while the front lobby of the 3-6-19 Minutes, Town Council Regular Session 2 Administration Building was remodele d. - Ms. Jacobs provided an overview of the Move Across 2 Ranges event that occurred on March 2, 2019. - Ms. Jacobs asked that residents be mindful of construction crews and students when driving on La Cholla or avoid the area while under construction. Oro Valley resident Tony Be retta voiced his concerns about the potential building heights proposed in Rooney Ranch Area 3. Oro Valley resident Daniella Beretta voiced her concerns regarding the scenic corridor. PRESENTATIONS 1. Recognition of Outgoing Board and Commission Members Mayor Winfield recognized outgoing Board and Commission Members. 2. Presentation and possible discussion of the Town’s Fiscal Year 2018/2019 Financial Update through December 2018 Administrative Services Director/CFO Stacey Lemos presented the FY 2018/19 Financial Update through December 2018 and included the following; - FY 18/19 Budget by Fund as % of Total Budget - General Fund Revenues - General Fund Expenditures - Highway Fund - Community Center Fund 3-6-19 Minutes, Town Council Regular Session 3 - Water Utility Fund and Stormwater Utility Fund - Questions Discussion ensued amongst Council and staff regarding the Town's Fiscal Year 2018/19 Financial Update through December 2018. Resolution No. (R)19-08, authorizing an intergovernmental agreement between the Town of Oro Valley and the Regional Transportation Authority (RTA) of Pima County for the funding of traffic signal equipment under the Regional Traffic Signal Program D. Approval to amend the 2019 Council Liaison assignments by adding a Council Liaison to the Budget and Finance Commission MOTION: A motion was made by Councilmember Rodman and seconded by Councilmember Jones-Ivey to approve Consent Agenda items (A), (B) and (D). Resolution No. (R)19-09, authorizing and approving an intergovernmental agreement (IGA) between the City of Phoenix Police Department and the Town of Oro Valley Police Department for the Arizona Internet Crimes Against Children Task Force Councilmember Piña requested additional information regarding internet crimes against children. Lieutenant John Teachout provided further information regarding internet crimes against children. MOTION: A motion was made by Councilmember Piña and seconded by Vice Mayor Barrett to approve Resolution No. (R)19 -09, authorizing and approving an Intergovernmental Agreement (IGA) between the City of Phoenix Police Department and the Town of Oro Valley Police Department for the Arizona Internet Crimes Against Children Task Force. Fire Marshall for Golder Ranch Fire District, Will Loesche , spoke regarding the recommended ingress and egress of the proposed project. 3-6-19 Minutes, Town Council Regular Session 6 Discussion continued amongst Council, staff, Mr. Longaker and Mr. Morris. Mayor Winfield requested from the applicant and staff to look into the following concerns: - Minimize site grading as much as possible - Would like to see 75% open space - Preferred at least 10 foot setbacks - Look at mix of uses to improve development possibilities - Clarify exemptions within the Oracle Road Scenic Corridor - Provide a view shed analysis of the site - Obtain noise readings and provide noise reduction or mitigation options MOTION: A motion was made by Mayor Winfield and seconded by Vice Mayor Barrett to continue Ordinance No. (O)19-04, authorizing and approving the proposed amendment to the Oro Valley Town Center, to the April 3, 2019 Town Council meeting . MOTION carried, 4-3 with Councilmember Piña, Councilmember Rodman, and Councilmember Solomon opposed. 2. DISCUSSION AND POSSIBLE ACTION ON A CONCEPTUAL SITE PLAN AND LANDSCAPE PLAN FOR A PROPOSED 21 LOT SINGLE -FAMILY RESIDENTIAL SUBDIVISION, LOCATED ON THE NORTHEAST CORNER OF LAMBERT LANE AND SHORE CLIFF DRIVE Senior Planner Milini Simms presented ite m #2 and included the following: - Purpose - Existing Zoning - Conceptual Site and Landscape Plan - Proposed In-Lieu Fee for Rec Area - Public Participation - Summary and Recommendation Discussion ensued amongst Council and staff regarding item #2. MELCOR USA Assistant Development Manager, Hugo Blanco, addressed Council questions. The following individual spoke in opposition to item #2: Oro Valley resident Bill Babir Discussion continued amongst Council, staff and Mr. Blanco regarding item #2. 3-6-19 Minutes, Town Council Regular Session 7 MOTION: A motion was made by Vice Mayor Barrett and seconded by Councilmember Jones-Ivey to approve the Conceptual Site Plan and landscape Plan for the proposed 21 lot subdivision on Shore Cliff Drive, finding the request is in conformance with the Design Principles and applicable Design Standards. MOTION carried, 7-0. 3. DISCUSSION AND POSSIBLE ACTION ON RESOLUTION NO. (R)19 -10, PROVIDING NOTICE OF INTENT TO INCREASE WATER RATES FOR THE ORO VALLEY WATER UTILITY Water Utility Director Peter Abraham presented item #3 and included the following: - Notice of Intent ot Increase Water Rates - Schedule MOTION: A motion was made by Councilmember Piña and seconded by Councilmember Jones-Ivey to approve Resolution No. (R)19 -10, providing notice of intent to increase water rates for the Oro Valley Water Utility. Proclamation - World Down Syndrome Day Mayor Winfield proclaimed March 21, 2019 as World Down Syndrome day in the Town of Oro Valley. Katie Ferguson expressed her gratitude for the proclamation of World Down Syndrome Day in Oro Valley. 2. A. Minutes - February 27 and March 6, 2019 Mayor Winfield requested that the minutes for March 6, 2019 be updated to include the specific direction given to staff regarding a proposed zoning amendment to the Oro Valley Town Center Planned Area Development. MOTION: A motion was made by Mayor Winfield and seconded by Councilmember Nicolson to approve the February 27, 2019 Town Council minutes and to continue the March 6, 2019 Town Council minutes to the April 3, 2019 Council meeting for approval. MOTION carried, 7-0. B. Request for approval of a Final Plat for the Saguaro Viejos West residential subdivision, located near the northwest corner of La Cholla Boulevard and Na ranja Drive Vice Mayor Barrett requested clarification regarding the Final Plat for Saguaro Viejos West residential subdivision. Planning Manager Bayer Vella clarified the request for approval of a Final Plat for the Saguaro Viejos West residential subdivision. Discussion ensued amongst Council and staff regarding item B. MOTION: A motion was made by Vice -Mayor Barrett and seconded by Councilmember Nicolson to approve the Final Plat for the Saguaro Viejos residential subdivision, based on the finding that it meets Town requirements and with the condition that details listed in Town Code regarding which saguaros shall be preserved in place be included in the Final Plat. MOTION carried, 7-0. C. Resolution No. (R)19-11, approving the dedication of public easements for Trail No. 331, Trail No. 33 and drainage maintenance and access associated with the Valley Vista subdivision located north of Tangerine Road and east of Rancho Vistoso Boulevard along the future Moore Road Loop extension D. Resolution No. (R)19-12, authorizing and approving an Employment Agreement for the Town Magistrate, George Dunscomb 3-20-19 Minutes, Town Council Regular / Study Session 4 E. Resolution No. (R)19-13, authorizing and approving a subgrantee agreement between the Town of Oro Valley and the Arizona Department of Homeland Security to fund overtime and mileage under the Operation Stonegarden program F. Resolution No. (R)19-14, authorizing and approving a subgrantee agreement between the Town of Oro Valley and the Arizona Department of Homeland Security to fund the purchase of three(3)License Plate Readers under the Operation Stonegarden program MOTION: A motion was made by Councilmember Rodman and seconded by Councilmember Solomon to approve Consent Agenda items (C) - (F). (R)19-15, DISCUSSION AND POSSIBLE ACTION REGARDING THE FY 2019/20 - FY 2020/21 TOWN COUNCIL STRATEGIC LEADERSHIP PLAN Town Manager Mary Jacobs gave a brief overview of the FY 2019/20 - FY 2020/21 Town Council Strategic Leadership Plan. Discussion ensued amongst Council and staff regarding item #1. MOTION: A motion was made by Vice -Mayor Barrett and seconded by Councilmember Nicolson to approve Resolution (R)19-15, adopting and approving the FY 2019 -20- FY 2020/21 Town Council Strategic Leadership Plan. MOTION carried, 6-1 with Councilmember Piña opposed. FUTURE AGENDA ITEMS Mayor Winfield requested a presentation on FlashVote, seconded by Councilmember Solomon. CALL TO AUDIENCE No comments were received. EXECUTIVE SUMMARY: The purpose of this request is to consider a Final Plat for Phase 1 of the Saguaro Viejos East residential subdivision, located near the northwest corner of La Cholla Boulevard and Naranja Drive (see image to the right). Final Plats are legal documents used to formally subdivide the property to sell the individual lots. The entire subdivision includes 178 lots on approximately 86 acres and will be developed in three phases. Final Plats for the subsequent phases will be presented for Town Council consideration at a future time. The proposed Final Plat (see Attachment 2) for Phase 1 consists of 97 detached single-family residential lots (out of the 178 lots) on approximately 47 acres. The subdivision design features gated access off both Naranja Drive and La Cholla Boulevard. The plat preserves approximately 20 acres of open space, which also includes buffer yards, a recreation area and a portion of a public trail (running north to south) shared between this development and Saguaro Viejos West.  Lastly, the conservation of large Saguaros and the timing and improvements to Glover Road were major components for design approval. As such, stipulations for both are included as general notes (notes 7, 10 and 31, respectively) on the plat. 98% of the Saguaros in Phase 1 will either be preserved in place or transplanted on site. A condition is included in Attachment 1 to reflect the preservation and salvage of cacti. In summary, the Final Plat for Phase 1 of Saguaro Viejos East meets Town requirements and conforms to the approved rezoning and conceptual site plan designs. Therefore, staff recommends approval subject to the condition in Attachment 1. In 2018, the Town Council approved a rezoning and accompanying Tentative Development Plan for all three phases of the Saguaro Viejos East development. The conservation of large Saguaros (general note 7) and the timing and improvements to Glover Road were major components for design approval. Although the rezoning condition defined the improvements for Glover Road (general note 10), the timing and responsibility of them is now divided between this property and the Saguaro Viejos West development. As such, general note 31 on the Final Plat further clarifies the timing of Glover Road improvements. With regard to Saguaro conservation, the inventory for Phase 1 includes 310 Saguaros, of which 32 are significant  per the Zoning Code (at least 15' feet with 2 or more arms). Five of the significant Saguaros are 24' or taller with two or more arms and must be preserved in place per a rezoning condition. Overall, ninety-eight percent (98%) of the Saguaros will be preserved in place or transplanted onsite and five are being removed. All five Saguaros being removed are in poor health as verified onsite with staff. A condition is included in Attachment 1 to reflect the preservation and salvage of Saguaros. Meeting Date:04/03/2019   Presentation - Water Resources Strategic Plan Information Subject PRESENTATION AND POSSIBLE DISCUSSION REGARDING AN UPDATE ON THE ARIZONA DROUGHT CONTINGENCY PLAN AND ORO VALLEY'S WATER RESOURCE STRATEGIC PLAN Summary The designated representatives of the seven States of the Colorado River Basin have signed the Colorado River Drought Contingency Plan.  The plan has been sent to Congress for approval.  Federal legislation and subsequent implementation of the agreements will enable prompt action to enhance conservation of Colorado River water.  This plan will assist in reducing the probability that Lakes Powell and Mead will decline to critically low elevations. Furthermore, the Colorado River Drought Contingency Plan provides priority Central Arizona Project sub-contract holders, like Oro Valley, with greater water resource certainty enhancing the Water Utility's ability to successfully plan strategically for the communities existing and future water resource needs.
